The public hearing will be held at 7:30 PM in the Rolling Hills City Hall Council Chambers. Since the last meeting on March 19, 1996, we have not received any letters and verbal reports from nearby residents but, we did receive the attached note from Planning Commissioner Arvel Witte. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY RESOLVE AS FOLLOWS: Section 1. On August 7, 1995, applications were duly filed by the Palos Verdes Peninsula Unified School District with respect to real property at the ±31.14 acre western portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting (1) to amend the Rolling Hills Zoning Ordinance to allow joint powers transit authority uses as a conditionally permitted use in the RA-S-2 Zone; and (2) a Conditional Use Permit to allow portions of school district property used as a maintenance and warehouse facility at the Palos Verdes Peninsula Unified School District property to be used by a joint powers transit authority for administrative uses and the storage parking only of 10 vans at the Palos Verdes Peninsula Unified School District Crest Road property at 38 Crest Road West, Rolling Hills, CA (±31.14 acre western portion of Lot 74-MS). Section 2. On February 26, 1963, a Conditional Use Permit was approved by the Planning Commission for the following five structures to be constructed at the Palos Verdes Peninsula Unified School District site: (1) administration building, (2) education material and library facility building, (3) warehouse building, (4) district maintenance building, and (5) an elementary school building, The Conditional Use Permit expired on February 26, 1964 and no new buildings were constructed. Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the Planning Commission to permit the construction of an (1) administration building, (2) elementary school building, and (3) district maintenance building. The Planning Commission found that the construction and location of the proposed administration building, maintenance building and garage would establish and permit a commercial use of the property that would consist of a garage for the storage of approximately thirty-seven (37) diesel school buses, a facility for repairing, maintaining and servicing the buses, a warehouse for the storage of school supplies and a repair/workshop for the repair and maintenance of school property, all of which uses will create noise, dirt and confusion from 6 AM in the morning until approximately 5 PM in the afternoon each day the facilities are in operation, and these uses would constitute a nuisance and depreciate the value of all property adjoining the school property and interfere with the enjoyment of the residential use of the adjacent properties by the residents and owners. Section 4. Applications were made for the subject project by the Palos Verdes Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning staff prepared an initial study for the project. The initial study found that the project would not have a significant effect on the environment. A Negative Declaration was prepared and was circulated to the applicant and other interested parties in accordance with State of California CEQA Guidelines. The public notice of the Planning Commission's intent to RESOLUTION NO. 95-16 PAGE 1 OF 6 • • recommend approval of the Negative Declaration was published on August 31, 1995. Copies of the Negative Declaration were sent to adjacent cities and other government agencies. No comments on the Negative Declaration were received. Section 5. The application applies to the ±31.14 acre western portion of Lot 72-RH. The General Plan Land Use designation for this property is Very Low Density Residential 2+ Net Acres per Dwelling Unit. Section 6. The subject site is presently occupied by 7 school buildings, a maintenance building, a warehouse building, a computer/office equipment repair building, a vehicle repair shop, and an administration building. The zone designation for the subject site is RA-S-2 and the zone designation on adjacent properties is RA-S-2. Section 7. The project as proposed is to permit portions of school district property used as a maintenance and warehouse facility to be used by a joint powers transit authority for administrative uses and the storage parking only of 10 vans at the site. The site will continue to be used for the storage and maintenance of school district vehicles and equipment. The school district proposes to permit a joint powers transit authority to use 500 square feet of the northernmost portion of a 7,600 square foot warehouse for administrative uses and 2,500 square feet of an existing asphalt paved area of school district property for the storage parking only of 10 vans. Section 8. The Planning Commission conducted a duly noticed public hearing to consider the applications on September 19, 1995 and October 17, 1995. The applicants were notified of the public hearing in writing by first class mail. Evidence was heard and presented from all persons interested in affecting said proposal, from all persons protesting the same, and from members of the City staff and the Planning Commission having reviewed, analyzed and studied said proposal. Palos Verdes Peninsula Unified School District representatives were in attendance at the hearing. Section 9. The Planning Commission has reviewed the proposed Negative Declaration and finds that it represents the independent judgment of the City and that it was prepared in compliance with CEQA. Therefore, the Planning Commission finds that the proposed project could not have a significant effect on the environment. Based upon these findings, the Planning Commission hereby recommends that the City Council adopt the Negative Declaration in accordance with the California Environmental Quality Act. Section 10. On October 17, 1995, the Planning Commission adopted Resolution No. 95-15 which recommended the adoption of an ordinance to authorize joint power transit authority limited uses in the RA-S-2 Zone. The Conditional Use Permit requested by the applicant is, therefore, dependent on the City Council's adoption of this ordinance. Section 11. With respect to the request for a Conditional Use Permit for administrative uses and the storage parking only of 10 vans by a joint powers transit authority, the Planning Commission finds: A. The granting of a Conditional Use Permit for administrative uses and the storage parking only of 10 vans by a joint powers transit authority would be consistent RESOLUTION NO. 95-16 PAGE 2 OF 6 • • A. The granting of a Conditional Use Permit for administrative uses and the storage parking only of 10 vans by a joint powers transit authority would be consistent with the purposes and objectives of the Zoning Ordinance and General Plan and will be desirable for the public convenience and welfare because the use is consistent with similar school district uses in the community and these uses will be located in an area of the property where such use will be the least intrusive to surrounding properties. The transit vans will not use Rolling Hills' roads, traffic will be decreased on the Palos Verdes Peninsula, fuel consumption will be reduced on the Peninsula, and air quality of the Peninsula will be preserved. B. The nature, condition, and development of adjacent uses, buildings, and structures have been considered, and the public transit authority administrative uses and the storage parking only of 10 vans will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures because the existing structures are sufficiently screened and will not impact the view or privacy of surrounding neighbors. C. The project is harmonious in scale and mass with the site, the natural terrain, and surrounding residences because the public transit authority administrative uses and the storage parking only of 10 vans will comply with the low profile residential development pattern of the community and will be located on a ±31.14 acre parcel of property that is adequate in size, shape and topography to accommodate such use. D. The proposed conditional use complies with all applicable development standards of the zone district because the public transit authority administrative uses and the storage parking only of 10 vans will not require any development at the existing site. E. The proposed conditional use is consistent with the portions of the Los Angeles County Hazardous Waste Management Plan relating to siting and siting criteria for hazardous waste facilities because the project, though listed on the current State of California Hazardous Waste and Substances Sites List, will not require any development at the site. F. The proposed conditional use observes the spirit and intent of Title 17 of the Zoning Code because the public transit authority administrative uses and the storage parking only of 10 vans will not require any development at the site and access will be outside the gates of the City. Section 12. Based upon the foregoing findings, the Planning Commission approves the request for a Conditional Use Permit in Zoning Case No. 532 to allow joint powers transit authority limited administrative uses and the storage parking only of 10 vans at the Palos Verdes Peninsula Unified School District site, as shown on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the conditions specified in Section 13. The Conditional Use Permit approval shall not take effect until the effective date of an ordinance adopted by the City Council authorizing joint powers transit authority limited uses in the RA-S-2 Zone. Section 13. The Planning Commission's approval of a Conditional Use Permit in Zoning Case No. 532 to allow joint powers transit authority limited administrative uses RESOLUTION NO. 95-16 PAGE 3 OF 6 • • A. The Conditional Use Permit approval shall not take effect until the effective date of an ordinance adopted by the City Council authorizing joint powers transit authority limited uses in the RA-S-2 Zone. B. The Conditional Use Permit shall expire on June 30, 1996 unless extended by the Planning Commission prior to that date. C. It is declared and made a condition of this Conditional Use Permit approval, that if any conditions thereof are violated, this approval shall be suspended and the privileges granted thereunder shall lapse; provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days. D. All requirements of the Buildings and Construction Ordinance, the Zoning Ordinance, and of the zone in which the subject property is located must be complied with unless otherwise set forth in the Permit, or shown otherwise on an approved plan. E. The lot shall be maintained in substantial conformance with the site plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise provided in these conditions. F. Administrative office space shall be limited to 500 square feet of the 7,600 square foot warehouse building. G. The 2,500 square foot storage parking only area at the western portion of the property designated for 10 transit vans shall be striped and marked "For Van Storage Parking Only." H. The vehicles shall be parked in such a manner so as to prevent and prohibit the backing up of vehicles. I. Vehicular access to and from the school district property shall be from the driveway at the northwest portion of the property outside the gates of the City of Rolling Hills. J• of the site. Speed limit signs shall be installed by the applicant on the internal driveway K. Maintenance of the 10 transit vans shall not take place at the school district property but, at an off -site repair facility. L. Landscaping shall be maintained to obscure the buildings and vehicles on the site so that the structures, vehicles, driveway, and slopes are screened and obscured from view at the northern property line with native drought -resistant vegetation that is compatible with the surrounding vegetation of the community. M. The applicant and other affected agencies shall coordinate a meeting or meetings with area residents regarding their concerns (i.e., noise abatement, car pooling, RESOLUTION NO. 95-16 PAGE4OF6 • • starting times, housekeeping on the site, etc.) prior to the March, 1996 Planning Commission meeting. N. At the March, 1996 Planning Commission meeting, the applicant shall submit a report on the actions taken to decrease noises on the site, which may include measurements, tests or other acoustical evaluation. O. The applicant and City staff shall schedule a public hearing before the Planning Commission at the Commission's March, 1996 meeting to hear a status report on the uses approved by this application. P. Any substantial modifications to the project which would constitute additional development or significantly alter the use shall require the filing of a new application for approval by the Planning Commission. Q. The applicant shall execute an Affidavit of Acceptance of all conditions of this Conditional Use Permit approval, or the approval shall not be effective. Please note in their correspondence that when "PVUSD" is indicated, that this refers to the School District vehicles/activities which are separate from the Transit Authority. This correspondence, as well as all of your correspondence, will be forwarded to the Planning Commission for their interim hearing on this matter to be held on Tuesday, March 19, 1996. I hope that we are able to address and resolve all concerns. The cost savings that we are able to achieve by parking at the maintenance yard has already had an extremely positive impact on our budget. Additionally, as we apply to the MTA and county for continued local peninsula funding, we are able to show a balanced budget, strong ridership, and support by all four cities plus the school district. To monitor the implementation of the CUP. and to address Ms. Hawkins' concerns, during the past inonth+ Mike Escalante and I have visited the site numerous times. Also, John Meyer has spent considerable time at the site on a daily basis. We have met with the drivers, their supervisors, the PVPUSD staff at the yard and the PVPUSD administration. To address the questions you raised, I thought it best to use a format organized by subject. In operating our 94-95 combination demand/response-fixed route service PV Transit used 10 vehicles. For the new 95-96 all fixed route service, PV Transit operates 13 vehicles. With our rotating maintenance schedule, two vehicles (occasionally one) return to Wilmington every day, which most often leaves 11 vans at the yard. I apologize for this problem as, with the change from a demand -response service to a fixed route service, I should have requested that 11-13 vans be allowed to park on the site. However, to comply with our commitment we are making arrangements to ensure that only 10 of our PV Transit vans remain at the yard each night. Some of our vans are 16-20 passengers and others are 18-22 passengers. The vans were manufactured by different firms, but they are basically small transit vans. (I believe you are aware that the PVPUSD also owns several transit vehicles which have been parked on the site for several years. There may be some confusion that these PVPUSD vehicles are PV Transit vans. I believe that the district is in the process of declaring their vehicles surplus, for discard.)) Back-up Warning During additional meetings with the drivers and supervisors, they emphatically state that they do not back up in the morning, as the vehicle are parked in a special way the afternoon before. However, to ensure that all drivers are continually reminded of this policy we have implemented the following reminder. Each afternoon each driver turns his/her van keys into the PV transit office, and each driver in the morning picks up his/her van keys from the office. We have posted a notice with the key box to ensure that drivers are aware of the "no beeping" policy each time they return and each time they leave. Additionally, Mike Escalante, John Meyer and I have been monitoring the site and have heard no "beeping" from the PV Transit vans. However, vendors delivering supplies to the PVPUSD warehouse have to back up to the loading dock and, of course, their warning beep is automatically engaged when the truck is in reverse. Morning Run As you are aware, the vans are in place at their first stop at 6:30AM. We have asked the drivers to do their vehicle safety check as quickly and quietly as possible so that the amount of time the drivers are on the yard is kept to a minimum. The vans that do the "Miraleste/East " runs leave the yard at 6:15 and the vans doing the "Peninsula Center/West" runs leave at 6:20. . . Transit Authority has already breached its Lr:mises with respect to the parking lot use at the "school" l'w,�ated along Crest Road, more -or -less "inboard" from the Crenshaw .gate entry to the City. While you referenced my "concern" about these violations, simply wanted to clarify the purpose of my report. It was not my 'purpose to express a concern about these violations. As I T.redicted during the hearings on this subject, I expected the P.V. - ansit Authority to break its promises to the City. Therefore, it rame as no surprise to me when the prediction materialized. You also recall the assurances from the proponents of the plan that my concerns were misplaced and that there would be strict compliance with the plan. Why I wrote my letter was to let the City Council know that these "solemn" promises have already been broken. Your letter Tade no mention about the Council being concerned about the 58representations which were made. What I would appreciate is a letter from you telling me that some affirmative steps are being taken to enforce the agreement, not patronizing letters that to the J'fc:t that you (at City Hall) appreciate my concerns. Please free to dispense with wasting your time and postage with your "thank you for your concern letters." I have to think that, if a resident were to "stray from the paths of righteousness" in this regard, i.e., violating a =promise, the City (and the Association) would crack down on the ,eident without hesitation; however, in its dealing with "outsiders," exceptions to enforcement seem to be the rule, not the exception. .I think that is one of the great frustrations of 2ealing with "City Hall" in this community. One need look no further than the action being threatened by the City and/or C,Junity Association to remove the security signs that have proliferated throughout the City. There is a reason for the proliferation of these signs in this community. The reason is that Craig R. As a consequence, crime goes up. As a result, .security signs pop up like mushrooms and security gates become more common az residents, betrayed by their own community government, resort to self help. In reaction, city government refuses to deal with these security issues (as it quite apparently will refuse to deal with the infractions by the P.V. Transit Authority) but, instead, threatens its own constituents with the forcible removal of their security signs because, I gather, the signs somehow compromise the rural atmosphere of this community. THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY RESOLVE AS FOLLOWS: Section 1, On August 7, 1995, applications were duly filed by the Palos Verdes Peninsula Unified School District with respect to real property at the ±31.14 acre western portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting (1) to amend the Rolling Hills Zoning Ordinance to allow joint powers transit authority uses as a conditionally permitted use in the RA-S-2 Zone; and (2) a Conditional Use Permit to allow portions of school district property used as a maintenance and warehouse facility at the Palos Verdes Peninsula Unified School District property to be used by a joint powers transit authority for administrative uses and the storage parking only of 10 vans at the Palos Verdes Peninsula Unified School District Crest Road property at 38 Crest Road West, Rolling Hills, CA (±31.14 acre western portion of Lot 74-MS). Section 2. On February 26, 1963, a Conditional Use Permit was approved by the Planning Commission for the following five structures to be constructed at the Palos Verdes Peninsula Unified School District site: (1) administration building, (2) education material and library facility building, (3) warehouse building, (4) district maintenance building, and (5) an elementary school building, The Conditional Use Permit expired on February 26, 1964 and no new buildings were constructed. Section 3. On, June 5, 1964 a Conditional Use Permit was denied by the Planning Commission to permit the, construction of an (1) administration building, (2) elementary school building, and (3) district maintenance building. The Planning Commission found that the construction and location of the proposed administration building, maintenance building and garage would establish and permit a commercial use of the property that would consist of a garage for the storage of approximately thirty-seven (37) diesel school buses, a facility for repairing, maintaining and servicing the buses, a warehouse for the storage of school supplies and a repair/workshop for the repair and maintenance of school property, all of which uses will create noise, dirt and confusion from 6 AM in the morning until approximately 5 PM in the afternoon each day the facilities are in operation, and these uses would constitute a nuisance and depreciate the value of all property adjoining the school property and interfere with the enjoyment of the residential use of the adjacent properties by the residents and owners. Section 4. Applications were made for the subject project by the Palos Verdes Peninsula Unified School District on August 7, 1995. On August 17, 1995, Planning staff prepared an initial study for the project. The initial study found that the project would not have a significant effect on the environment. A Negative Declaration was prepared and was circulated to the applicant and other interested parties in accordance with State of California CEQA Guidelines. The public notice of the Planning Commission's intent to RESOLUTION NO. 95-16 PAGE 1 OF 6 r• recommend approval of the Negative Declaration was published on August 31, 1995; • Copies of the Negative Declaration were sent to adjacent cities and other government agencies. No comments on the Negative Declaration were received. Section 5. The application applies to the ±31.14 acre western portion of Lot 72-RH. The General Plan Land Use designation for this property is Very Low Density Residential 2+ Net Acres per Dwelling Unit. Section 6. The subject site is presently occupied by 7 school buildings, a maintenance building, a warehouse building, a computer/office equipment repair building, a vehicle repair shop, and an administration building. The zone designation for the subject site is RA-S-2 and the zone designation on adjacent properties is RA-S-2. Section 7. The project as proposed is to permit portions of school district property used as a maintenance and warehouse facility to be used by a joint powers transit authority for administrative uses and the storage parking only of 10 vans at the site. The site will continue to be used for the storage and maintenance of school district vehicles and equipment. The school district proposes to permit a joint powers transit authority to use 500 square feet of the northernmost portion of a 7,600 square foot warehouse for administrative uses and 2,500 square feet of an existing asphalt paved area of school district property for the storage parking only of 10 vans. Section 8. The Planning Commission conducted a duly noticed public hearing to consider the applications on September 19, 1995 and October 17, 1995. The applicants were notified of the public hearing in writing by first class mail. Evidence was heard and presented from all persons interested in affecting said proposal, from all persons protesting the same, and from members of the City staff and the Planning Commission having reviewed, analyzed and studied said proposal. Palos Verdes Peninsula Unified School District representatives were in attendance at the hearing. Section 9. The Planning Commission has reviewed the proposed Negative Declaration and finds that it represents the independent judgment of the City and that it was prepared in compliance with CEQA. Therefore, the Planning Commission finds that the proposed project could not have a significant effect on the environment. Based upon these findings, the Planning Commission hereby recommends that the City Council adopt the Negative Declaration in accordance with the California Environmental Quality Act. Section 10. On October 17, 1995, the Planning Commission adopted Resolution No. 95-15 which recommended the adoption of an ordinance to authorize joint power transit authority limited uses in the RA-S-2 Zone. The Conditional Use Permit requested by the applicant is, therefore, dependent on the City Council's adoption of this ordinance. Section 11. With respect to the request for a Conditional Use Permit for administrative uses and the storage parking only of 10 vans by a joint powers transit authority, the Planning Commission finds: A. The granting of a Conditional Use Permit for administrative uses and the storage parking only of 10 vans by a joint powers transit authority would be consistent RESOLUTION NO. 95-16 PAGE 2 OF 6 A. The granting of a Conditional Use Permit for administrative uses and the' storage parking only of 10 vans by a joint powers transit authority would be consistent with the purposes and objectives of the Zoning Ordinance and General Plan and will be desirable for the public convenience and welfare because the use is consistent with similar school district uses in the community and these uses will be located in an area of the property where such use will be the least intrusive to surrounding properties. The transit vans will not use Rolling Hills' roads, traffic will be decreased on the Palos Verdes Peninsula, fuel consumption will be reduced on the Peninsula, and air quality of the Peninsula will be preserved. B. The nature, condition, and development of adjacent uses, buildings, and structures have been considered, and the public transit authority administrative uses and the storage parking only of 10 vans will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures because the existing structures are sufficiently screened and will not impact the view or privacy of surrounding neighbors. C. The project is harmonious in scale and mass with the site, the natural terrain, and surrounding residences because the public transit authority administrative uses and the storage parking only of 10 vans will comply with the low profile residential development pattern of the community and will be located on a ±31.14 acre parcel of property that is adequate in size, shape and topography to accommodate such use. D. The proposed conditional use complies with all applicable development standards of the zone district because the public transit authority administrative uses and the storage parking only of 10 vans will not require any development at the existing site. E. The proposed conditional use is consistent with the portions of the Los Angeles County Hazardous Waste Management Plan relating to siting and siting criteria for hazardous waste facilities because the project, though listed on the current State of California Hazardous Waste and Substances Sites List, will not require any development at the site. F. The proposed conditional use observes the spirit and intent of Title 17 of the Zoning Code because the public transit authority administrative uses and the storage parking only of 10 vans will not require any development at the site and access will be outside the gates of the City. Section 12. Based upon the foregoing findings, the Planning Commission approves the request for a Conditional Use Permit in Zoning Case No. 532 to allow joint powers transit authority limited administrative uses and the storage parking only of 10 vans at the Palos Verdes Peninsula Unified School District site, as shown on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the conditions specified in Section 13. The Conditional Use Permit approval shall not take effect until the effective date of an ordinance adopted by the City Council authorizing joint powers transit authority limited uses in the RA-S-2 Zone. Section 13. The Planning Commission's approval of a Conditional Use Permit in Zoning Case No. 532 to allow joint powers transit authority limited administrative uses RESOLUTION NO. 95-16 PAGE 3 OF 6 • • A. The Conditional Use Permit approval shall not take effect until the effective date of an ordinance adopted by the City Council authorizing joint powers transit authority limited uses in the RA-S-2 Zone. B. The Conditional Use Permit shall expire on June 30, 1996 unless extended by the Planning Commission prior to that date. C. It is declared and made a condition of this Conditional Use Permit approval, that if any conditions thereof are violated, this approval shall be suspended and the privileges granted thereunder shall lapse; provided that the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days. D. All requirements of the Buildings and Construction Ordinance, the Zoning Ordinance, and of the zone in which the subject property is located must be complied with unless otherwise set forth in the Permit, or shown otherwise on an approved plan. E. The lot shall be maintained in substantial conformance with the site plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise provided in these conditions. F. Administrative office space shall be limited to 500 square feet of the 7,600 square foot warehouse building. G. Notwithstanding my tenure as a Peninsula resident, were my family to propose constructing an industrial site anywhere within the boundaries of this City, complete with war surplus quonset hut buildings, quartz halogen lamps which, when lit, illuminate a half -mile in all directions like some beacon to the repair yard, commercial and private vehicle parking lot, and general dump site situated below, the Planning Commission and the City Counsel would think the idea too preposterous for consideration. The City Counsel, in denying such a hypothetical request, would be correct. While the school board's public relation team advocates the expansion of this site with a slick poster presentation, replete with photographs of attractive trees and lawns, it is not posters which will be situated at the site. If the school board's proposal is granted, what will be found at the site will be not only the ten (10) vans that the board is focusing on, but additional administrative vehicles and the personal cars of the drivers and maintenance personnel and administrative personnel that will service this additional usage of the site, all of which are contrary to the ambiance of this geographically small, rural community. If this proposal is sanctioned by the Council, I wager that the vehicle count will be nearer 30 vans and passenger cars than the ten (10) vans that are being proposed. Advocating that the school board's request be denied is not "anti children," school age or otherwise. Whether or not this City becomes the "command post" for these additional buses/vans as well as the additional vehicular traffic of those persons getting to and from the school business to drive and repair them and to dispose of the toxic waste which those school buses "create" -- the school children of the Palos Verdes Peninsula will continue to attend school and the board will find another location to utilize for the requested purpose. The concession of the school board representative that (1) it lacks the financial wherewithal to • • City of Rolling Hills October 23, 1995 Page 2 continue utilizing the existing storage site in an industrial section of Wilmington and (2) despite years of trash dumping and trash storage at the site, the board cannot instruct its own employees not to use the site as a dumping ground for trash which littered the facility for the past (10) ten years, the representative successfully cuckolded the Planning Commission into agreeing to expanding the use of the present, already disgraceful site. Most respectfully, the school board needs to spend less time with its poster boards and more time at the• planning board for the purpose of figuring out a way it can better manage its funds and/or a more suitable location for its busses. Should the City lack the foresight to deny the board's request, it should minimally impose a fee on the board for the purpose of maintaining the facility and for providing site security to keep the quartz halogen lights off at night and for traffic control to keep the busses and the other motor vehicle traffic operating at posted limits. In various respects, the board has neglected to adequately maintain the premises for as long as I can remember passing the facility (about ten years) and unashamedly makes no promises about even doing a "better job" if the conditional use permit is granted. In fact, when the maintenance issue was raised at the Planning Commission, the school board representative protested that she could not tell what is tantamount to her own employee how to do his job. With that sort of mentality, it is hardly any wonder that the school board and/or Palos Verdes Transit are in financial extremis. This is not an "insider" or an "outsider" issue. This is an issue of what sort of facility -- if any -- is appropriate for our small city. Viewed objectively, the answer to that question is clear. No resident of this City would ever be allowed to operate a site of this type within City limits because such a site is inappropriate for this community. The non tax paying school board should not be given more favorable treatment than any tax paying resident by the proposed expansion of its existing eyesore and "sound sore." Moreover, the "good neighbor" argument is flawed. If the school board was a "good neighbor" and had any interest in this matter, the board would share the concern of even having an industrial complex (let alone expanding the complex) within a pastoral community such as Rolling Hills. And once the school board's "foot is further in the door," count on it to return to the City, hat in hand, explaining how -- for the kids and in the interests of being a good neighbor -- they should be allowed to bring their vehicles through the City as a short cut to the site. • City of Rolling Hills October 23, 1995 Page 3 My family would certainly like to see those at City Hall take a stronger interest in doing everything within their power to maintain the rural atmosphere of this City. What the school board proposes is contrary to at least my view of this City. If, nonetheless, the Council agrees to allow an expansion of the site, some recommendations are made. Tax the school board for such use. Require the presence of a watchman during evening hours so that proper security is maintained and so that the quartz halogen lights do not have to be illuminated all night. Make absolutely certain that site conditions are properly maintained, i.e., no dumping, and that the use of City streets as a shortcut for anv vehicular traffic (personnel and/or school busses/vans) to or from the site is prohibited. Parenthetically, since this "problem" seems to be legitimately characterized as a "Peninsula problem," and since the school board claims that what is needed is a temporary parking spot for just ten (10) vans a couple of times during the day, one solution might be to have a discrete number of these vans parked at each City Hall, i.e., in Rolling Hills Estates, Rancho Palos Verdes, Palos Verdes Estates and/or Rolling Hills. Each van could be strategically deployed so that the drivers could complete their respective pickup and delivery routes in as efficient and economic fashion as possible. Depending upon the number of City Halls utilized, up to two (2) to five (5) vehicles would "burden" each location on a temporary basis each day, thus barely denting the parking lot capacity of, at least, Rolling Hills Estates, Rancho Palos Verdes and Rolling Hills. When drivers arrive to carry out their appointed rounds, they could leave their commute cars at the designated City Hall until their route was completed. Thereafter, these drivers would return their vans to the designated City Hall and, presumably, go home or to their next work assignment. Routine service and maintenance of these vans could be conducted off -site, e.g., wherever the other transit vehicles go for service. Routing of the vans would be improved with resultant cost savings. Because of the increased efficiency in routing, traffic congestion on the Peninsula would be minimized. Moreover, such a solution represents a truly cooperative, Peninsula solution to a Peninsula problem. Christa M. I have done considerable research and analysis regarding this matter, listened carefully to the tape of your September 19th Commission meeting, and have reviewed a multitude of documents and correspondence. )CI ' T liniT AUTHO1R11TY The Authority is a local peninsula John powers arras ement between the cities of Rolling Hills Estates, Palos Verdes Estates and Rancho Palos Verdes. Membership is comprised of two councilmembers each from these three cities. Even though the city of Rolling Hills is not a contributing member, we do transport several of your resident children to/ from school and other activities, as they "catch" the van in locations outside your city boundary. The vans are the property of the Authority's member cities. ( OA1. "*. The Authority's primary goal is to provide transit service in all areas on the peninsula, with the exception of your gated community, in an efficient and fiscally sound manner. An additional goal is to reduce congestion, particularly along Palos Verdes Drive North. And, we are now faced with the goal of achieving a cost savings to our three member cities of nearly $100,000 in order to continue current transit service to peninsula residents. By parking our vans in the maintenance yard this goal becomes reality through free rent, reproduction and office services, "deadhead" (empty van travel time), and greatly reduced fuel costs. S1T& J) CISIQN _MAKING Beginning in May, Authority members reviewed a considerable number of "brainstormed" parking sites on the peninsula. The sites mentioned at your Commission meeting were included, as were others. We approached the PVPUSD to review school district properties. After a considerable amount of discussion «nu review, we came to the conclusion that the PVPtJSD maintenance yard was the best site in meeting our needs and, in guaranteeing die Authority the full cost savings of $100,000. Since the maintenance yard is a 35 acre paved lot, which has been in its present location for over 30 years, with the express purpose of parking, storing and maintaining vehicles, as well as housing maintenance employees, we feel our request is consistent with the site's past, present and future usage. Our needs required a location on the peninsula that would provide an administrative office to allow for on -site supervision and communication to drivers, a fenced and secure area, existing personnel which could handle an emergency situation in the absence of the administrative staff ( e.g. maintenance foreman), a fairly central location and, very importantly, the ability to fuel our vans on a daily basis at a greatly reduced cost. At the commission meeting, several sites were mentioned. Although I had previously discussed some of these with couneilmembers from your city, I unfortunately was not present to make you aware that those sites ( among others) had already been thought of and analyzed. Without going into a lengthy debate about •ru,. • • each site, suffice it to say that potential other sites did not meet our above detailed needs to provide the cost savings so desperately needed. As a specific example, Northrop is being developed into single family dwellings, and the library is ok)en and utilizes its parking area during times we would need to store vans. Additionally, the office space is fully utilized by library employees and patrons. CW CERNS I be) ieve there is general agreement that the screening is such that. there would be no view impact to residents. but a concern, which was voiced at your meeting, is potential noise from the vans. We have spent quite some time on this issue. The vehicles are small vans, not busses, and they use gasoline rather than diesel. This allows for a much quieter operation. No maintenance will be done at the site. Instead, the vans will return to the ATE site in North Long Beach on a rotational basis. In addition, we have determined that we are able to park the vans in such a way that they will not need to back up. This will eliminate any "beeping" sound. Finally, let me address operational noise. On October 10, Mike Escalante, PVPUSD Director of Business Services, spent several hours at the site with a police and code enforcement officer taking several decibel readings. The decibel measurements were taken during engine start-up as •,yell as driving up and down the road. The measurement device was that used by the City of PVE in edo,cing its noise ordinance. Ke,ping in mind that. RPV staff states that the closest property line in their city is 400' from the proposed purling site, the start up noise level was less than 50 DB at 200' and wouldn't even register at 300'. the van on the access road, the downhill range was 53 DB at 60' and 35 DB at 100'. The uphill :ange was 591)B at 60' and 57 DB at 100'. I am confident that there will he no noise impact to residents. t;MMVIAtRY At the request of your Mayor and city council members, I have worked diligently to keep the maintenance lard topic the low key matter I believe it. truly is. I have not made it an issue for the press, nor have I ,_ rcrrted anxiety and excitement. among the peninsula residents who are transit users. However, if the Authority is not able to implement. the planned cost savings we will be forced to reduce service to peninsula residents. I believe that we have diligently explored all options, and have worked to ensure that our use of the maintenance yard would put no additional burden on any resident. The cities on our peninsula depend upon each other. At forums, we often hear the mayors speak of cooperation and support of each other's cities. A recent example that comes to mind was the request by the usty of Rolling Hills to the other three cities to exert pressure to keep the Crest Road fire statio» open. We all responded with support. Row, we need your support. Public transportation on the Peninsula is difficult under all circumstances because of limited arterial roads. The Transit Authority will require Peninsula wide cooperation to provide the service that is needed. The offer of the school district to store the vans is a fine example of the response that is necessary. To enable this to occur your Planning Commission must grant a conditional use permit for the transit authority to store the vans at the maintenance yard. This iS a site that already stores heavy equipment so it doesn't make a significant change. The League of Women Voters supports cooperation of all local jurisdictional bodies serving the peninsula. We also support a transportation system that can meet the special needs of the youth. Such a system not only benefits the youth but their parents, and the traffic flow on the entire Peninsula. Removing hundreds of cars from early morning traffic is a benefit to the entire Peninsula as x'vell as an environmental improvement. We encourage you to grant the conditional use permit. It will be far beneficial for the transit authority to incur the $100,000 cost savings which can be reinvested in improving and guaranteeing the type of transportation system that is needed for the residents of the Peninsula. This 1995-96 fiscal year the Palos Verdes Peninsula Transit Authority has been provided,a one-year grant from the Los Angeles County Supervisors Office to continue service. It is the desire of the PVPTA to create a fixed route service throughout the peninsula. In an attempt to save taxpayer funds and provide expanded services, the PVPTA has requested support from the Palos Verdes Peninsula Unified School District. At the June 19, 1995, Palos Verdes Peninsula Unified School District's Board meeting, the District offered to provide the PVPTA with several in -kind services. The District offered to provide office space and overnight van parking at the Crest Road Maintenance Site, printing, and gasoline at the reduced District rate. The PVPTA vans will not be serviced at the Crest Road Maintenance Site. It has been estimated by PVPTA staff that these services would generate approximately $50,000 to $60,000 of savings for the PVPTA. • Over the past several weeks the Palos Verdes Peninsula Unified School District staff, has been working with the Rolling Hills City staff to determine the Conditional Use implications regarding the move of the PVPTA to the Crest Road Maintenance Site. The District has completed the necessary paperwork to initiate a hearing for this Conditional Use Permit change. A hearing date of September 19, 1995, has has. been established regarding this issue. ADMINISTRATIVE ANALYST RECOMMENDATION Adopt Resolution No. 95- authorizing an $86,400 budget increase in the.AB 2766 Air Quality rund for the City's contribution to the Palos Verdes Peninsula Transit Authority for its estimated share of the transit service costs. OACKOROUND The FY 95-96 City budget includes $297,900 in Proposition A funds for the City's share for Palos Verdes Peninsula Transit Authority services. Up to now, Peninsula Transit Authority service included PV Transit, Dial -a -Ride and PVE Shuttle service. Since adoption of the budget the Peninsula Transit Authority Board has taken action to change the transit service it provides, requiring an additional contribution from the City. DYSCUESTON Service provided by the Transit Authority will change effective September 7, 1995. The current PV Transit (taxi -like) demand service will stop September 6, 1995 and the PVE Shuttle service stopped in mid -June. These will be replaced by a new fixed route service that will run through the Cities of Rancho Palos Verdes, Palos Verdes Estates and Rolling Hills Estates. The Dial -a -Ride service will continue unchanged. This new fixed route service will operate similar to traditional bus service with established routes and bus stops, as shown on the attached map. The existing PV Transit vans will be used for this service. The service will be available weekdays from 6:30 a.m. to 6:30 p.m. and a van will be available at each bus stop avert 30 minutes. The bus fare will be $2.00 for a single fare, $50 for a monthly pass and $180 for a semester pass, the same fares that were charged for PVE Shuttle service and lower than was charged for PV Transit service. Department of Transportation Commuter Express services. The total cost for this new service is nearly the same as for the old services. Under the old system, Palos Verdes Estates paid for the total cost of the PVE Shuttle fixed route service, and all three cities contributed on a per capita basis for the remaining Dial -a -Ride and demand services. The City of Palos Verdes Estates has proposed that each city's contribution rate be charged so that the total costs be based on a per capita basis. The new system of fixed routes benefits the three cities on a more equal basis, therefore, it made sense for all three cities to fund the system on a per capita basis. This change of funding will increase Rancho Palos Verdes' obligation by 585,400. Rolling Hills Estates proposed contribution would increase by $16,700, however, it is unknown whether they will approve the request. Palos Verdes Estates obligation would be reduced by $sb,400 to $1020100. This recommendation is made based on the assumption that the benefits derived from the new system approximate the per capita formula. There ;s no easy way of determining the allocation of benefits in advance. The Transit Authority Board will be asked to direct the Transit Authority General Manager to evaluate the system during the coming year and to report to the Board whether the per capita formula has a reasonable relationship to the benefits received by each city. Staff recommends that the additional $85,400 needed from Rancho Palos Verdes be funded with AB 2766 Air Quality funds. This fund has a $228,000 balance and the City has not identified any other eligible projects. There are several caveats to staff's recommendation. The first is that the FY 95-96 budget includes a one year contribution of $375,000 from Supervisor Dana's office, It is hoped that this can be replaced next year with additional funding from the MTA. If replacement funds do not materialize, the Peninsula Transit Authority member cities will be faced with increasing their contributions and/or modifying the service provided. The second caveat is that certain assumptions made when the FY 9;-95 budget was adopted have not materialized, leading to higher cysts. The Transit Authority administrative office was scheduled to move into School District offices located in the City of • Rolling Hills on Crest Road near Crenshaw Boulevard as of July 1, 1995. fIsues_ raised by the ..City.'of...Rolling •Hills have delayed this move, therefore increasing the FY 95-96 costs to the Authority because they must continue paying rent for the current office space. Since talking to Mayor Lee Byrd at this week's Mayors Luncheon, I have learned that the request by the School District requires a Zoning Code Text Amendment and ultimately a Conditional Use Permit application. As you are no doubt aware, this type of review is subject to Public Hearing requirements in order to fully allow all interested parties to have input on this proposal. We, as a City Council, are sympathetic to the transportation needs of the Palos Verdes Peninsula. The Dial -a -Ride service offered by PV Transit to students as well as the general public represents an outstanding use of local Proposition A transportation dollars. We applaud that use. However, we must operate within the scope of our Municipal Code as any other municipality. It is my understanding that our City staff worked very closely with our City Attorney's office to determine a way for this proposal to be approved within the confines of the existing Municipal Code language. They were unsuccessful in this endeavor and have provided the School District with application forms and applicable Municipal Code sections for the District to initiate the Zoning Code Text Amendment process. I understand that you have received a copy of that letter. Printed on Recycled Paper. Page 2 As you know, the City of Rolling Hills is entirely a residential community. The School District property is located in the Residential -Agricultural -Suburban Zone. Previously, the School District requested to store School District transportation vehicles at that location. Our records indicate that this request was met with opposition from our local residents during the Public Hearing process. In our efforts to dissuade a negative local reaction, we need to keep in mind the importance of avoiding any misinformation relative to this request. It is my estimation that Rolling Hills residents, reading about this matter in the press, might apply pressure to oppose this type of use without having all of the facts in front of them. It is our contention that our local Public Hearing process will serve to educate our residents on this matter and may generate support for this proposal rather than opposition. I discussed this matter in great detail with my City Manager. He has indicated to me that he will be meeting with administrative representatives of the School District, the Transit Authority and our City Attorney's office to further discuss this matter. It is hoped that the results of this meeting will be to encourage the School District to apply for the required Zoning Code Text Amendment and Conditional Use Permit. The PVPUSD school board unanimously approved a formal isgi Bement at their July 17 meeting, and a copy of this agreement was faxed to Mr. Nealis the afternoon of Tuesday, July 18. I am in receipt of a letter sent the morning of July 18 to Mr. Escalante from Lola Ungar, Principal Planner for the City of Rolling Hills, After reviewing said letter, l feel that it is based on some erroneous information or mis-communication, and I :wish to clarify a few issues. The Palos Verdes Peninsula Transit Authority is not a commercial entity. We arc oIely a local Joint powers agency comprised of 2 council members each from the ,.stis of Rancho Palos Verdes, Rolling Hills Estates and Palos Verdes Estates. 1 currently serve as chairman. Each city contributes a proportionate share of funding. All of our PV Transit vans are owned or leased by the Transit Authority. \Ve contract with ATE Ryder to drive our vans. ATE currently operates from `t'+'lmington, but is relocating to north Long Beach within the month. Currently, the Transit Authority must pay "deadhead time" (no passengers on board) for ::s l ers to drive each van from Wilmington to the Peninsula at the beginning of :.�.. h day, back to Wilmington during non -peak time in the middle of the day, aci: to the Peninsula for late afternoon peak time, and back again to Wilmington at :he end of the day. In order to better servc the entire peninsula and to have a balanced budget, the Transit Authority has asked the PVPUSD to allow us to park our small vans during "deadhead time" in a heavily screened area of their fenced maintenance yard. Understanding potential concerns of neighboring properties, I have personally reviewed the site and see no impact, No van maintenance would be done at this location. When necessary, would pay a driver to take a van to the ATE Long Beach yard. All operations for PV Transit would be done by our operator, ATE, at their Long Beach location. The Transit Authority employs only a part-time administrator and secretary are on site approximately two days a week. The administrator's primary .;,,; rnsibility is to respond to resident phone calls and letters regarding peninsula transit service, and to work with the officials and staff of the three peninsula cities which make up the Transit Authority. Sales of semester passes are done at the PVE police station. !n summary, the Palos Verdes Peninsula Transit Authority's member cities of Rancho Palos Verdes, Rolling Hills Estates and Palos Verdes Estates are questing that this local agency be allowed to park its 10 to 12 small vans in a a.avily screened location at the PVPUSD maintenance yard and to allow our staff person to be housed in a small office at this site. We are a local ''. n it+istrative agency, not a commercial use operation, and, as such should not he it violation of your city regulations. I believe Mayor Byrd told you chat the cost savings to our Authority would be in the neighborhood of $50,000. After further analysis, with ATE's move to Long Beach, the cost savings are closer to $80,000. We understand that you would like to assist the Palos Verdes Peninsula Transit Authority (PVPTA) in the reduction of expenses by providing parking spaces for its transit vans and related office space at the Palos Verdes Unified School District (PVUSD) Crest Road property in the City of Rolling Hills. You would like City approval of this use prior to the 1995-96 school year. The PVUSD Crest Road property is presently located in the City's Residential - Agricultural -Suburban Zone (RA-S-2 Zone) and the site was originally authorized by an existing Conditional Use Permit dated February 26, 1963, for use as an elementary school use, along with an administrative office building use, an education and library facility storage building use, a warehouse building use, and a district utility maintenance building use. In addition, there is an agreement between the City and the Palos Verdes Unified School District dated May 8, 1990, which authorized the change of use of the school from an elementary school to a continuation high school. The City's staff has reviewed your request, consulted the City's Zoning Ordinance and discussed this matter with the City Attorney's office. We find that to approve your request, we must amend the text of the City's Zoning Ordinance. This is because Section 17.16.040(B) of the Zoning Code lists the types of uses allowed in the RA-S-2 Zone with a Conditional Use Permit. The uses that you are inquiring about PAGE 1 OF 3 n :d Printed on Recycled Paper. ■ S are not included in that list. Therefore, in order to allow the maintenance and warehouse facility area to be used for the parking of transit vans and for commercial related administrative uses, we would have to amend Section 17.16.040(B) to make that proposed use one of the types permitted with a Conditional Use Permit. This type of use is not one for which the school district may choose to commence without compliance with the City's Zoning Ordinance (See Government Code 53094). In addition, the proposed use would require a modification to the existing Conditional Use Permit for the district property. The applicable Zoning Code chapters and sections are attached for your reference. To accomplish these changes, the process would begin with the submittal of an application for a Zoning Ordinance Text Amendment and a Conditional Use Permit Modification application. Those applications would have to include a current survey plot plan stamped by a licensed surveyor or civil engineer showing the existing structures, parking spaces, where the vans will be parked, and where the office space will be sited. Once submitted, the City staff would prepare the required environmental documents for the project pursuant to the California Environmental Quality Act (CEQA) Guidelines. That document is most likely to be a Negative Declaration. The applications would then be set for public hearing by the Planning Commission. Planning Commission meetings are held at 7:30 PM on the third Tuesday of every month. Following the Planning Commission's recommendations on the applications, the applications would be set for hearing before the City Council. The City Council meetings are held at 7:30 PM on the 2nd and 4th Mondays of every month. You should note that in 1964, a Conditional Use Permit application by the school district to include a garage to store and maintain school buses along with the previously approved uses was opposed by City residents and denied by the Planning Commission. Findings at that time included: the creation of noise, dirt and confusion from 6 AM to 5 PM constituting a nuisance, causing depreciation of value of all property adjoining the school property and interfering with the enjoyment of the residential use of those properties. Enclosed are application forms for the Conditional Use Permit Modification and an Environmental Information Form. Application for the Zoning Text Amendment must be filed as required by Chapter 17.30. The application should explain the reason of public necessity, convenience, health, safety or general welfare requiring such amendment. In addition, we are including a fee schedule and a Planning Commission Deadline Schedule. Given the time necessary to prepare and complete the requirements for these applications, it is apparent that it may not be possible to complete the City's approval process prior to the 1995-96 school year. For example, we would need plans and applications completed by you and submitted for City review prior to July 24, 1995 in PAGE 2 OF 3 di • order to advertise for the August 15, 1995 meeting of the Planning Commission. Also, the Planning Commission usually takes field trips of projects and such a separate field trip meeting may add a few additional weeks to the process. When we receive your completed applications we will process them as quickly as possible. But, be advised that the most common Planning Commission minimum hearing time period is 3 months. The Palos Verdes Peninsula Transit Authority (PVPTA) has been evaluating opportunities to reduce expenses. The PVPTA has contacted the Palos Verdes Peninsula Unified School District about the use of office space and overnight van storage at the District's Crest Road Maintenance Site. Because the primary users of the PVPTA are school age children, the Board of Education has conceptually agreed to assist the PVPTA by providing the following at no charge: e 550 square feet of office space at the west end of the District's warehouse building. The space will be used for administration of the PVPTA consisting of no more than two part-time employees, two to three days per week, who answer phones, schedule routes, and manage fiscal responsibilities. On occasion PVPTA board members visit the office and an occasional customer may come in for vouchers or refunds. o Ten (10) parking spaces are needed for the ten eighteen passenger vans that provide service. The vans would need to leave the yard at approximately 6:30 a.m. and return by 7:00 p.m. The vans are not used weekends or holidays and only limited service is provided during the summer. The vans would be stored in an area that is heavily screened with minimal view impact to surrounding properties. The greatest cost savings benefit to the PVPTA would not be the rental space savings, but rather the ability to park the ten vans at a location central to the peninsula. Vans would not have to travel long distance for • July 10, 1995 Page 2 overnight storage which would save gas, maintenance, and driver time. The vehicles would not be serviced or maintained at the Crest Road Maintenance Site. The PVPTA has requested that the District proceed with this request as soon as possible. From our conversation today, it appears that City approval prior to the 1995-96 school year is needed to make this opportunity available for the children that use the PVPTA.
