A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ROLLING HILLS APPROVING AN
EXTENSION OF APPROVAL FOR A VARIANCE TO THE FRONT YARD
AND SIDE YARD SETBACKS AND FOR A SITE PLAN REVIEW
IN ZONING CASE NO. 408
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Dr. Robert
Moore with respect real property located at 11 Middleridge Lane
North, Rolling Hills, (Lot 7-MR) requesting an extension on a
variance to the front yard and side yard setback requirements to
construct additions to the existing nonconforming residence and site
plan review approval for proposed additions to the existing
residence, and which had a date of expiration for the approval on
November 14, 1990.
Section 2. The Planning Commission conducted a duly noticed
public hearing to consider the application on September 18, 1990.
Section 3. Section 17.32.110 (A) provides for the Planning
Commission to grant an extension for up to one year on an Variance
approval. Section 17.34.080 (B) provides for an extension for up to
one year on a Site Plan Review approval upon application by the
property owner, and that a public hearing is to be held and an
approval granted in the same manner and based upon the same criteria
as for the issuance of a new permit.
Section 4. Pursuant to the foregoing Section, the Planning
Commission makes the finding that previous findings determined with
the approved Resolution No. 89-29, dated November 14, 1989, can be
restated=

Section 5. Based upon the foregoing Section, the Planning
Commission hereby approves the extension of approval for Zoning Case
No. 408 to permit a one year extension of the Site Plan Review
approval to November 14, 1991.

SITE PLAN REVIEW APPROVAL IN ZONING CASE NO. 408
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Applications were duly filed by Dr. Robert Moore
with respect to real property located at 11 Middleridge Lane North,
Rolling Hills (Lot 7-MR) requesting a variance to the front yard and
side yard setback requirements to construct additions to the existing
nonconforming structure and site plan review approval for proposed
additions to the existing residence.
Section 2. The Planning Commission conducted a duly noticed
public hearing to consider the application on October 17, 1989 and
November 14, 1989, and conducted a field site review on November 11,
1989.
Section 3. Sections 17.32.010 through 17.32.030 permit
approval of a variance from the standards and requirements of the
Zoning Ordinance when exceptional or extraordinary circumstances
applicable to the property and not applicable to other similar
properties in the same zone prevent the owner from making use of a
parcel of property to the same extent enjoyed by similar properties.
Pursuant to these Sections, the Planning Commission finds that:
A. Portions of the existing residential structure already
encroached into the front yard and side yard setbacks. The
proposed encroachments involves additions to the residence
and expansion of the existing attached garage. The proposed
improvements vary as to the extent of encroachment into -the
front yard, and will encroach to a maximum of thirty-two
(32) feet into the front yard setback where an existing
nonconforming encroachment of thirty-two (32) feet already
exists. The proposed improvements in the side yard will
encroach a maximum of ten (10) feet into the side yard
setback where an existing nonconforming encroachment of ten
(10) feet already exists.
B. Due to the existing site development, the proposed additions
cannot be located elsewhere on the property. The proposed
additions would not extend the new structure beyond the
point at which the nonconforming residential structure

presently exists, meaning that there will be no greater
incursion into the front yard or side yard than already
exists on the property at this time.
C. In view of the topographical situation and the presence of
an existing incursion in the front yard, there exists unique
circumstances not generally applicable to other properties
in the same zone that justify the continued encroachment.
D. The grant of a variance under these circumstances will not
be detrimental to the public health, safety and welfare and
will be compatible with surrounding properties and will be
consistent with the goals of the Zoning Ordinance.
Section 4. Based on the foregoing findings, the Planning
Commission hereby approves the Variance for Case No. 408 to permit an
encroachment to a maximum of 32 feet into the front yard setback and
an encroachment to a maximum of 10 feet in the side yard as indicated
in the Development Plan submitted with this application and
incorporated herein by reference as Exhibit A, subject to the
following conditions:
A. The variance to the front yard and side yard setbacks as
indicated on the Development Plan shall not be effective if the
existing residential structure is demolished.
B. The variance to the front yard and side yard setbacks shall
expire if not used in one year from the effective date of approval as
defined and specified in Section 17.32.110 of the Municipal Code.
C. The proposed building plan must be approved by the Rolling
Hills Community Association Architectural Committee before the
applicant receives a building permit from the County of Los Angeles.
D. The working drawings submitted to the County Department of
Building and Safety for plan check must conform to the Development
Plan approved with the variance..
E. Exterior mechanical equipment, including, but not limited
to, air conditioning units, shall not be installed in any required
yard.

approved by the Planning Commission.
