0n April 20, 1976 your Conditional Use Permit for a
swimming pool in your front yard was approved by the Planning
Couuuission. The Conditional Use Permit was approved on the
condition that 'no structure over 30" in height be permitted',
therefore eliminating a slide that would be visible from
Portuguese Bend Road, but permitting a diving board. It has
been reported to us by our engineering inspector you, in fact,
have a filter 44" high and a heater approximately 7' from the
deck level. Both of these are in violation of the Conditional
Use Permit.
If it was necessary to have a structure higher than that
allowed by the Planning Commission, it was incumbent upon you,
to come back to them for a modification of your Conditional Use,.
Permit. They were most adamant about this condition and have
mentioned your existing violation to the staff on several
occasions. We in turn discussed it with you, resulting in no
change. The Planning Commission is asking for your immediate
cooperation in correcting the problem.
The next meeting of the Planning Commission is on
November 16, 1976, and you may request permission to be.on
the agenda. If you do not do so the Planning Commission will
turn the matter over for further action to the City Council
and the City Attorney. --
