213, A side yard variance to increa, Staff ReportsCITY OF ROLLING HILLS PLANNING COMMISSION REPORT ON: ZONING CASE NO. 213 APPLICANT: Mr. and Mrs. William Campbell No. 3 Middleridge Lane Rolling Hills, California LOCATION: 3 Middleridge Lane Rolling Hills, California VICINITY MAP CITY OF ROLLING HILLS DATE OF HEARING ZONING CASE NO. 213 JULY. 18, 1978 APPLICANT'S PROPOSAL: To establish and maintain a stable and make additions to a legally established single family residence with a modification of the required front and side yards in Zone RAS (Residential Agrictulture - Suburban) DATA BEARING IN THIS CASE NOTED AS FOLLOWS: 1. Location and Description of Subject Property Address: 3 Middleridge.Lane The subject property is an irregular shaped 1.426 acre lot divided by Middleridge Road along a 145 foot frontage, all measurements being approximate. The subject property is developed with a single family residence on the part easterly of Middleridge Lane. The residence and roadway are a the high point of the property which slopes downward to the east and west. The paved area in Middleridge Lane is not centered4and a portion is constructed outside the roadway right of way at the southerly property line. 2. Description of the Project The applicant proposes to construct a 862 square foot barn westerly of Middleridge Lane at approximately 0' setback. from the roadway right of way and from 30 to 40 feet from the existing roadway pavement line. The applicant further proposes to continue the existing building lines of the residence within the required side yard setback. The applicant's plan. indicates that all new construction on the residence will be a minimum of 30 feet from the roadway right of way. 3. Surrounding Area The property adjacent and to the north and south are developed with single family residences. Construction in required yards is common in the area of the subject property. 4. Roads The subject property fronts approximately 145 feet along Middleridge Road a 50 afoot wide roadway with variable width paving. 5. Modification of required setbacks were previously granted by Zoning Case No. 130 STAFF RECOMMENDATION The proposed room additions to the single family residence will not project farther into the required yard than the existing legally established residence. The proposed barn area is remote from the paved portion of the roadway. • The location of the roadway improvements and the division of the lot by the roadway right of way create a double front yard setback limitation on this property Numerous other residences in the immediate area of the subject property are constructed with less than the required setbacks. The staff therefore recommends conditional.approval of zoning case No. 213 subject to the following conditions Should the Commission grant the Zone Variance, certain conditions should be made a part of such grant. The following list of con- ditions are provided for the commission's consideration: 1. That this Zone Variance shall not be effective for any purpose until the owner of the property involved, or his duly authorized representative, has filed with the City Clerk of the City of Rolling Hills his affidavit stating that he is aware of, and accepts, all the conditions of the Permit. 2. That it is declared to be the intent that if any provision of the grant is held or declared to. be invalid the permit shall be void and the privileges granted thereunder shall lapse. 3. That it is declared and made a condition of the grant, that if any condition thereof is violated, or if any law, statute, or ordinance is violated, the Permitshall be suspended and the privileges granted thereunder shall lapse; provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days. 4. That all requirements of the Zoning Ordinance and of the specific zoning of the subject property must be complied with unless otherwise set forth in the variance or shown otherwise on the approved site plan. 5. That the barn structure be maintained not less than 5 feet from theroadway right of way. 6.
