Project Description: Request to extend and modify an expiring Conditional Use Permit to permit portions
of the Palos Verdes Peninsula Unified School District Crest Road property used for
a maintenance and warehouse facility to continue to be used by the Palos Verdes
Peninsula Transit Authority for administrative uses and increase storage parking
from 10 vans to 14 vans at the school district property.
Findings of Exemption (Attach Required Findings):
The Planning Commission finds that there is no evidence that administrative office uses and storage parking
of 14 vans at school district property will have an effect on endangered or threatened species of plants and
animals.
The Planning Commission finds that that administrative office uses and storage parking of 14 vans at school
district property will not have an effect on wetlands and that water courses will not be eliminated or
converted.
The Planning Commission has determined that the proposed administrative office uses and storageparking
of 14 vans at school district property will not have a significant adverse impact on the environment and has
adopted a Negative Declaration consistent with the provisions of the California Environmental Quality Act
(CEQA).
Certification:
I hereby certify that the lead agency has made the above findings of fact and that based upon the initial study
and hearing record the project will not individually or cumulatively have an adverse effect on wildlife
resource as in Section 711.2 of the Fish and Game Code.

RESOLUTION NO. 95-16
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A CONDITIONAL USE PERMIT FOR JOINT
POWERS TRANSIT AUTHORITY LIMITED USES IN ZONING CASE NO.
532.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. On August 7, 1995, applications were duly filed by the Palos Verdes
Peninsula Unified School District with respect to real property at the ±31.14 acre western
portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting (1) to
amend the Rolling Hills Zoning Ordinance to allow joint powers transit authority uses as
a conditionally permitted use in the RA-S-2 Zone; and (2) a Conditional Use Permit to
allow portions of school district property used as a maintenance and warehouse facility at
the Palos Verdes Peninsula Unified School District property to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at the
Palos Verdes Peninsula Unified School District Crest Road property at 38 Crest Road West,
Rolling Hills, CA (±31.14 acre western portion of Lot 74-MS).
Section 2. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2) education
material and library facility building, (3) warehouse building, (4) district maintenance
building, and (5) an elementary school building, The Conditional Use Permit expired on
February 26, 1964 and no new buildings were constructed.
Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2) elementary
school building, and (3) district maintenance building. The Planning Commission found
that the construction and location of the proposed administration building, maintenance
building and garage would establish and permit a commercial use of the property that
would consist of a garage for the storage of approximately thirty-seven (37) diesel school
buses, a facility for repairing, maintaining and servicing the buses, a warehouse for the
storage of school supplies and a repair/workshop for the repair and maintenance of school
property, all of which uses will create noise, dirt and confusion from 6 AM in the morning
until approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property adjoining
the school property and interfere with the enjoyment of the residential use of the adjacent
properties by the residents and owners.
Section 4. Applications were made for the subject project by the Palos Verdes
Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning staff
prepared an initial study for the project. The initial study found that the project would not
have a significant effect on the environment. A Negative Declaration was prepared and
was circulated to the applicant and other interested parties in accordance with State of
California CEQA Guidelines. The public notice of the Planning Commission's intent to
RESOLUTION NO. 95-16
recommend approval of the Negative Declaration was published on August 31, 1995.
Copies of the Negative Declaration were sent to adjacent cities and other government
agencies. No comments on the Negative Declaration were received.
Section 5. The application applies to the ±31.14 acre western portion of Lot 72-RH.
The General Plan Land Use designation for this property is Very Low Density Residential
2+ Net Acres per Dwelling Unit.
Section 6. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone designation for
the subject site is RA-S-2 and the zone designation on adjacent properties is RA-S-2.
Section 7. The project as proposed is to permit portions of school district property
used as a maintenance and warehouse facility to be used by a joint powers transit authority
for administrative uses and the storage parking only of 10 vans at the site. The site will
continue to be used for the storage and maintenance of school district vehicles and
equipment. The school district proposes to permit a joint powers transit authority to use
500 square feet of the northernmost portion of a 7,600 square foot warehouse for
administrative uses and 2,500 square feet of an existing asphalt paved area of school district
property for the storage parking only of 10 vans.
Section 8. The Planning Commission conducted a duly noticed public hearing to
consider the applications on September 19, 1995 and October 17, 1995. The applicants were
notified of the public hearing in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal, from all persons protesting
the same, and from members of the City staff and the Planning Commission having
reviewed, analyzed and studied said proposal. Palos Verdes Peninsula Unified School
District representatives were in attendance at the hearing.
Section 9. The Planning Commission has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and that it
was prepared in compliance with CEQA. Therefore, the Planning Commission finds that
the proposed project could not have a significant effect on the environment. Based upon
these findings, the Planning Commission hereby recommends that the City Council adopt
the Negative Declaration in accordance with the California Environmental Quality Act.
Section 10. On October 17, 1995, the Planning Commission adopted Resolution
No. 95-15 which recommended the adoption of an ordinance to authorize joint power
transit authority limited uses in the RA-S-2 Zone. The Conditional Use Permit requested
by the applicant is, therefore, dependent on the City Council's adoption of this ordinance.
Section 11. With respect to the request for a Conditional Use Permit for
administrative uses and the storage parking only of 10 vans by a joint powers transit
authority, the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and the
storage parking only of 10 vans by a joint powers transit authority would be consistent
RESOLUTION NO. 95-16
• •
A. The granting of a Conditional Use Permit for administrative uses and the
storage parking only of 10 vans by a joint powers transit authority would be consistent
with the purposes and objectives of the Zoning Ordinance and General Plan and will be
desirable for the public convenience and welfare because the use is consistent with similar
school district uses in the community and these uses will be located in an area of the
property where such use will be the least intrusive to surrounding properties. The transit
vans will not use Rolling Hills' roads, traffic will be decreased on the Palos Verdes
Peninsula, fuel consumption will be reduced on the Peninsula, and air quality of the
Peninsula will be preserved.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative uses and
the storage parking only of 10 vans will not adversely affect or be materially detrimental to
these adjacent uses, buildings, or structures because the existing structures are sufficiently
screened and will not impact the view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural terrain,
and surrounding residences because the public transit authority administrative uses and
the storage parking only of 10 vans will comply with the low profile residential
development pattern of the community and will be located on a ±31.14 acre parcel of
property that is adequate in size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative uses and
the storage parking only of 10 vans will not require any development at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting criteria
for hazardous waste facilities because the project, though listed on the current State of
California Hazardous Waste and Substances Sites List, will not require any development at
the site.
F. The proposed conditional use observes the spirit and intent of Title 17 of the
Zoning Code because the public transit authority administrative uses and the storage
parking only of 10 vans will not require any development at the site and access will be
outside the gates of the City.
Section 12. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 532 to allow joint
powers transit authority limited administrative uses and the storage parking only of 10
vans at the Palos Verdes Peninsula Unified School District site, as shown on the
Development Plan dated August 8, 1995 and marked Exhibit A, subject to the conditions
specified in Section 13. The Conditional Use Permit approval shall not take effect until the
effective date of an ordinance adopted by the City Council authorizing joint powers transit
authority limited uses in the RA-S-2 Zone.
Section 13. The Planning Commission's approval of a Conditional Use Permit in
Zoning Case No. 532 to allow joint powers transit authority limited administrative uses
RESOLUTION NO. 95-16
A. The Conditional Use Permit approval shall not take effect until the effective
date of an ordinance adopted by the City Council authorizing joint powers transit authority
limited uses in the RA-S-2 Zone.
B. The Conditional Use Permit shall expire on June 30, 1996 unless extended by
the Planning Commission prior to that date.
C. It is declared and made a condition of this Conditional Use Permit approval,
that if any conditions thereof are violated, this approval shall be suspended and the
privileges granted thereunder shall lapse; provided that the applicant has been given
written notice to cease such violation and has failed to do so for a period of thirty (30) days.
D. All requirements of the Buildings and Construction Ordinance, the Zoning
Ordinance, and of the zone in which the subject property is located must be complied with
unless otherwise set forth in the Permit, or shown otherwise on an approved plan.
E. The lot shall be maintained in substantial conformance with the site plan on
file dated August 8, 1995 and marked Exhibit A, except as otherwise provided in these
conditions.
F. Administrative office space shall be limited to 500 square feet of the 7,600
square foot warehouse building.
G. The 2,500 square foot storage parking only area at the western portion of the
property designated for 10 transit vans shall be striped and marked "For Van Storage
Parking Only."
H. The vehicles shall be parked in such a manner so as to prevent and prohibit
the backing up of vehicles.
I. Vehicular access to and from the school district property shall be from the
driveway at the northwest portion of the property outside the gates of the City of Rolling
Hills.
J.
of the site.
Speed limit signs shall be installed by the applicant on the internal driveway
K. Maintenance of the 10 transit vans shall not take place at the school district
property but, at an off -site repair facility.
L. Landscaping shall be maintained to obscure the buildings and vehicles on the
site so that the structures, vehicles, driveway, and slopes are screened and obscured from
view at the northern property line with native drought -resistant vegetation that is
compatible with the surrounding vegetation of the community.
M. The applicant and other affected agencies shall coordinate a meeting or
meetings with area residents regarding their concerns (i.e., noise abatement, car pooling,

starting times, housekeeping on the site, etc.) prior to the March, 1996 Planning
Commission meeting.
N. At the March, 1996 Planning Commission meeting, the applicant shall submit
a report on the actions taken to decrease noises on the site, which may include
measurements, tests or other acoustical evaluation.
O. The applicant and City staff shall schedule a public hearing before the
Planning Commission at the Commission's March, 1996 meeting to hear a status report on
the uses approved by this application.
P. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a new
application for approval by the Planning Commission.
Q. The applicant shall execute an Affidavit of Acceptance of all conditions of this
Conditional Use Permit approval, or the approval shall not be effective.

The public notice of the Planning Commission's intent to

recommend approval of the Negative Declaration was published on August 31, 1995.
Section 8. The Planning Commission conducted a duly noticed public hearing to
consider the applications on September 19, 1995. The applicants were notified of the public
hearing in writing by first class mail. Evidence was heard and presented from all persons
interested in affecting said proposal, from all persons protesting the same, and from
members of the City staff and the Planning Commission having reviewed, analyzed and
studied said proposal. Palos Verdes Peninsula Unified School District representatives were
in attendance at the hearing.
Section 10. On September 19, 1995, the Planning Commission adopted Resolution
No. 95-13 which recommended the adoption of an ordinance to authorize joint power
transit authority limited uses in the RA-S-2 Zone.
A. The granting of a Conditional Use Permit for administrative uses and the
storage parking only of 10 vans by a joint powers transit authority would be consistent

property where such use will be the least intrusive to surrounding properties. The transit
vans will not use Rolling Hills' roads, traffic will be decreased on the Palos Verdes

Peninsula will be preserved.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative uses and
the storage parking only of 10 vans will not adversely affect or be materially detrimental to
these adjacent uses, buildings, or structures because the existing structures are sufficiently
screened and will not impact the view or privacy of surrounding neighbors.

and surrounding residences because the public transit authority administrative uses and
the storage parking only of 10 vans will comply with the low profile residential
development pattern of the community and located on a ±31.14 acre parcel of property that
is adequate in size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative uses and
the storage parking only of 10 vans will not require any development at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting criteria
for hazardous waste facilities because the project, though listed on the current State of
California Hazardous Waste and Substances Sites List, will not require any development at
the site.
F. The proposed conditional use observes the spirit and intent of Title 17 of the
Zoning Code because the public transit authority administrative uses and the storage
parking only of 10 vans will not require any development at the site nor and access will be
outside the gates of the City.
Section 13. The Planning Commission hereby approves a Conditional Use Permit

Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the
Planning Commission to permit the construction of an (1) administration building,
(2) elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.

Section 4. Applications were made for the subject uses by the Palos Verdes
Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning
staff prepared an initial study for the project. The initial study found that the project
would not have a significant effect on the environment. A Negative Declaration
was prepared and was circulated to the applicant and other interested parties in
accordance with State of California CEQA Guidelines. The public notice of the
Planning Commission's intent to recommend approval of the Negative Declaration
was published on August 31, 1995. Copies of the Negative Declaration were sent to
adjacent cities and other government agencies. No comments on the Negative
Declaration were received.
Section 5. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of 10 vans at
the site. The site will continue to be used for the storage and maintenance of school
district vehicles and equipment. The school district proposes to permit a joint
powers transit authority to use 500 square feet of the northernmost portion of a 7,600
square foot warehouse for administrative uses and 2,500 square feet of an existing
asphalt paved area of school district property for the storage parking only of 10 vans.
Section 6. The Planning Commission conducted a duly noticed public
hearing to consider the applications on September 19, 1995. The applicants were
notified of the public hearing in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal, from all persons
protesting the same, and from members of the City staff and the Planning
Commission having reviewed, analyzed and studied said proposal. Palos Verdes
Peninsula Unified School District representatives were in attendance at the hearing.
Section 7. The Planning Commission has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the Planning
Commission finds that the proposed project could not have a significant effect on
the environment. Based upon these findings, the Planning Commission hereby
recommends that the City Council adopt the Negative Declaration in accordance
with the California Environmental Quality Act.
Section 8. With respect to the request to amend the Rolling Hills Zoning
Ordinance to include a joint powers transit authority under Section 17.16.040(B)
Conditional Use Permit as Primary Use, the Planning Commission finds:
A. The proposed project is consistent with the General Plan goals and
policies to maintain Rolling Hills' distinctive rural residential character (Land Use
Element, p. 15.), to maintain the rural character of Rolling Hills' road system
(Circulation Element, p. 13.) and to maintain the private status of the streets within
the City boundaries (Circulation Element, p. 13) because there will not be any
development on the site and access shall continue from outside the gates of the City.
RESOLUTION NO. 95-13
PAGE 2 OF4
• DRAFT
B. The proposed use will fulfill a public necessity in the use of portions of
school district property used as a maintenance and warehouse facility to be used by a
joint powers transit authority for administrative uses and the storage parking only
of 10 vans at the site for Peninsula students and residents. The proposed use will
conserve public costs related to van storage, van fuel, van use and driver
commuting distances.
C. The proposed use will be convenient in that portions of school district
property used by the joint powers transit authority for administrative uses and the
storage parking only of 10 vans at the site will be accessed from outside of the gates
of the City. The transit vans will be stored at the school district property during the
time they are not in use which will decrease road traffic on the Peninsula, reduce
fuel consumption and preserve air quality.
D. The proposed use will benefit the health, safety and general welfare of
the citizens of the City of Rolling Hills, as well as the citizens of the Palos Verdes
Peninsula, in that portions of school district property used by the joint powers
transit authority for administrative uses and the storage parking only of 10 vans at
the site will not use Rolling Hills' roads, traffic will be decreased on the Palos
Verdes Peninsula, fuel consumption will be reduced on the Peninsula, and the air
quality of the Peninsula will be preserved.
Section 9. Based upon the findings contained in Sections 7 and 8 of this
resolution, the Planning Commission recommends that the City Council adopt an
ordinance to amend Paragraph B of Section 17.16.040 of Chapter 16 of Title 17
(Zoning Ordinance) of the Rolling Hills Municipal Code to read:
"B. Conditional Use As Primary Use. The following conditional uses may
be permitted as a primary use on a lot:
1. Elementary school offering State -mandated curriculum;
2. Fire station;
3. Gate house;
4. Park and/or playground;
5. Public transportation limited uses by a joint powers transit
authority on school district property which is developed as a
school maintenance facility in the RA-S-2 Zone;
6. Public utility building or structure, including a reservoir or tank,
necessary for the provision of essential utility services to
permitted uses in the City, but excluding wires, pipelines or
poles;
7. Temporary manufactured home."

AN ORDINANCE OF THE CITY OF ROLLING HILLS AUTHORIZING
JOINT POWER TRANSIT AUTHORITY LIMITED USES AS A
CONDITIONALLY PERMITTED USE IN THE RA-S-2 ZONE, AND
AMENDING TITLE 17 OF THE ROLLING HILLS MUNICIPAL CODE.
Findings of Exemption (Attach Required Findings):
The City Council finds that there is no evidence that the ordinance of the City of Rolling Hills
authorizing joint power transit authority limited uses as a conditionally permitted use in the RA-
S-2 Zone, and amending Title 17 of the Rolling Hills Municipal Code will have an effect on
endangered or threatened species of plants and animals.
The City Council finds that the ordinance of the City of Rolling Hills authorizing joint power
transit authority limited uses as a conditionally permitted use in the RA-S-2 Zone, and amending
Title 17 of the Rolling Hills Municipal Code will not have an effect on wetlands and that water
courses will not be eliminated or converted.
The City Council has determined that the ordinance of the City of Rolling Hills authorizing joint
power transit authority limited uses as a conditionally permitted use in the RA-S-2 Zone, and
amending Title 17 of the Rolling Hills Municipal Code will not have a significant adverse impact
on the environment and has adopted a Negative Declaration consistent with the provisions of the
California Environmental Quality Act (CEQA).
Certification:
I hereby certify that the, lead agency has made the above findings of fact and that based
upon the initial study and hearing record the project will not individually or cumulatively have an
adverse effect on wildlife resources, as in Section 711.2 of the Fish and Game Code.

FINDINGS AND FORMAL REPORT
Zoning Case No. 43
The above entitled matter came on for hearing on the 28th day of
April, 1964, at the hour of 8 p.m. in the City Hall of the City of Rolling
Hills, California. Mr. Grover J. Moore appeared for and on behalf of the
Palos Verdes 'Peninsula Unified School District and submitted to the Commission
evidence, both oral and documentary; in support of the application; and Mr. &
Mrs. Felix H. McGinnis and Mr. & Mrs. Walter Ralphs submitted evidence in opposition
to the application; and thereafter the matter was continued by the Commission
until May 26, 1964, at the hour of 8 p.m. at which time Mr. Grover J. Moore
appeared, and the Planning Commission now being fully advised, makes its
findings and formal report as required by Ordinance No. 33 of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Palos Verdes Peninsula
Unified School District, is the owner of that certain real property located on
the south side of Crest Road West, adjoining the western boundary of the City,
consisting of approximately 32 acres, known by street and number as 38 Crest
Road West, Rolling Hills, California, and that no application or fee is required
by applicant as provided for in Section 6.13 of Ordinance No. 33. The Commission
further finds that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33,
of the City of Rolling Hills, California.
• •
II.
The Commission further finds that the plot plan submitted in evidence
by applicant as Exhibit A represents the existing and/or proposed location of
the proposed construction of an Administration Building, District Maintenance
Building and Elementary School Building for which applicant is requesting a
Conditional Use Permit.
III.
The Commission further finds that the construction and location of
the proposed administration building, maintenance building and garage, would
establish and permit a commercial use of said property which would consist of
a garage for the storage of approximately thirty-seven (37) diesel school
busses, a facility for repairing, maintaining and servicing said busses, a
warehouse for the storage of school supplies and a repair and work shop for
the repair and maintenance of school property, all of which uses will create
noise, dirt and confusion from six o'clock in the morning until approximately
five o'clock in the afternoon each day that said facilities are in operation,
and that said uses constitute a nuisance and depreciate the value of all
property adjoining said school property and interfere with the enjoyment of
the residential use of said property by the residents and owners thereof.
IV.
The Commission further finds that the foregoing proposed use is
undesirable for the public convenience and welfare of the residents of the
City of Rolling Hills and is inconsistent for the purposes and objectives of
Ordinance No. 33.
CONCLUSIONS AND REPORT
1. From the foregoing, it is concluded that a Conditional Use
Permit for the uses described in said application on the property owned by
the applicant, Palos Verdes Peninsula Unified School District, should be
denied, AND IT IS THEREFORE SO ORDERED.
Dated: This 5th day of June, 1964.
