FINDINGS AND REPORT
The application of Mr. Marvin Poer, Lot 11-MR, Middleridge
Tract, for a conditional use permit under Article III, Section 3.06
Front Yard Requirements, Ordinance No. 33 came on for hearing on
the 19th day of March, 1974 in the Council Chambers of the Admin-
istration Building, 2 Portuguese Bend Road, Rolling Hills, California
and the applicant, having submitted evidence in support of the
application, the Planning Commission, being advised, now makes its
Findings and Report as required by the Ordinances of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Marvin Poer,
is the owner of that certain real property described as Lot 11-MR,
Middleridge Tract, located in the City of Rolling Hills, California,
and that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California.

The Commission finds, further, that no communication, written
or oral, had been received in opposition to the request for per-
mission to construct a barn in the front yard, and that Mrs. Arlene
Lawler, 15 Middleridge Lane North, who was present at the hearing
stated that Middleridge Lane is a cul de sac with minimum traffic,
and she thought location of the barn on level ground close to the
road would not infringe on any properties in the area.

The Commission further finds that the applicant stated that
an area in the front yard across from the residence had been graded
prior to the time he purchased the property, and that he had graded
an access to the location. The architect advised the Commission
that the floor of the barn would be 14 feet below road level and
the construction would be 16-17 feet high, so there would be no view
obstruction. The Commission finds that a conditional use permit for
construction of a barn in the front yard, with the provision that the
height be limited so that the roofline be not more than two feet above
the lowest point of the road grade on the Poer property should be
granted in order to preserve substantial property rights possessed
by other property in the same vicinity and zone.
IV.
From the foregoing it is concluded that a variance of Front
Yard Requirements under Article III, Section 3.06 of Ordinance No. 33
should be granted by the Planning Commission of the City of Rolling
Hills to Mr. Marvin Poer, Lot 11-MR, Middleridge Tract, in accordance
with the plot plan marked Exhibit I on file in these proceedings, and
it is, therefore, so ordered.
