UNGAR 2 3 I, Lola M. Ungar, declare as follows: 4 1. I am the Principal Planner for the City of Rolling Hills. In that capacity, I am 5 and have been the sole planner employed by the City since January 25, 1991, and am completely 6 familiar with the City's subdivision procedures. I have personal, firsthand knowledge of the 7 following facts and, if called as a witness, I could and would competently testify thereto. 8 2. I have reviewed the Declaration of Richard L. Stone attached to Colyear's Reply g to the City of Rolling Hills' Opposition to Motion for Administrative Writ of Mandate. The 10 Declaration erroneously addresses the procedure by which Certificates of Compliance and lot line it adjustments are processed in the City of Rolling Hills. 12 3. In Paragraphs 2 and 3 of his Declaration, Mr. Stone states his belief that he 13 contacted the City of Rolling Hills Planning Department to ascertain the City's procedures for 14 processing lot line adjustments. In fact, he did not. From the telephone number set forth in 15 Paragraph 2 and the person to whom he spoke, it appears Mr. Stone telephoned the wrong city, 16 the City of Rolling Hills Estates, at (310) 377-1577, and spoke with David Wahba of that City's 17 Planning Department, who apparently told Mr. Stone how that City processes applications for a 18 lot line adjustment. The City of Rolling Hills Estates adjoins, and is located to the north of, the 19 City of Rolling Hills, which is the respondent and cross -complainant in the above -entitled action. 20 4. The City of Rolling Hills has adopted its own Subdivision Ordinance, which is 21 contained in Chapter 16 of the City's Municipal Code. That Subdivision Ordinance neither 22 incorporates the procedures set forth in the Los Angeles County Code nor the procedures set 23 forth in Title 22, § 22.56.1756(c), of the County Code for the processing of applications for lot 24 line adjustments. In response to the City's argument raised for the first time in its 12 opposition papers that its imposition of the easement condition at issue was required 13 because of Colyear's request for Certificate of Compliance, I contacted the City of Rolling 14 Hills' Planning Department on June 24, 1993, at 9:40 a.m. I reached the Planning 15 Department by calling the City of Rolling Hills City Hall at (310) 377-1577. I spoke to a 16 gentleman named "David" with the City's Planning Department. 17 18 3. David informed me that the City of Rolling Hills uses the L.A. 19 County Mapping Department to process lot line adjustments. He informed me that after 20 an engineering company prepares an actual survey and a legal description is provided, 21 that the City of Rolling Hills submits it to Los Angeles County's Mapping Department for 22 23 24 25 26 27 28 -17- 1 further processing.
