Main buildings, accessory buildings, structures, tennis courts, swimming pools, service yards
(enclosed or unenclosed), stables, or an area of not less than 1,000 square feet for the
construction of a stable and corral (with vehicle access thereto) shall not cover more than
twenty percent (20%) of the net lot area, provided further that in addition to the above
described improvements, the areas included within driveways, parking space, walks, patios,
decks and asphalt or concrete paving of any kind excepting roads maintained by the Rolling
Hills Community Association, shall not cover more than thirty-five percent (35%) of the net
lot area.
For the purposes of this Section "net area" shall exclude: a) any and all perimeter easements
measured to a minimum lineal distance of 10 feet perpendicular to the property lines; b)
any portion of the lot used for roadway purposes; c) any private drive or driveway which
provides access to any other lot or parcel; and d) the access strip portion of any flag lot.
COMPUTATION OF BUILDABLE AREA AND COVERAGE THEREOF
A policy of the City is to address coverage of an identified "EXISTING BUILDABLE
AREA." Coverage thereof is based upon the calculation of the "footprint" square footage
of the residence, garage, stable (barn), and other accessory structures proposed and/or
developed on said "buildable area."
For purposes of this calculation, "buildable area" shall be defined as stated in Section
17.12.020 of the Rolling Hills Municipal Code which declares existing "buildable area" as the
portion of a lot that constitutes the existing building pad and any other contiguous portion
of the lot WITHIN ALLOWABLE SETBACKS THAT HAS AN AVERAGE SLOPE OF TEN
PERCENT (10%) OR LESS. If there is no existing building pad, it shall mean that portion
of a lot within allowable setbacks that has an average slope of ten percent (10%) or less.

Rancho Del Mar Continuation High School conducts classes at the property
site which serves the Palos Verdes Peninsula Unified School District.
The high school serves the communities of Rolling Hills, Rolling Hills
Estates, Rancho Palos Verdes and Palos Verdes Estates, The high school
has a capacity of 125 students but, varies substantially and quickly as
students can graduate at any time during the 10 month school year. Also
during the school year, eight teachers, one principal and a secretary
commute to and from the property.
For the entire year, a large portion of the site is used for the storage
and maintenance of school district vehicles and equipment. There are 23
school maintenance workers who park their vehicles at the property and
work off -site during the day. There are 5 warehouse workers who work
on -site during the business day. Access to the school district property
is via Crest Road from the west portion of the property outside the
gates of the City of Rolling Hills.
The Palos Verdes Peninsula community benefits are that the school
district site is being used for the education of Peninsula High School
students, and for the storage and maintenance of school district
vehicles and equipment. These uses do not impede one another. The site
is screened by landscaping from the road.

The text of the City's Zoning Ordinance must be amended. This is
because Section 17.16.040(B) of the Zoning Code lists the types of uses

are requested are not included in that list. Therefore, in order to
allow the maintenance and warehouse facility area to be used for the
storage parking only of local joint powers transit agency vans and for
the related administrative uses, Section 17.16.040(B) would have to be
amended to make that proposed use one of the types permitted with a
Conditional Use Permit. In addition, the proposed use would require a
Conditional Use Permit for the district property.

SETTING
Item 31.148. Description of project site.
The project site is a large ±31.14 acre parcel consisting of undulating hillsides and
knolls covered by grasses, and mature shrubs and trees, with some areas being
heavily wooded. Currently, there are 12 one-story structures at the site. They consist
of 7 school buildings, 1 maintenance building, 1 warehouse building, 1
computer/office equipment repair building, 1 vehicle repair shop, and 1

administration building. A long tree lined driveway off Crest Road West outside
the City of Rolling Hills' gates beginning at the westernmost portion of the lot
serves as the accessway to the Palos Verdes School District property.
The school district is requesting to amend the Rolling Hills Zoning Ordinance and
requesting a Conditional Use Permit to permit portions of a high school
continuation school and maintenance and warehouse facility at the Palos Verdes
Peninsula Unified School District property to be used by a joint powers transit
agency for administrative uses and the storage parking only of 10 vans at the site.
The site will continue to be used for the Rancho Del Mar Continuation High School
and the storage and maintenance of school district vehicles and equipment.
Native brush grows on the steep slope at the rear of the lot. Trees and shrubs
surround the existing facility at the south, west and north. with native plants,
grasses, shrubs, and trees beyond the facility area. Native birds and animals frequent
the area such as sparrows, crows, raccoons, possum, skunks, gophers and an
occasional fox.
Item 39. Description of surrounding properties.
The site is located within a one unit per 2-acre designation and is surrounded at the
north and west by one-story ranch style development with agricultural
outbuildings. The Mary & Joseph Retreat property and St. John Fisher Church
property, respectively, are located directly to the west of the school district property
in the City of Rancho Palos Verdes. One and two story residential housing in the
City of Rancho Palos Verdes is located to the southwest.

The following analysis is a description of the findings contained in the
Environmental Information and Checklist Form which preceded this page. A
detailed discussion of all potential environmental impacts checked "Yes" or
"Maybe" is provided, along with appropriate mitigation measures.
ENVIRONMENTAL IMPACTS
Item 40. Earth.
The proposed use will not require any development on the site.
Item 41. Air
The proposed use will generate slight increases in vehicle trips. It is determined
that there will be approximately 40 additional average daily trips (ADT). The 10
transit agency vans will leave and return approximately 2 times a day. The total

transit agency vans will leave and return approximately 2 times a day. The total
number of vehicle trips are equivalent to the total ADT of 4 single family residences
which average 10 ADT's per residence. Regionally, the ADT's of the transit agency
vans will be shortened because it will not be necessary for the vans to travel from
and to the current Long Beach facility 4 times a day during "down" time. The
impact on air quality in the City of Rolling Hills will be less than significant.
Item 42. Water
The proposed use will not require any development on the site and the impact
generated from the storage parking only of 10 vans will be less than significant.
Item 43. Plant Life
The proposed use will not require any development on the site. No known rare
and endangered species of plants exist in the City. The impact of the current
proposal is expected to be less than significant.
Item 44. Animal Life
The proposed use will not require any development on the site. The only animal
listed by the Federal Government is the Palos Verdes Blue, a butterfly which was not
seen in the Rolling Hills area from 1986 to 1994. In 1994, the Palos Verdes Blue was
seen at the nearby San Pedro Fuel Depot Station. Several other animals do occur,
however, that are considered as candidates for protection by either the Federal
Government or the State Government. Recently, the California gnatcatcher was
added to the list of endangered species and, in a recent census, pairs were located in
the adjacent City of Rancho Palos Verdes. Other target species for the Rancho Palos
Verdes Peninsula Area that are being studied by the State of California Department
of Fish and Game are the Cactus Wren and the Coast Horned Lizard. The impact of
the proposed use of portions of a maintenance and warehouse facility area of school
district property to be used by a joint powers transit agency for administrative uses
and the storage parking only of 10 vans at the site is expected to be less than
significant.
Item 46. Light and Glare
The proposed use will not require any development on the site. The 10 joint
powers transit agency vans will leave and return approximately 2 times a day. The
use of running lights will be required only during dense fog or early winter
evenings. Vans will access the the school district site from outside the City. Dense
landscape screening surrounds the school district site at the west, north and east.
Light and glare impacts therefore are expected to be less than significant.

Item 52. Transportation/Circulation
a. The proposed use will generate slight increases in vehicle trips. It is

SECOND AMENDED AGREEMENT
THIS SECOND AMENDED AGREEMENT is entered into this 8th day of May,
1990, BY AND BETWEEN THE CITY OF ROLLING HILLS, a municipal corporation,
(hereinafter "City") and the PALOS VERDES PENINSULA UNIFIED SCHOOL DISTRICT
(hereinafter "District).
RECITALS
1. On November 25, 1985, City and District entered into an agreement settling
and resolving a dispute over the use of the La Cresta Elementary School (hereinafter
"La Cresta") as a continuation high school generally known as the Rancho del Mar
Continuation High School.
2. In the agreement the parties agreed to the location of the Rancho del Mar
Continuation High School at the La Cresta site for a period of twenty-four (24) months
during which time the parties were committed to meet and negotiate with respect to the
long-term utilization of that site. The agreement also set forth certain conditions under
which the school was to operate so as to assure that it would be a good neighbor to
the nearby residences.
3. That agreement was first amended on November 16, 1987. During the course
of the past two years, the parties have met and engaged in discussions concerning the
Tong -term future development of the La Cresta site as contemplated by the agreement
but no definitive conclusions have been reached and no definite plans on the part of
the district have been prepared.
4. District desires to extend the period of time within which it may continue to
use the La Cresta site for the Rancho del Mar Continuation High School and during
which time it will both develop plans for the Tong -term development of the site and
meet with the City to accomplish the District's objectives and best integrate any future
development into the City. It is City's desire to obtain assurances that District's
development plans will either require relocation of the continuation high school or
integration of the high school into a total overall development that will be harmonious
with other uses proposed for the entire site.
5. It is the purpose of this Second Amended Agreement to accomplish the
aforementioned objectives of the parties and to supersede the First Amended agreement
dated November 16, 1987.
NOW, THEREFORE, the parties agree as follows:
1. District agrees to take such action of its Board as is legally necessary to
continue to locate Rancho del Mar Continuation High School temporarily at the La
Cresta site and that such decision shall be effective for a period not to exceed twenty-

four (24) months.
2. During this twenty-four (24) month period, District and City agree to meet and
negotiate in good faith for the purpose of evaluating the highest and best use of the La
Cresta site, and the means by which the site's value for sale and development may be
increased, with the objective of either relocating the high school to a different permanent
campus or integrating the high school into the total site plan design in a harmonious
manner. The parties agree to meet on a regular basis to fully explore the alternatives
available for the development of the La Cresta site and on a regular basis as
determined by the parties to provide progress reports on actions taken in that regard.
3. During the period that the Rancho del Mar Continuation High School is
temporarily located at La Cresta, District shall comply with the following conditions in
respect of the school's operations:
(a) If City determines after observation of school operations and
discussions with District officials that it would prefer the gate at the foot of
the stairway leading to the residential area to be chain locked with the key
to be administered by City, City may give notice of its determination to
District. Within 60 days after receiving such notice from City, District shall
completely enclose the stairway by installing fencing 5 feet in height along
both sides of the entire length of stairway, chain lock the gate at the
bottom of the stairway, and furnish the key to the lock to the City to be
maintained and administered by City at the gate house;
(b) District shall maintain the existing landscaping along the south
side of Crest Road along the northern boundary line of District's property.
Said maintenance shall include irrigation, pruning, replacement of dead or
diseased landscaping and any other measures reasonably necessary to
maintain the landscaping in a flourishing and attractive condition;
(c) Rancho del Mar Continuation High School shall operate only
between the hours of 7:30 a.m. and 4:00 p.m.; no evening Rancho del
Mar Continuation High School activities of any kind shall occur on the
property except for specific events agreed upon by the parties;
(d) All students who drive an automobile to Rancho del Mar
Continuation High School shall register their automobile with the school
and theschool shall provide them with a sticker which must be affixed to
the front windshield of the car. A separate parking area with sufficient
spaces shall be reserved for Rancho del Mar Continuation High School
students. The school reserves the right to limit parking privileges of its
students and may also reserve parking for guests and business visitors;
(e) Average daily attendance of no more than 150 high school
students;
(f) Any operation (other than Rancho del Mar) utilizing the campus
under lease or other arrangement other than civic center uses mandated
upon the .District shall comply with City's conditional use permit
requirements. To the extent allowed by law, Harbor College shall continue
to be subject to CUP requirements;
(g) Smoking shall be limited to a specified, supervised area;
(h) Community members shall continue to have permission to utilize
the playing fields on the site; and,
(i) The fields on the site shall be kept free and clear of dry brush
and weeds and non -paved areas shall be regularly watered to eliminate
dry and hazardous conditions;
4. District agrees that it shall not sell all or any portion of its property in Rolling
Hills at this location without first providing the City not less than ninety days written
notice of its intention to do so. In the event the District proposes to sell all or any
portion of the site and to continue operating the school on a portion of the site, the
parties shall renegotiate this Agreement to ensure that such a mixed use proposal is
consistent with the neighborhood. Until and unless such a new agreement is
renegotiated, the terms and conditions of this Agreement shall remain in full force and
effect.
5. It is understood and agreed that the terms and conditions recited hereinabove
are not to be construed as an admission of liability on the part of the parties hereto and
that the parties have entered into this Agreement as evidence of their mutual goodwill
and willingness to cooperate in resolving a dispute without resort to litigation.
6. The parties hereto represent and warrant that this Agreement has been duly
authorized, executed, and delivered in the manner required by lax, that all official
action necessary to authorize and approve the Agreement has been taken, and that the
Agreement constitutes the legally binding obligation of the parties, enforceable in
accordance with its terms.
7. This Agreement may not be amended without further written agreement of
both parties.
8. This Agreement shall be governed by and construed in accordance with the
laws of California: The parties acknowledge and agree that in the event of any breach
of this Agreement, by either party, money damages would be an inadequate remedy.
Accordingly, this Agreement may be enforced by specific performance, mandatory or
prohibitory injunction, or other appropriate order or decree.

9. Any notice required or contemplated by this Agreement shall be given in
writing by personal delivery, or by prepaid registered or certificated mail, return receipt
requested, and shall be effective upon receipt. Notice shall be given to the following

effect.
12. This Agreement shall inure to the benefit of and be binding upon the
representatives, successors -in -interest, heirs, and assigns of th; parties hereto.
