132, Construct a tennis court in th, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Richard Colyear Lot 241A-MS ZONING CASE NO. 132 FINDINGS AND REPORT The application of Mr. Richard Colyear, Lot 241A-MS, Miscel- laneous Tract, for a conditional use permit under Article III, Section 3.06, Front Yard Requirements and Section 3.07, Side Yard Requirements, Ordinance No. 33 came on for hearing on the 21st day of May, 1974 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as re- quired by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Richard Colyear, is the owner of that certain real property described as Lot 241-A-MS, Miscellaneous Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission finds, further, that no communication, written or oral, had been received in opposition to the request, and that a letter had been received from Mr. and Mrs. R. I. Mahan, 33 Crest Road West, stating that they have no objection to the construction under specific conditions, specifically that their view is not blocked. Further, the Commission finds that in approving the tennis court plan in the front yard, the Board of Directors on April 4, 1974 had imposed conditions regarding trimming of trees and preservation of view III. The Commission further finds that the property on which the tennis court is planned is a flag lot resulting from subdivision, and the tennis court will not be on Crest Road, although access is from Crest Road. Further, the applicant advised the Commission that when the property was subdivided he had included a condition in the modi- fication of Deed Restrictions that the property could never be sub- divided further in order to prevent overdevelopment of the site, and the conditional use permit is required because the tennis court will be located in the front yard between the residence and the front property line. The Commission finds that a conditional use permit for construction of a tennis court in the front yard should be granted in order to preserve substantial property rights possessed by other property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance of Front Yard Requirements and a Conditional Use Permit for construction of a tennis court in the front yard under Article III, Section 3.06, Ordinance No.33 should be granted to Mr. Richard Colyear, Lot 241A-MS, Miscellaneous Tract, subject to the following conditions: 1) That the conditions imposed by the Board of Directors of the Rolling Hills Community Association be complied with. 2) That the deed for quitclaim of easement on the southerly boundary of the property in the area of the tennis court construction, granted by the Board of Directors, be presented to the Manager. 3) That three copies of the tennis court plan, incorporating conditions of approval by the Board of Directors and the Planning Commission be submitted to the Architectural Committee, and it is, therefore, so ordered. /s/ Godfrey Pernell CHAIRMAN, PLANNING COMMISSION ui TARY, PLANNING) OMISSION
