BURKE, Lot 70-1-MS, for • a Conditional Use Permit under Article 3, Section 3. 01, paragraph (D), subparagraph 3(c), of Ordinance No. 33 as amended by Ordinance No. 112 of the City of Rolling Hills, for the construction of a paddle tennis court, came on for hearing on February 21, 1978, in the Council Chambers of the Administration Building of the City of Rolling Hills at No. 2 Portuguese Bend Road, Rolling Hills, California, the applicant being present in person and having submitted evidence in support of the application, and the Planning Commission having determined that it was necessary to physically examine and view the site of the proposed construction of the paddle tennis court, and the matter being continued to March 2, 1978, and the members of the Planning Commission having individually (not collectively) inspected the site of the proposed paddle tennis court and the premises generally, and the applicant being present in person and oral and documentary evidence having been presented by the applicant, and residents of the. Burke is the owner of a certain parcel of real property which is in the process of being improved, described as Lot 70 of Miscellaneous Parcels in the Records of the City of Rolling Hills, said parcel also being. known by street and number as 33' Crest Road East, Rolling Hills, California. II Notice of the public hearing in connection with the application of Adrienne E. Burke, for a Conditional Use Permit for the construction of a paddle tennis court on the above described real property, was given as required by Sections 8. 06. and 8.07 of Ordinance No. 33 as amended, of the City of Rolling Hills, California. Applicant proposes to construct a paddle tennis court on the westerly portion of the above described real property which parcel contains approximately 2. 2.gross acres, on which there has been constructed a resi- dential dwelling, swimming pool and a pool house. Said paddle tennis court is located so that it can be viewed by traffic traveling in an easterly direction on Crest Road and from Southfield Drive, which is located easterly of said property and is lower than the road surface of Crest Road and Southfield Drive. -2-, • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Iv Applicant proposes to screen said paddle tennis court with landscaping and agrees to maintain said landscaping as required. A plan of said proposed landscaping was introduced into evidence for examination by the Commission. V Said paddle tennis; court proposed to be constructed is located 440 feet southerly of the Occhipinti residence, 450 feet from the Morris resi- dence, 420 feet from the Stearn residence, 320 feet from the Fischer resi- dence, 200 feet from the Wachtell residence, and 435 feet from vacant property on which Mr. Coates proposes to construct a residence. A11 of said properties are either adjacent to or are located in the vicinity of the proposed construction. VI That all land in the City of Rolling Hills is zoned for residential - agricultural purposes except for a small area zoned limited commercial at the northerly boundary of the City. Applicant's property is located in a residential - agricultural two -acre minimum zone on Crest Road East, which is the, pri- mary road for transversing the City in an easterly and westerly direction. Houses located on the northerly side of Crest Road are generally at a higher elevation than those located on the southerly side. VII Ingress and egress to applicant's property is over private roads and applicant's property is located near the intersection of Crest Road and Southfield Drive. The property slopes generally in a southwesterly -3- • • 0 >o CO J O O 7 m W mdn J Z Z p� z Sao re0ILco ▪ V• .cnvt ▪ 3Wuz zxi • N u Q U7 W Vo -1 N 1 direction and is comparatively flat. 2 Mr. Joe Linkogle, Vice President of Coldwell Banker, a realty 3 brokerage firm, and who has specialized in selling real estate on the Palos 4 Verdes Peninsula for ten years, testified that construction of the applicant's 5 6 7 8 9 10 11 12 13 14 15 16 17 18 1.9 20 21 22 23 24 25 26 27 28 paddle tennis court, if properly located so as not to be an eyesore and having an adequate distance adjacent to the property, would not deteriorate from the value of adjoining properties; and if said court were improperly placed, in such a manner that it obstructed the view, of adjoining properties or if it were constructed in such a .manner that .it detracted from the general overall appeal of the adjacent properties, it could be a detriment to the value of adjoining properties. VIII Allan Roberts, Thomas Wachtell, residents of the City of Rolling Hills, testified against the granting of the Conditional Use Permit. Eugene Schwartzman and Robert Schmidt, residents of the City of Rolling Hills, testified in favor of granting the Conditional Use Permit. The southerly boundary of the Wachtell property is 200 feet distant from the site of the pro- posed paddle tennis court. IX The arrangement and location of all improvements, including the proposed paddle tennis court on applicant's property, gives the overall effect that the property is being over -built. The lot, although containing 2. 2 gross acres, has a net area of approximately 65, 000 square feet (after deducting easement areas) and is smaller in area than lots in the immediate vicinity. -4- • • MASON AND KINLEY 437-0973 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 X There is in existence on the Stern property, which is located 420 feet from the site of the proposed paddle tennis court, a tennis court; and. the construction of a paddle tennis court will increase the noise and traffic and congestion in the area in which the applicant's lot is located. XI The construction of the paddle tennis court on applicant's lot is inconsistent with the development of the surrounding property and puts too great a burden on the lot itself; and has an adverse effect on adjoining properties. FORMAL REPORT The granting of the Conditional Use Permit to applicant would either destroy or intrude upon the rural nature and quiet atmosphere and would obstruct the view' of properties adjoining Lot 70 of Miscellaneous Parcels and would infringe upon the seclusion and privacy of owners of adjoining residential property and is not in keeping with the development of other properties adjoining or in the vicinity of said property. From the foregoing, it is concluded that the Conditional. Use Permit should not be granted to applicant Adrienne E. Burke, and the granting of said permit would be inconsistent with the purposes and objectives of Ordinance No. 33 as amended as said purposes are set forth in Section 1.01 of said Ordinance and would be contrary and undesirable to the convenience and general welfare of the public.
