I. Such change is warranted because (State reasons) It will provide optimum use.
It is in keeping with overall uses of adjacent properties; the choice of site
was made in part to allow for construction of tennis or paddle tennis court;
it is necessary to allow owner maximum use and enjoyment of the TE9p2Ety in
keeping with the theme of the community.
T1.Such Change is based upon the following described exceptional or extraordinary
circumstances or conditions that do not apply generally to other property or
class of use in the same vicinity and zone. (State circumstances) The overall
plan for the property is such that the court will not be visible from the
street. It will not interfere with the use or enjoyment of any other properties.
The parcel is adequate in size dimensions and topography to allow for such use.
III.Such change is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone.
(State reasons) Adjacent property already has a tennis court thereon. Numerous
home (properties) in the city have tennis or paddle tennis courts. Most of the,
newer homes have been designed to allow for such uses. The reasons for choice
of site and city are in part based upon property owners desire to eniov such
recreational uses as are afforded other homeowners in the city.
IV. Such change will not be materially detrimental to the public welfare nor injur-
ious to the property or improvements in such vicinity and zone where property
is located because The court will be located upon the property in such fashion
so as to blend in with the overall theme of the surrounding properties. The
property is being landscaped in a fashion so as to make it attractive from any
view or angle. It will not be generally visible from any location off the
property. Fencing will be low as to not be visible from off the property and
will not interfere with the view from adjacent property.
