FINDINGS AND REPORT
The application of Mr. William Lennartz, Lot 70B-2-MS, Mis-
cellaneous Tract, for a Variance of Side Yard Requirements under ARTICLE
III, Section 3.07 of Ordinance No. 33 came on for hearing on the 19th
day of February, 1980 in the Council Chambers of the Administration
Building, 2 Portuguese Bend Road, Rolling Hills, California, and the
applicant, having submitted evidence in support -of the application,'the
Planning Commission, being advised, now makes its Findings and Report as
required by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant Mr. William Lennartz,
is the owner of that certain real property described as Lot 70B-2-MS
located at 63 Crest Road East in the City of Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the
City of Rolling Hills, California. The Commission finds, further, that
no comment, written or verbal, was received in favor of or in opposition
to the request.
II.
The Commission finds that the applicant has requested a variance
of side yard requirements for construction of a pool, spa, deck and guest
house/recreation building in the side yard of his property, which
consists of more than six acres, and in order to build the recreation
building to the maximum size permitted by building regulations, and to
separate the proposed swimming pool from an existing tennis court on
the property, it would be necessary to build into the required ten foot
side yard setback. The Commission finds that in order to conform with
the regulations regarding side yards it would be necessary to reduce
the recreation building from 800 square feet to 570 square feet, and

The Commission•ids that the applicant has requested a variance
of side yard requirements for construction of a pool, spa, deck and guest
house/recreation buildi,,n.g„in the side yard of. his property, which
consists of more than six acres, and in order to build the recreation
building to the maximum size permitted by building regulations, and to
separate the proposed swimming pool from an existing tennis court on
the property, it would be necessary to build into the required ten foot
side yard setback. The Commission finds that in order to conform with
the regulations regarding side yards it would be necessary to reduce
the recreation building from 800 square feet to 570 square feet, and

to eliminate the deck between the swimming pool and tennis court, and
build the pool adjacent to the tennis court. The Commission finds that
hardship has not been demonstrated, since the property is large and it
is possible to build the requested improvements in a legal location.
The Commission finds that a side yard variance should not be granted in
order to preserve substantial property rights in the same vicinity and
zone, and that the granting of such variance would be materially detri-
mental to the public welfare and injurious to property in the same
vicinity and zone.
III.
From the foregoing it is concluded that a variance of side
yard requirements should not be granted to Mr. William Lennartz,
Lot 70B-2-MS for construction of a pool, spa, deck and guest house in
the side yard of his property, and it is, therefore, so ordered.
The applicant is further advised that the time within which
to seek judicial review of the action of the Planning Commission is
governed by Section 1094.6 of the Code of Civil Proceedings of the
State of California.
