FINDINGS AND REPORT
The application of Mr. William Lennartz, Lot 70B-2-MS,
Miscellaneous Tract, for a conditional use permit under ARTICLE III,
Section 3.06, Front Yard Requirements, and ARTICLE V, Section 5.06,
Extension of Non -conforming Building, Ordinance No. 33, came on for
hearing on the 17th day of January 1978 in the Council Chambers of
the Administration Building, 2 Portuguese Bend Road, Rolling Hills,
California, and the applicant, having submitted evidence in support
of the application, the Planning Commission, being advised, now makes
its Findings and Report as required by the Ordinances of the City of
Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. William Lennartz
is the owner of that certain real property described as Lot 70B-2-MS,
located at 63 Crest Road East in the City of :Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California. The Commission finds, further,
that no comment, written or verbal, was received in favor of or in
opposition to the request.
II.
The Commission finds that the applicant has requested a
conditional use permit for a residence addition which would encroach
into the front yard set back. The Commission finds further that plans
on file with the Rolling Hills Community Association indicated that
the residence was 45 feet from the front easement line and it was
assumed that the 15 foot addition would observe the required 30 foot
front yard setback. A subsequent survey determined that the plan was
incorrect, and the existing residence is within the required set back

and the proposed addition would extend to the easement line, but would
be 36 feet from the right of way of Crest Road, and exceeds most set
backs. Further, the Commission finds that the road elevation in the
area of the proposed addition is in excess of 115 feet and the floor
elevation is approximately 108 feet, so the addition would not be highly
visible from the road, since there is landscaping between the existing
residence and the Road. The Commission finds that a conditional use
permit should be granted in order to preserve substantial property
rights possessed by other property in the same vicinity and zone, and
that the granting of such conditional use permit would not be materially
detrimental to the public welfare, nor injurious to property in the same
vicinity and zone.

From the foregoing it is concluded that a conditional use
permit should be granted to Mr. William Lennartz, Lot 70B-2-MS, 63 Crest
Road East under ARTICLE III, Section 3.06, Front Yard Requirements, and
ARTICLE V, Section 5.06, Extension of Non -Conforming Building, Ordi-
nance No. 33 for construction of a residence addition which would i
extend to the front easement line, but would be 36 feet from the road
right of way, and it is, therefore, so ordered.
