FINDINGS AND REPORT
The application of Dr. Richard Oas, Lot 119-RH, Rolling Hills
Tract, for a conditional use permit under ARTICLE III, Section 3.06,
Front Yard Requirements, Ordinance No. 33 for construction of a swimming
pool in the front yard at 40 Portuguese Bend Road came on for hearing on
the 20th day of April, 1976 in the Council Chambers of the Administra-
tion Building, 2 Portuguese Bend Road, Rolling Hills, California, and
the applicant, having submitted evidence in support of the application,
the Planning Commission, being advised, now makes its Findings and Report
as required by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Dr. Richard Oas, is
the owner of that certain real property described as Lot 119-RH, Rolling
Hills Tract, located in the City of Rolling Hills, California, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the
City of Rolling Hills, California. The Commission finds further that no
communication, written or oral, had been received in opposition to the
request, and that Mrs. Donna Scarritt, 42 Portuguese Bend Road, wrote to
state that she had no objection to the request.

The Commission further finds that the applicant requests a
conditional use permit for construction of a swimming pool in the front
yard of his property, and has advised the Commission that the house is
set back 275 feet from the road, and properties on either side are in
excess of five acres, and the pool would not obstruct any views or be
directly visible from the road, and the applicant advised the Commission
that future residence additions may completely surround the pool.

The Commission finds that a conditional use permit should be
granted in order to preserve substantial property rights possessed by

other property in the same vicinity, and that in granting such permit, the
condition be attached that no structure over 30" in height be permitted,
thereby eliminating a slide which would be visible from Portuguese Bend
Road, but permitting a diving board, and that the granting of such con-
ditional use permit would not be materially detrimental to the public
welfare nor injurious to property in the same vicinity and zone.
IV.
From the foregoing it is concluded that a conditional use
permit should be granted under Article III, Section 3.06, Front Yard
Requirements for construction of a swimming pool in the front yard, with
no construction exceeding 30" in height to Dr. Richard 0as, Lot 119-RH,
and it is, therefore, so ordered.
