Allen Lay at Monday's City Council meeting.
As presented in the conceptual plans to the City Planning Commission and the City
Council, we intend to have a basement in our new home. 1 am aware that the Association
is in the process of writing new guidelines concerning basements and light -wells for
basements.
1 assure you that we intend to fully comply with the Association's basement guidelines in
the design and construction of our new home.

Dear Mr. and Mrs. Chelf:
This letter is to inform you that at the February 12, 2007 City Council meeting,
Councilmembers took Zoning Case No. 732 under jurisdiction citing concern over the
design of the basement, exits from the well, slope behind the basement wall and the
appearance of a two story structure due to the exposed area of the basement above the
well wall.
A public hearing in this matter before the City Council will be held on Monday, February
26, 2007 at 7:30 PM in the Council Chambers.
Please submit 8 sets of site plan for the project including cross sections, elevations,
including elevation of the basement depicting the windows and doors, and any other
materials you deem necessary for City Council's consideration. Please submit the plans
and documents no later than Thursday, February 22, 2007.
You will receive a notice of the public hearing before the City Council, as well as the staff
report that will be presented to the City Council. You or your representative(s) must be
present at the meeting.

Dear Mr. and Mrs. Chelf:
This letter shall serve to notify you that the Planning Commission adopted a resolution on January 16,
2007 granting your request for Site Plan Review and Variance in Zoning Case No. 732. That action,
accompanied by the record of the proceedings before the Commission will be reported to the City
Council on FEBRUARY 12. 2007 at their regular meeting beginning at 7:30 PM. You or your
representative should be present to answer any questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days after the adoption
of the resolution by the Commission, unless an appeal has been filed or the City Council takes
jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of the Rolling
Hills Municipal Code). Should there be an appeal, the Commission's decision will be stayed until the
Council completes its proceedings in accordance with the provisions of the Municipal Code.
If no appeals are filed within the thirty (30) day period after adoption of the Planning Commission's
resolution, the Planning Commission's action will become final and you will be required to cause to be
recorded an Affidavit of Acceptance Form together with the subject Resolution in the Office of the
County Recorder before the Commission's action takes effect.
The staff report to the City Council, together with the Resolution will be mailed to you on Friday,
February 9, 2007. Please review the Resolution. After the City Council's action, I will forward to you
instructions for recordation of the Affidavit Of Acceptance Form and the Resolution.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING APPROVAL FOR ASITE PLAN REVIEW FOR
GRADING AND CONSTRUCTION OF A NEW SINGLE FAMILY RESIDENCE
TO REPLACE AN EXISTING RESIDENCE AND REQUEST FOR VARIANCES
TO ENCROACH INTO THE FRONT SETBACK AND TO EXCEED THE
MAXIMUM PERMITTED DISTURBED AREA OF THE LOT IN ZONING CASE
NO. 732, AT 22 MIDDLERIDGE LANE NORTH, (LOT 1-MR), (CHELF).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Bradford
Chelf with respect to real property located at 22 Middleridge Lane North (Lot 1-
MR), Rolling Hills, CA requesting a Site Plan Review and Variances to permit
grading and construction of a new 4,374 square foot single family residence, a
portion of which would encroach into the front yard setback, 832 square foot
garage, 96 square foot service yard, 266 square feet covered porches and 2,739
square foot basement.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the application on September 19, 2006, October 17, 2006,
November 21, 2006, December 19, 2006 and at a field trip visit on October 17,
2006. The applicants were notified of the public hearings in writing by first class
mail. Evidence was heard and presented from all persons interested in affecting
said proposal and from members of the City staff and the Planning Commission
having reviewed, analyzed and studied said proposal. The applicants'
representatives were in attendance at the hearings.
Section 3. The applicants propose to relocate the driveway and the
driveway approach. The Traffic Commission reviewed the location of the
proposed driveway approach and recommended approval without conditions.
Section 4. At the October and November meetings, the Planning
Commission expressed concerns regarding the size of the proposed development
and the many Variances being applied for. Subsequently, the applicants scaled
down the project and withdrew two variances. Ultimately the project was
approved with the encroachment into the front setback and the exceedance of the
maximum permitted disturbed area of the lot.
Section 5. The Planning Commission finds that the project qualifies as
a Class 3 Exemption (The State of CA Guidelines, Section 15303) and is therefore
categorically exempt from environmental review under the California
Environmental Quality Act.
Section 6. Section 17.46.030 requires a development plan to be
submitted for Site Plan Review and approval before any grading requiring a

This letter shall serve to notify you that the Planning Commission voted at their
regular meeting on December 19, 2006 to direct staff to prepare a resolution to
approve your request in Zoning Case No. 732 and shall be confirmed in the draft
resolution that is being prepared. The Planning Commission will review and
consider the draft resolution, together with conditions of approval, at an
upcoming meeting on JANUARY 16, 2007 and make its final decision on your
application.
The findings and conditions of approval of the draft resolution will be forwarded
to you before the Planning Commission meeting.
The decision shall become effective thirty days after the adoption of the Planning
Commission's resolution unless an appeal has been filed or the City Council
takes jurisdiction of the case within that thirty (30) day appeal period. (Section
17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal, the
Commission's decision will be stayed until the Council completes its proceedings

As stated above, the Planning Commission's action taken by resolution
approving the development application is scheduled for Tuesday. Tanuary 16,
2007 at 6:30 n.m. That action, accompanied by the record of the proceedings
before the Commission, is tentatively scheduled to be placed as a report item on
the City Council agenda at the Council's regular meeting on Monday Tanuary 22,
2007.

August, 1986, by end between THE CITY OF ROLLING HILLS ESTATES, a Municipal
Corporation ("City"), and Elizabeth Moore ("License Holder"), with respect to
the following circumstances:

1. RECITALS: This Agreement is made and entered into with respect to the
following facts:
a. That License Holder is owner in fee of certain real property
located within the County of Los Angeles commonly known as 22 Middleridge
Lane North, Palos Verdes Peninsula, California 90274:

right -of -sway commonly known as Palos Verdes Drive North along its northerly
boundary in the City.
2. LICENSE: City does.hereby grant a revocable License to License
Holder allowing her to encroach upon the public right-of-way adjacent to the
northern end of 22 Middleridge Lane, Palos Verdes Peninsula for the purposes of
ecceseing the horsekeeping facilities and enclosing and using an area approx-
imately 138 feet by 45 Feet by the erection and maintenance of a three rail
wooden fence ("Fence").
3. TERMS: The License" granted hereunder shell be subject to the

License and at the License Holder's sole cast and expense, maintain in good
order and make repairs for damages arising from vandalism, erosion or any
other cause to the Fence, access, any other structures, landscaping, paving
and improvements upon the public right-of-way, and shall keep the right-
of-way free of rubbish and debris end in a clean, safe, sanitary and neat
.condition at all times.
J. City may make, at its discretion, any repair or perform any
maintenance to insure that said encroachment area and access is adequately
and safely maintained. However, in the event repair or maintenance is
necessary due to License Holder's negligence or failure to provide proper
maintenance of the area as required in Paragraph 3(i) above, License Holder
shall be liable for the cost of said repairs or maintenance.
k. If, at any time, the Fence or access is modified, destroyed or
removed, whether by License Holder, City or otherwise, the rence and/or
acoese may be reconstructed, provided it meets all applicable laws in
effect at the time of reconstruction. Any modifications to or recon-
struction of the Fence must conform to the requirements of City in effect
at that time.
4. INSURANCE: License Holder, et all times during the term of this
Agreement, shall carry public liability and property damage insurance which
shall name the City as en additional insured, covering its operations and
obligations hereunder in an amount not less than $$00,000.
License Holder shall cause to be issued to the City certificate of
insurance, in a form acceptable to the City, evidencing that said insurance has,
in fact, been obtained and is in full force and effect prior to commencing
activities pursuant to this Agreement. 'Said certificates shall also provide
that if the insurance policy or policies are modified. or cancelled, the insur-
ance carrier shall so notify the City in writing at least thirty (30) days prior
to the modification or cancellation. ,

limited to the area shown in the diagrams attached hereto and incorporated
herein as Exhibit "A".
c. The Fence and access shall be erected and/or constructed in the
manner and to the specifications shown in the diagrams attached hereto as

Exhibit "A". No other structure of any kind shall be constructed in the
area of encroachment.
d. Only vehicular or pedestrian access necessary to feed and
maintain the horses being kept on the License Holders' property shall be
permitted.
e. The amount of vehicular traffic shall be kept to the minimum
amount necessary to Feed end maintain the horses on License Holders
property because of the traffic hazard of ingress and egress to Palos
Verdes Drive North.
f. No more than three family -owned horses may be kept in this area
of encroachment.
g. Any encroachment by License Holder on said public right-of-way
pursuant to this License shall conform to all applicable City Ordinances.
h. The interest created hereunder may be subject to property
taxation as a possessory interest of License Holder. Any real property or
other taxes or general or special assessments of any nature eseeseed upon
the land or any interest created by this License shall be paid by the
License Holder not later than fifteen'(15) days prior to the date when'the
same becomes delinquent, and evidence of payment thereof shall be promptly
submitted to City.

removed within thirty (30) days thereafter by License Holder or the City
may remove or cause the removal of said Fence and/or access et License
Holder's expense. The City will not be held liable for any damage to the

SILHOUETTE CONSTRUCTION GUIDELINES
When required by the Planning Commission or City Council, a silhouette of
proposed construction should be erected for the week preceding the
designated Planning Commission or City Council meeting.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not
acceptable.
Bracing should be provided where possible.
Wire, twine or other suitable material should be used to delineate roof ridges
and eaves.
Small pieces of cloth or flags should be attached to the wire or twine to aid in

information/plan for the above noted applications and finds that the information

at their meeting on Tuesday, September 19, 2006, beginning at 6:30 PM in the Council
Chambers, Rolling Hills City Hall Administration Building, 2 Portuguese Bend Road,
Rolling Hills. The property owners or their designated representative must attend to
present the project and to answer questions.
The staff report for this project will be available at the City Hall after 3:00 PM on Friday
before the meeting. We will forward a copy of the staff report to you and your
representative.
PLEASE NOTE: IF YOUR REQUEST IS GRANTED, YOU WILL BE REQUIRED, IN
ADDITION TO MEETING ALL OTHER REQUIREMENTS OF THE CITY'S ZONING AND
BUILDING CODES, TO PLACE THE UTILITY LINES TO ALL STRUCTURES ON THE
PROPERTY UNDERGROUND, AND THE ENTIRE ROOF WILL HAVE TO BE OF CLASS
"A" ASSEMBLY AND CLASS "A" CONSTRUCTION MATERIAL AS APPROVED BY THE
ROLLING HILLS COMMUNITY ASSOCIATION.
