This letter serves as an update on the Conditional Use Permit (CUP), which allows
the Authority to park buses on the School District Property on Crest Road. Since
September 2004, we have been parking large buses and vehicles in excess of
fourteen at the South Coast Botanic Gardens. We have not received any complaints
regarding our operations during this time.

On August 9, 1995, the Palos Verdes Peninsula Unified School District deposited an
environmental fee charged by the State Department of Fish and Game for $1,275 with
the City of Rolling Hills in Zoning Case No. 532.
Enclosed, find a refund check for $1,225. We have deducted two $25 fees ($50)
charged by the County Recorder for the filing of a Negative Declaration prior to the
Planning process on August 31, 1995 and the filing of a Notice of Determination at the
completion of the Planning process with a request for a waiver from the Department of
Fish and Game on June 19, 1996.

SUBJECT: Update on Parking Area
Dear Mr. Nealis:
This letter serves as an update on our progress to screen the bus parking area and the
permitted uses.
Following the execution of the Memorandum of Understanding (MOU) with the Los
Angeles County Metropolitan Transportation Authority (LACMTA) pertaining to our
capital improvements, we obtained bids from fencing contractors in January. A contract
for the fencing was let and the project should be completed this weekend. The project
was slightly delayed due to inclement weather. It consists of a 6' chain link fence along
the access road on the north and a 12' fence all along the southern edge. It was deemed
necessary to go to this height in order to completely screen the vehicle roofs from the
neighbor's view. We opted for the insertion of dark green vinyl slats in this section of the
fence and are contemplating the planting of vines on the south side to assure complete
screening.
We were requested at the last Planning Commission meeting to keep Mr. Grewen of 25
Crestwind Drive, Rancho Palos Verdes apprised of our plans and to show him a sample
of the screening material. We left phone messages with him on 2/17 and 2/25. Mr. Meyer
visited his house the evening of 2/18 but the Grewen family was not at home. Mr.
Grewen called us on 2/28 and said he had been out of the country when we called. We
left a message at Mr. Grewen's office on 3/3 and apprised him of our screening plans. We
hope to report on his reaction to these improvements at your March 17th meeting.
We also spoke with Ms. Christa Hawkins of 31 Crest Road West, Rolling Hills on 2/11
and she said she had no complaints and said, "so far things are super duper."

This letter is to remind you about our telephone discussion regarding the subject
Conditional Use Permit that will expire on June 18, 1998 unless the permit is
extended by the Planning Commission prior to that date in accordance with
Paragraph A of Secttion 11 of Resolution No. 96-12 that is attached, We have also
attached a blank application form and a copy of the previous application for
reference. Please return the forms to me to allow the City time to advertise for a
public hearing. The Planning Commission meets on the third Thursday of every
month.
We would also like to inform you of the Rolling Hills Planning Commission
meeting on March 17, 1998. The Planning Commission continued the public
hearing from their January meeting to hear a status report on the progress the
Transit Authority has made in screening the bus parking area and the permitted
uses. We have spoken with Mr. Martin Gombert of the Transit Authority regarding
the status report. The public hearing will be held at 7:30 PM in the Rolling Hills
City Hall Council Chambers at 2 Portuguese Bend Road, Rolling Hills.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING AN EXTENSION AND
MODIFICATION OF A CONDITIONAL USE PERMIT FOR JOINT
POWERS TRANSIT AUTHORITY LIMITED USES IN ZONING CASE
NO. 532A.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1, An application was duly filed by the Palos Verdes Peninsula Unified
School District with respect to real property at the ±31.14 acre western portion of Lot
72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting to extend and
modify a Conditional Use Permit to permit portions of the Palos Verdes Peninsula
Unified School District Crest Road property that is used for a maintenance and
warehouse facility to continue to be used by the Palos Verdes Peninsula Transit
Authority for administrative uses and to increase storage parking from 10 vans to up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and Iocation of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in, the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.

C. On November 13, 1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2
Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school district
property.
Section 3, On May 9, 1996, Planning staff prepared an initial study for the
project. The initial study found that the project would not have a significant effect
on the environment. A Negative Declaration was prepared and was circulated to
the applicant and other interested parties in accordance with State of California
CEQA Guidelines. The public notice of the Planning Commission's intent to
recommend approval of the Negative Declaration was published on May 11, 1996.
Copies of the Negative Declaration were sent to adjacent cities and other
government agencies. No comments on the Negative Declaration were received.
Section 4. The application applies to the ±31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5, The subject site is presently occupied. by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on adjacent
properties is RA-S-2.
Section 6, The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 square feet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on May 21, 1996 and June 18, 1996. The
applicants were notified of the public hearing in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal, from
all persons protesting the same, and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. Palos
Verdes Peninsula Unified School District and Palos Verdes Peninsula Transit
Authority representatives were in attendance at the hearing.

Section 8 The PlanningCommission has reviewed the proposed Negative

Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the Planning
Commission finds that the proposed project would not have a significant effect on
the environment. Based upon these findings, the Planning Commission hereby
recommends that the City Council adopt the Negative Declaration in accordance
with the California Environmental Quality Act.
Section 9, Ordinance No. 256 was adopted by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a ±31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting

criteria for hazardous waste facilities because the project, though listed on the
current State of California Hazardous Waste and Substances Sites List, will not
require any development at the site.
P. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10, Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 532A to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the
conditions specified in Section 11.
Section 11, The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 532A to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit shall expire on June 18, 1998, unless
extended by the Planning Commission prior to that date.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval shall be
suspended and the privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation and has failed to do
so for a period of thirty (30) days.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
J. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. A meeting or meetings with area residents shall be coordinated by the
applicant and the transit authority regarding their concerns prior to the Planning
Commission meetings in December, 1996; March, 1997; December, 1997; and March,
1998.
Q. The applicant and City staff shall schedule a public hearing before the
Planning Commission at the Commission's meetings in December, 1996; March,
1997; December, 1997; and March, 1998 to hear a status report on the uses approved
by this application.
R. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
S. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

CONDITIONAL USE PERMIT
Certain uses of property are permitted in the City only upon approval of a Conditional Use Permit.
Such uses are set forth in Sections 17.16.040 and 17.20.040 of the Municipal Code. Conditional Use
Permits are decided upon by the Planning Commission following a public hearing.
APPLICATION AND REOUEST FOR HEARINQ
In order to obtain a Conditional Use Permit, a property owner or his or her agent must submit an
application and request a hearing before the Planning Commission. To do so, the applicant should
complete the requirements enumerated herein, assemble the necessary application documents and call
to make an appointment at (310) 377-1521. Making an appointment will assure that someone is
available to explain the necessary procedures and review the case material for completeness and
accuracy.
PLAN SUBMITTAL PROCESS
Applications must be submitted to the Planning Department as shown on the "Planning Application
Filing Deadline Schedule". Applications shall be deemed complete only after all required information
is submitted and the application fees are paid. The City Manager or Principal Planner will meet with
the applicant to discuss the proposal.
Once an application has been accepted as complete by the City, a hearing will be set before the
Planning Commission. Applications are considered at the regular meetings of the Planning Commission
which are held the third Tuesday of each month. Provide sufficient time in your schedule to attend at
least two meetings to allow the Planning Commission to study the facts presented and to make a field
trip review of the physical conditions. The applicant or a representative should appear at all meetings.
PLAN SUBMITTAL INFORMATION
Complete and submit with each application:
1. "Request for Hearing" application. Fifteen copies of the plan MUST accompany the initial
application. Plans must be FOLDED to approximately 8 1/2" x 11" with title block visible.
2. Owner's Declaration.
3. Plan submittal using the "Checklist" as guide. Each plan must have a vicinity map, computation
of lot coverage, building and pad sizes, cut and fill totals, and the percentage of lot disturbance
printed on the plot plan and be stamped by a licensed civil engineer or land surveyor.
4. Property owner's radius map and property owner's labels. A map is required showing the
existing properties, within or partially within a 1,000 foot radius of the exterior boundaries of
the property under consideration, including the subject property. Prepare three complete lists
of property owners of each parcel with mailing address on mailing labels. Assign a number to
each name on the list to correspond with the map numbers.
5. Certified Property Owners List Affidavit.
6. Filing fee made payable to City of Rolling Hillg.

In reviewing a request, the Planning Commission must consider the following:
1. The Planning Commission shall consider all matters presented to it fairly and impartially,
recognizing the rights of the applicant as well as its obligation to enforce all zoning ordinances
and resolutions adopted by the City Council of the City of Rolling Hills.
2. The development and use of all land within the City of Rolling Hills should be directed to the
continuation of the existing rural open areas surrounding the existing residences in the City, and
each new improvement or use of land should be carefully examined to determine what effect
the proposed improvement or use of land will have on the terrain, trees and natural flora in the
City.
3. In granting a Conditional Use Permit, the Planning Commission must make the following
findings:
A. That the proposed conditional use is consistent with the General Plan.
B. That the nature, condition, and development of adjacent uses, buildings, and structures
have been considered and that the use will not adversely affect or be materially
detrimental to the adjacent uses, building, or structures.
C. That the site for the proposed conditional use is of adequate size and shape to
accommodate the use and buildings proposed.
D. That the proposed conditional use complies with all applicable development standards
of the zone district.
E. That the proposed use is consistent with the portions of the Los Angeles County
Hazardous Waste Management Plan relating to siting and siting criteria for waste
facilities.
F. That the proposed conditional use observes the spirit and intent of the Zoning
Ordinance.
DECISION OF PLANNING COMMISSION
The decision of the Planning Commission will be final unless, within thirty (30) days following the
adoption of the resolution, a written appeal is filed with the City Clerk by:
1. The applicant.
2. Any person who protested, either orally or in writing, as a matter of record prior to the final
vote of the Planning Commission on the matter and who, in addition, received or was entitled
to receive the written notice specified in Subdivision 2 of Subsection A of Section 17.34.030.
3. The City Council, upon the affirmative vote of three members of the City Council.

4. Subdivisions and Lot Line Adjustments
Provide fifteen (15) sets of plans that show the following:.
1. Name, address and telephone no. of applicant, and name, address and telephone no.
of architect and civil engineer.
2. Plot plans must be stamped by a licensed civil engineer or land surveyor.
3. Vicinity map drawn to scale with requested improvements dimensioned to property
line and residences of all contiguous properties.
4. North arrow and scale of plans.
5. Existing contours of the entire lot.
6. Show setbacks, easements, horse trails on entire lot.
7. Outline and show square footage of building pads within allowable setbacks in
accordance with Municipal Code Title 17 (form attached).
8. Computation of lot coverage in accordance with Municipal Code Title 17 (form
attached).
9. All slopes shall not be steeper in slope than two horizontal to one vertical, or exceed
a vertical height of thirty feet (30'). All slopes shall be marked with grade.
(Municipal Code Title 15).
10. Shade all cut and fill slopes. Show shaded area square footage, cut and fill totals,
and the percentage of lot to be disturbed. (Title 15).
11. Show all retaining walls and sections through walls, height and elevations. Show
height for all buildings.
12. Show proposed drainage pattern of graded areas.
13. Designate the area(s) for which the Variance, Conditional Use Permit or Site Plan
Review is requested.
14. Show outline of residence and any additional structures. All structures must be
physically measured and square footage of each structure must be shown on drawing.
A note must be on the drawing certifying to those measurements.
15. Show a graded ilia of not less than 450 square feet fgihe construction of a stable,
550 square feet ► r a corral, and a graded road of riff more than 25% grade for
vehicular access to the stable site. (Title 17).
16. Sections should be shown through highest slope and through other areas where
ground is steep, and as many additional sections as necessary to clearly delineate
land contours with existing ground.
17. A current survey and grading plan, with related soils, geology, hydrology/drainage
reports, showing all structures on the property, with their distance from property lines
delineated, will be required in applications where the requested change is close to
easements, close to other properties, and/or where there is to be significant grading
on the property.
18. Note distances from the center line of all existing and proposed streets adjacent to
the subject property.
19. Show the existing buildable area which is that portion of a lot that constitutes the
existing building pad and any contiguous portion of the lot WITHIN REQUIRED
MINIMUM SETBACKS that has an average slope of ten percent (10%) or less. If
there is not an existing building pad, the buildable area shall mean that portion of
a lot within allowable setbacks that has an average slope of ten percent (10%) or
less.

ROLLING HILLS ("City") and by private deed restrictions enforced by the ROLLING
HILLS COMMUNITY ASSOCIATION ("RHCA").

Main buildings, accessory buildings, structures, tennis courts, swimming pools, service yards
(enclosed or unenclosed), stables, or an area of not Iess than 1,000 square feet for the construction
of a stable and corral (with vehicle access thereto) shall not cover more than twenty percent (20%)
of the net lot area, provided further that in addition to the above described improvements, the areas
included within driveways, parking space, walks, patios, decks and asphalt or concrete paving of
any kind excepting roads maintained by the Rolling Hills Community Association, shall not cover
more than thirty-five percent (35%) of the net lot area.
For the purposes of this Section "net area" shall exclude: a) the entire area within a recorded
roadway easement plus the area within ten (10) feet measured perpendicular to the edge of the
roadway easement; (b) the ten (10) foot perimeter of the lot perpendicular to the property lines; (c)
any private drive or driveway that provides access to any other lot or parcel; and (d) the access strip
portion of a flag lot.
COMPUTATION OF BUILDABLE AREA AND COVERAGE THEREOF
A policy of the City is to address coverage of an identified "EXISTING BUILDABLE AREA".
Coverage thereof is based upon the calculation of the "footprint" square footage of the residence,
garage, stable (barn), and other accessory structures proposed and/or developed on said "buildable
area."
For purposes of this calculation, "buildable area" shall be defined as stated in Section 17.12.020 of
the Rolling Hills Municipal Code which declares existing "buildable area" as the portion of a lot
that constitutes the existing building pad and any other contiguous portion of the lot WITHIN
ALLOWABLE SETBACKS THAT HAS AN AVERAGE SLOPE OF TEN PERCENT
(10%) OR LESS. If there is no existing building pad, it shall mean that portion of a lot within
allowable setbacks that has an average slope of ten percent (10%) or less.

This letter is to remind you about the Rolling Hills Planning Commission meeting
on March 17. 1998. The Planning Commission continued the public hearing from
their January meeting to hear a status report on the progress the Transit Authority
has made in screening the bus parking area and the permitted uses. We have
spoken with Mr. Martin Gombert of the Transit Authority regarding the status
report. The public hearing will be held at 7:30 PM in' the Rolling Hills City Hall
Council Chambers at 2 Portuguese Bend Road, Rolling Hills.
Since the last meeting on January 20, 1998, we have not received any complaints
regarding the Transit Authority uses. We have also left telephone messages for Mr.
Frederick Grewen, 25 Crestwind Drive, regarding his previous concerns about his
viewscape.

As the new year began, it was
business as usual at the Palos Verdes
Peninsula Transit Authority's first
meeting last Thursday morning at
the Rolling Hills Estates City Hall.
Board members looked back on last
year's holiday season to assess the
success of their special holiday
shopper shuttle that ran through-
out the Peninsula, as well as the
timeliness and efficiency of the
fixed routes that run daily. They
also looked to the future and the
current developments that will
hopefully prove to be beneficial to
the Peninsula community in 1998.
Ridership Up From Past Years
Based on past numbers, rider-
ship, not including the holiday
shuttle, has gone up, according to
Deloris Dunn, operations manager
at Ryder/ATE, the company that
hires and schedules drivers for the
Peninsula transit authority.
Although official numbers were not
yet available for either the holiday
shuttle nor the regular routes, board
members were given an idea as to
how much ridership increased due-
ing the recent holiday season.
"One day in November,' approxi-
mately 100 people used the buses as
opposed to last year when only 19
made use of the community's tran-
sit system during the holidays," said
John Meyer,: administrator for the
transit authority.
Although ridership seems to be,
growing, the authority showed con-,
cern about the increasing turnover'

seniors need transportation from

Humphrey, chairperson of the
authority. "It would be nice if dri-
vers knew when to wait for them
so that they aren't left stranded:'
This problem, however, is not
solely the fault of the contractor.
Due to the unusual shift times
and because of the fact that most
drivers do not live on the Hill, it is
extremely difficult for hired dri-
vers to accommodate both their
working and personal schedules,
not to mention, make the trek up
the Hill, Meyer explained.
Realizing the difficulties that
drivers face, the board recom-
mended creating an incentive
package for the workers in order
to avoid turnover and the waste of
training costs. Recommendations
will be made at the next meeting.
"Drivers come from within and
outside the South Bay area, like
Inglewood," said Meyer. "Shifts
can start as early as 6 a.m., ending
at 9 a.m. Then they have to come
back at around 3 p.m., ending
their shift at 6 p.m. This creates a
difficulty for those who have chil-
dren since, with this shift, it would
be too early to drop them off at
child care and too late to pick
them up. Plus, they have to make
two trips up the Hill since there is
such a wide gap of free time dur-
ingtheday.".

Investments Made •
With the procurement of four
brand new vehicles, the PVP
Transit Authority will do away
with the existing buses that run
on diesel fuel. These new buses,
which will cost $240,000 and run
onregular gasoline, are to be
delivered sometime in February.
The purpose of these new vehicles
is twofold: improving the reliabil-
ity of the vehicle should also
improve the entire transit system;
and switching to regular -powered
gasoline tanks should decrease the
amount of noise pollution experi-
enced with diesel -operated buses.
Future Endeavors
The PVP Transit Authority is
currently taking bids from con-
tractors to complete a project in
order to protect and "hide" the
vehicles while not in operation.
The parking lot where the shuttles
are parked is located in a ravine
off Crest Road and Crenshaw,
near St. John Fisher Church. A
complaint from a resident whose
view is obstructed by the sight of
the vehicles from his house above
the ravine has encouraged the
board members to seek proper
fencing in order to conceal the lot.
Besides trying to accommodate
the resident's request to take mea-
sures to hide the lot from his view,
the authority also recognizes that
proper fencing is a good form of
security for the parked vehicle's to
protect them from vandalism or
theft.

Dear Ms. Ungar:
This letter serves as a follow-up to our recent conversation concerning Mr. Fred Grewen.
We met with Mr. Grewen on December 27, 1997 at his residence. He showed us the different
views from his property and where he could see the buses. The buses had been moved from the
parking area to allow it to be repaved. We still were able to get a good idea of his concerns
relating to the view of buses, however. We told Mr. Grewen that we were getting estimates for
fencing and screening and that we would update him on these plans in early January.
In late December we arranged for two fencing companies to visit the parking site and submit
estimates. We have received one estimate and are waiting for the second. Our preliminary plan is
to construct a 10 to 12 foot wood fence along the parking area that faces Mr. Grewen's property.
We anticipate receiving the final estimate, make a decision on the fencing material, and award a
contract by the end of January.
We left a message on Mr. Grewen's phone on January 9, 1998 updating him on our progress. We
will call him once we receive the second estimate and update him on our plans.
Several trees were planted along the parking area facing Mr. Grewen's home during last summer
in an effort to close some of the gaps in foliage. A number of these trees did not survive and they
were replaced on January 13, 1998. Additional landscaping will commence once the above
fencing has been installed and we can get a better idea of what additional efforts are required.
These efforts were also reviewed at the January 8th PVPTA Board meeting with all the member
cities participating in the discussion.
As we have noted, our plan is to select the fencing contractor, fencing material type, and award
the contract by the end of January. Fencing and additional landscaping should be completed in the

This letter serves as a follow-up to our recent conversation concerning Ms. Christa Hawkins.
We called Ms. Hawkins on December 23, 1997 after she called your office concerning bus noise from
the Crest Road parking area. We had a long discussion concerning bus operations. She was primarily
concerned with operations on the weekend. We told her that PV Transit operates 3 to 4 charters per
year that may operate on weekends and they are primarily for the home tours. We explained to Ms.
Hawkins that PV Transit had been operating the Holiday Shoppers shuttle the weekend prior to
Christmas and that it would end the following weekend. We also told her that, except for a rare charter
service, the only activity on the weekend at the parking location would be maintenance personnel taking
vehicles off the hill for maintenance.
We told her that we would like her to contact our office immediately if she had any noise complaints
and that we wanted to minimize her problems. She was very appreciative that we called,
We spoke with Ms. Hawkins again today and she said "things have been very quiet." We told her we
would contact her within two weeks to double check on her observations. We encouraged her to call
again if she had any problems.

RESOLUTION NO. 96-12
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING AN EXTENSION AND
MODIFICATION OF A CONDITIONAL USE PERMIT FOR JOINT
POWERS TRANSIT AUTHORITY LIMITED USES IN ZONING CASE
NO. 532A.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1, An application was duly filed by the Palos Verdes Peninsula Unified
School District with respect to real property at the ±31.14 acre western portion of Lot
72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting to extend and
modify a Conditional Use Permit to permit portions of the Palos Verdes Peninsula
Unified School District Crest Road property that is used for a maintenance and
warehouse facility to continue to be used by the Palos Verdes Peninsula Transit
Authority for administrative uses and to increase storage parking from 10 vans to up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.

C. On November 13, 1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2
Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school district
ProPerty.
Section 3, On May 9, 1996, Planning staff prepared an initial study for the
project. The initial study found that the project would not have a significant effect
on the environment. A Negative Declaration was prepared and was circulated to
the applicant and other interested parties in accordance with State of California
CEQA Guidelines. The public notice of the Planning Commission's intent to
recommend approval of the Negative Declaration was published on May 11, 1996.
Copies of the Negative Declaration were sent to adjacent cities and other
government agencies. No comments on the Negative Declaration were received.
Section 4. The application applies to the ±31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on adjacent
properties is RA-S-2.
Section 6. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 square feet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on May 21, 1996 and June 18, 1996. The
applicants were notified of the public hearing in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal, from
all persons protesting the same, and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. Palos
Verdes Peninsula Unified School District and Palos Verdes Peninsula Transit
Authority representatives were in attendance at the hearing.

Section 8, The Planning Commission has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the Planning
Commission finds that the proposed project would not have a significant effect on
the environment. Based upon these findings, the Planning Commission hereby
recommends that the City Council adopt the Negative Declaration in accordance
with the California Environmental Quality Act.
Section 9s Ordinance No. 256 was adopted by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for, administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a ±31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting

criteria for hazardous waste facilities because the project, though listed on the
current State of California Hazardous Waste and Substances Sites List, will not
require any development at the site.
P. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10, Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 532A to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 532A to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit shall expire on June 18, 1998, unless
extended by the Planning Commission prior to that date.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval shall be
suspended and the privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation and has failed to do
so for a period of thirty (30) days.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
j. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. A meeting or meetings with area residents shall be coordinated by the
applicant and the transit authority regarding their concerns prior to the Planning
Commission meetings in December, 1996; March, 1997; December, 1997; and March,
1998.
Q. The applicant and City staff shall schedule a public hearing before the
Planning Commission at the Commission's meetings in December, 1996; March,
1997; December, 1997; and March, 1998 to hear a status report on the uses approved
by this application.
R. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
S. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

This communication is a follow up, on previous correspondence in which we brought the City up
to date on any activities during the summer months and the concern expressed regarding early
morning noise during our start-up week in September.
As reported at that time, we immediately conducted a meeting with the drivers to reiterate the
need to conduct the early morning pull-out with a minimum of conversation and avoidance of any
back-ups. Two recommendations came out of that meeting: That the conditions be clearly
spelled out in the training manual for new drivers and that some vehicles be parked in parallel
fashion at the end of the afternoon shift in order to ascertain that no vehicles have to back up even
�a few feet in the morning. These driver originating suggestions were promptly implemented
and we have not become aware of any comments since the one during the first week of
September.
As previously reported, some $3000 worth of additional landscaping was planted by PVPTA this
summer to improve upon the screening of the parking lot. We are awaiting the final approval of a
Memorandum of Understanding for the MTA grant to further enhance the fencing and screening
of this area. Meanwhile, the PVPUSD has undertaken a much needed renovation program to
improve the restrooms, jointly used by their personnel, the credit union and ourselves.
In as much as I will be at my assignment on the privatization of transit in the European. Union at
the time of the next Planning Commission meeting, Mr. Martin Gombert will attend to answer any
questions the committee members or the city staff may have.
Once again we would like to thank the City for their cooperation in making these facilities
available to the Authority. As a result we were able to implement the current route system which
has resulted in unprecedented ridership increases during the past two years.

Dear Commission Members:
With reference to my appearance before the Planning Commission on June 18,
1996 and to my letter to the City of Rolling Hills dated February 7, 1997, I appear before
you tonight to express my profound frustration with the Commission and the Palos
Verdes Transit Authority.
The decision to park the Transit Authority vans on the access road that is in full
view of my property has caused my following concerns:
• This is an access road that must be used by the fire department if there is a
fire in the canyon as there was last spring. The vans being parked on that road
stand as an impediment to fire equipment getting into the canyon in an
emergency. This directly affects my family's safety as we live on that canyon.
• Without question, the vans occupying our view will affect the resale value of
my property.
• Since the vans have dominated our view, our quality of life living on what at
one time was a pristine, beautiful canyon has been shattered.
My appeal to your sense of decency and fair play has resulted in the vans
remaining in my view and occupying this road nine months after I addressed you last
June. This is an unacceptable condition that must be resolved by either the denial of the
permit or parking the vans in the lot that was design for that purpose in the first place.

Council that this is a new development, they told me it was apparently being done to avoid the
beeping sound that the vans make when they back up in the morning. Seven months later
nothing has changed.
Our view is one of a beautiful green canyon, city lights and mountains. I paid
handsomely for this view only to have some logistics genius make a road a parking lot. We all
know that the properties on this hill have values based on the views that they afford their owners.
1 also don't have to tell you about the quality of life that our views give us.
Since the vans have occupied our view, our quality of life and perceived properly value
have been diminished. This, all in the interest of aiming the vans in one direction.
There is a parking area designated for these vans that doesn't spoil anyone's view. In the
interest of doing what is right, proper and considerate, I sincerely hope that my plea will not be
ignored this time. We invited Ms. Rosemary Humphrey, Councilwoman P. V. Estates to visit
our property after the meeting on June 25. She promised she would do so in the near future but
we never heard from her.
I expect the responsible party to do the right thing and resolve this problem without my
having to take this issue beyond my own efforts. I also expect a timely response.

Following receipt of Mr. Fred Grewen's letter to you, we promptly investigated the situation and found that
this homeowner's problem was greatly aggravated, if not totally caused by, the tree cutting and underbrush
trimming undertaken by the District last December. PVPUSD needed to do this for safety and aesthetical
reasons. Unfortunately, a number of the vans became visible from Mr. Grewen's location through some
gaps in the foliage.
We suggested to Mr. & Mrs. Grewen that one manner in which to remedy this situation would be to
improve the landscaping by planting some fast growing bushes in the above mentioned areas. Mr. Grewen
asked us to first explore the possibility of moving the vans to the main parking lot where the vehicles would
be completely out of his line of sight. We diligently followed up on this request and have held several
discussion with the District. However, we are all concerned that such a move may have a negative impact
upon the homeowners closer to that location.
At the March 27, 1997 Authority meeting we will be presenting the Grewen's communication to our Board
with the recommendation that the landscaping improvement suggestion be pursued forthwith. As you know,
we have been extremely sensitive to the conditions set forth in the CUP during the past 18 months and have
made every effort to address any potential problems.
Please be assured that these efforts will continue. We are always ready to meet with any of the neighbors.
We will also be represented at the Planning Commission meeting on Tuesday to answer any questions.

Thank you for your correspondence dated January 25, 1997, describing the storage of
PV Transit Vans on the Palos Verdes Unified School District property. Permission
to utilize the property in this manner is authorized . under an approved Rolling
Hills Conditional Use Permit for that limited use.
The conditionthat requires parallel parking for the vans was included at the request
of several residents who reside south of the property in the City of Rancho Palos
Verdes. Their concern was to reduce early morning noise caused by the van back-up
warning devices.
We have forwarded a copy of your correspondence to PV Transit Administrator
John Meyer for his consideration. Members of the Rolling Hills Planning
Commission are scheduled to consider a status report regarding the use of this
property on March 18, 1997, beginning at 7:30 p.m. at Rolling Hills City Hall, 2

RESOLUTION NO. 96-12
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING AN EXTENSION AND
MODIFICATION OF A CONDITIONAL USE PERMIT FOR JOINT
POWERS TRANSIT AUTHORITY LIMITED USES IN ZONING CASE
NO. 532A.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by the Palos Verdes Peninsula Unified
School District with respect to real property at the ±31.14 acre western portion of Lot
72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting to extend and
modify a Conditional Use Permit to permit portions of the Palos Verdes Peninsula
Unified School District Crest Road property that is used for a maintenance and
warehouse facility to continue to be used by the Palos Verdes Peninsula Transit
Authority for administrative uses and to increase storage parking from 10 vans to up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.

C. On November 13, 1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2
Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school district
property.
Section 3. On May 9, 1996, Planning staff prepared an initial study for the
project. The initial study found that the project would not have a significant effect
on the environment. A Negative Declaration was prepared and was circulated to
the applicant and other interested parties in accordance with State of California
CEQA Guidelines. The public notice of the Planning Commission's intent to
recommend approval of the Negative Declaration was published on May 11, 1996.
Copies of the Negative Declaration were sent to adjacent cities and other
government agencies. No comments on the Negative Declaration were received.
Section 4. The application applies to the ±31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on adjacent
properties is RA-S-2.
Section 6. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 squarefeet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on May 21, 1996 and June 18, 1996. The
applicants were notified of the public hearing in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal, from
all persons protesting the same, and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. Palos
Verdes Peninsula Unified School District and Palos Verdes Peninsula Transit
Authority representatives were in attendance at the hearing.

Section 8. The Planning Commission has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the Planning
Commission finds that the proposed project would not have a significant effect on
the environment. Based upon these findings, the Planning Commission hereby
recommends that the City Council adopt the Negative Declaration in accordance
with the California Environmental Quality Act.
Section 9. Ordinance No. 256 was adopted by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and, development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a ±31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting

criteria for hazardous waste facilities because the project, though listed on the
current State of California Hazardous Waste and Substances Sites List, will not
require any development at the site.
F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 532A to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 532A to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit shall expire on June 18, 1998, unless
extended by the Planning Commission prior to that date.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval shall be
suspended and the privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation and has failed to do
so for a period of thirty (30) days.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
J. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. A meeting or meetings with area residents shall be coordinated by the
applicant and the transit authority regarding their concerns prior to the Planning
Commission meetings in December, 1996; March, 1997; December, 1997; and March,
1998.
Q. The applicant and City staff shall schedule a public hearing before the
Planning Commission at the Commission's meetings in December, 1996; March,
1997; December, 1997; and March, 1998 to hear a status report on the uses approved
by this application.
R. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
S. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

We have just been informed by PVPUSD that a contractor will be arriving tomorrow and
commence some much needed tree trimming in the area where our vehicles are usually parked.
PVPTA has been requested to move all vehicles to the center of the parking lot for the duration of
this project.
In as much as the vehicles may then be visible to certain neighbors we all may be receiving some
inquiries. Please have your personnel give the assurance that this will only last a few days and
then things should be back to normal. Also, kindly inform us of any individuals that could
benefit from a personal call and we will be most happy to contact same.

Thank you for your letter of November 5, 1996, in preparation for the Rolling
Hills Planning Commission's meeting on December 17, 1996. We will
incorporate your letter in the December meeting staff report.
The public hearing will be held at 7:30 PM in the Rolling Hills City Hall
Council Chambers, 2 Portuguese Bend Road, Rolling Hills.
The public hearing is scheduled before the Planning Commission to hear a
status report on the limited uses permitted to the Palos Verdes Peninsula
Transit Authority at the school district property on Crest Road in the City of
Rolling Hills in accordance with Section 11, Paragraph Q of Resolution No.
96-12, dated June 18, 1996 (attached).
Since the last meeting on June 18, 1996, we have not received any letters or
verbal reports from nearby residents.

Pursuant to our verbal report on the start up of the September services we would like to follow
up with a report on one of the conditions in the above mentioned Conditional Use Permit.
With a number of new drivers on board, we have asked our contractor to place great emphasis on
the need for car pooling during their training and safety sessions. A reminder is also prominently
displayed on the assignment board utilized by all the drivers. At this time approximately 20% of
the drivers are in a car pool on a daily basis. Others avail themselves of the opportunity do so
when their shift coincides with someone else within their geographic area. Two impediments
toward car pooling have been identified: The disperse area from which these folks have to come
and the fact that a number of them are part-timers who work on different shifts. Please rest
assured that we will continue to monitor this situation closely.
This information is presented at this time in order that it can be presented in December to the
Planning Commission. We continue to be amazed at the savings created by our ability to keep
the vehicles here overnight. The Agency Members as well as the school district continue to be
deeply appreciative of this cooperative effort by the City of Rolling Hills.

This letter shall serve as official notification that Zoning Case No. 532A was APPROVED by
the Planning Commission on June 18, 1996 at a regular meeting. The Planning Commission's
decision will be reported to the City Council at their regular meeting on June 24, 1996.
Note that a public hearing to hear a status report will be scheduled for Planning Commission
meetings in December, 1996; March, 1997; December, 1997; and March, 1998; prior to which a
meeting or meetings with area residents shall be coordinated by the school district and the
transit authority regarding the conditions stated in Section 11 of the Resolution.
The approval will become effective:
(1) Thirty (30) days after adoption of the Planning Commission's resolution if no appeals
are filed within that time period (Section 17.54.010(B) of the Rolling Hills Municipal
Code attached), AND
(2) An Affidavit of Acceptance Form and the subject resolution must be filed by you with
the County Recorder.
We have enclosed a copy of RESOLUTION NO. 96-12, specifying the conditions of approval
set forth by the Planning Commission and the approved Exhibit A Development Plan to keep
for your files. Once you have reviewed the Resolution, please complete the enclosed

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING AN EXTENSION AND
MODIFICATION OF A CONDITIONAL USE PERMIT FOR JOINT
POWERS TRANSIT AUTHORITY LIMITED USES IN ZONING CASE
NO. 532A.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by the Palos Verdes Peninsula Unified
School District with, respect to real property at the ±31.14 acre western portion of Lot
72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting to extend and
modify a Conditional Use Permit to permit portions of the Palos Verdes Peninsula
Unified School District Crest Road property that is used for a maintenance and
warehouse facility to continue to be used by the Palos Verdes Peninsula Transit
Authority for administrative uses and to increase storage parking from 10 vans to up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.

C. On November 13, 1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2
Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school . district
property.
Section 3. On May 9, 1996, Planning staff prepared an initial study for the
project. The initial study found that the project would not have a significant effect
on the environment. A Negative Declaration was prepared and was circulated to
the applicant and other interested parties in accordance with State of California
CEQA Guidelines. The public notice of the Planning Commission's intent to
recommend approval of the Negative Declaration was published on May 11, 1996.
Copies of the Negative Declaration were sent to adjacent cities and other
government agencies. No comments on the Negative Declaration were received.
Section 4. The application applies to the ±31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on adjacent
properties is RA-S-2.
Section 6. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 square feet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on May 21, 1996 and June 18, 1996. The
applicants were notified of the public hearing in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal, from
all persons protesting the same, and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. Palos
Verdes Peninsula Unified School District and Palos Verdes Peninsula Transit
Authority representatives were in attendance at the hearing.

Section 8. The Planning Commission has reviewed the proposed Negative
Declaration and finds that it represents the independent judgment of the City and
that it was prepared in compliance with CEQA. Therefore, the Planning
Commission finds that the proposed project would not have a significant effect on
the environment. Based upon these findings, the Planning Commission hereby
recommends that the City Council adopt the Negative Declaration in accordance
with the California Environmental Quality Act.
Section 9. Ordinance No. 256 was adopted , by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a ±31.14 acre parcel of property that is adequate- h
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development :.
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development.

E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and, siting :.

criteria for hazardous waste facilities because the project, though listed on the
current State of California Hazardous Waste and Substances Sites List, will not
require any development at the site.
F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 532A to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 532A to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit shall expire on June 18, 1998, unless
extended by the Planning Commission prior to that date.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval shall be
suspended and the privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation and has failed to do
so for a period of thirty (30) days.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked' "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
J. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. A meeting or meetings with area residents shall be coordinated by the
applicant and the transit authority regarding their concerns prior to the Planning
Commission meetings in December, 1996; March, 1997; December, 1997; and March,
1998.
Q. The applicant and City staff shall schedule a public hearing before the
Planning Commission at the Commission's meetings in December, 1996; March,
1997; December, 1997; and March, 1998 to hear a status report on the uses approved
by this application.
R. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
S. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

Due to a scheduling conflict, I will be unable to
personally attend tonight's meeting; however, I would like to
submit this letter to express my views on the referenced
Application.
If the applicant is going to be given the conditional use
permit it requests, I recommend that such conditional use permit be
subjected to the following conditions:
1. Parking of ten (10) vans only and no
other vehicles in the area designated for
van parking.
2. The van drivers be required to car pool
to the site and that personal cars --
save and except those used for car
pooling purpose -- cannot park at the
referenced site. In no event can the
private vehicles, i.e., those used for
car pool purposes, be parked in the area
designated for van parking.
3. The vans parked in the area designated
for van parking may not be operated from
the site before 7:00 a.m. Moreover, the
vans may access the area designated for
van parking only twice per day, i.e.,
once in the morning when the vans depart
and once at the end of the day when the
vans are returned to the designated
parking area.
The foregoing "conditions" are all based on the solemn
promises made by the school board's representatives when they
applied for the conditional use permit. Each and every promise has
been consistently broken. There have been routinely 15 vans in the
designated parking area, plus another 12-16 vehicles parked in the
area designated for van parking during the days. The drivers do
not car pool. The drivers start the vans between 5:45 a.m. and

6:00 a.m. every morning. The vans are operated in and

If the City is going to grant the school board any sort
of extension on the conditional use permit, in my view the school
board ought to have the above recommended conditions imposed upon
it. Imposing these conditions is merely insisting that the school
board live up to its previous promises. As such, the conditions
are, in fact, self imposed. The City should not allow the school
board to increase the number of vehicles at the site given its
consistent breach of its prior promises. If the City is going to
provide any sort of extension on the conditional use permit, the
school board should be placed "on probation," i.e., insisting that
it put its conduct where its promises have been. The City should
monitor the school board's willingness to meet its commitments for
another six (6) months and, if the there are further infractions,
the City should revoke the conditional use permit.
How do I know about these infractions? I live directly
across the street from the van parking site. My family and I have
our sleep disturbed every morning -- generally before 6:00 a.m. --
by the van drivers. As an aside, I understand from other residents
that these van drivers leave the facility in order to swarm at a
local coffee shop (near the Peninsula Center) for coffee and
donuts. There is absolutely no excuse for any of our residents
being disturbed while these van operators "start their engines" at
this early hour which is, no doubt, about the time their passengers
are still wiping the "sleep" from their eyes. If the van operators
want to shop for donuts and coffee, surely it is not too much to
ask that they do so -- from their own private vehicles and on their
own time -- without making themselves nuisances to the residents of
the City that is being asked to host the school board's venture.

received. We have been monitoring the service very closely and we welcome the opportunity to
respond to the questions raised by Planning Commissioner Witte at the last meeting and in his

The above departure times from the yard may vary by one to five minutes. The mandated safety
check is performed as quickly and quietly as possible and we have asked the operators to spend
only a minimal amount of time at the yard.
There may have been an occasion where a vehicle was left at the Library in between the above
times due to mechanical difficulties. Our office is immediately notified of same in order that we

may reassure the passengers that a replacement is on the way. However, during a careful
examination of our daily logs since mid -November we were unable to locate any multiple such
incidents during a given day. Finally, the occurrence described in Mr. Witte's note could have
involved vehicles 5, 6, 8 or - most likely - vehicle 9 as it passes by the Library at that time.
Vehicles left idling at the Library
Our contractor and administrator are enforcing some rather stringent rules pertaining to vehicles
on "down time" or "standby". Operators are to shut the engines off if any stoppage exceeds four
minutes. They are not to leave the engines running unattended under any circumstances and they
are to shut down the engine and lock the vehicle if circumstances call for the operator to be
temporarily away from the vehicle. The Authority appreciates hearing from anyone who observes
a violation of these rules, as well as any other incident, in order that counseling and/or disciplinary
action may be instigated in a timely manner.
Number of vehicles
The original application should have been for all the vehicles in the active fleet, rather than the
number owned by the Authority. The modification addresses this oversight.
Back-up warning signals
We understood that this item was addressed at the March 19th meeting in some detail. There is
absolutely no reason for any of the PVPTA vehicles to back up as the parking spaces were
carefully laid out to avoid this. In addition, a sign has been placed above the key rack as a daily
reminder. We also know that PVPUSD personnel are very cognizant of this problem as it
pertains to their equipment. We believe this issue is confined only to the outside vendors delivery
trucks arriving at the loading dock in the morning.
In conclusion, we would like to once again reiterate that the 3 member cities of the Authority
and the School District are extremely grateful that your City's favorable action has resulted in
such savings in operating costs. This has enabled us to a) balance the budget and, b) to serve the
community in a much more efficient fashion than would otherwise be possible.
We will be prepared to answer any additional questions the Commissioners or staff may have on
May 21st.

APPLICATION REQUIRED BY THE MUNICIPAL CODE: Section 17.16.040(B) - Conditional
Use As Primary Use.
Pursuant to the authority and criteria contained in the California Environmental Quality Act (CEQA)
and the CEQA Guidelines of the City of Rolling Hills, the Lead Authority has analyzed the
proposed requests. After reviewing the Initial Study and any applicable mitigating measures for
the project, staff has determined that this project will not have a significant effect on the
environment. Accordingly, a Negative Declaration has been prepared.
Consideration of this proposed Negative Declaration is in conjunction with the Commission's
review of the proposed project to determine whether the project conforms with the Zoning Code
and General Plan of the City of Rolling Hills. The Planning Commission will thereafter consider
whether to adopt the Negative Declaration at a subsequent meeting for which notice is also given.
Public comments will be received by the City of Rolling Hills on the Negative Declaration for this
project through May 30, 1996.
Any person is welcome to review the subject application and plans prior to the public hearing at the
City Hall Administration Building located at 2 Portuguese Bend Road, Rolling Hills, CA 90274
