We are requesting the expansion of an outdoor living area, a partially covered patio, and converting it into a breakfast nook area to serve our existing kitchen. The patio area extends into a recently imposed setback area which requires a variance for any activity within. Although we do not feel that a variance is necessary, it has been ruled so by the city officials and we are undertaking the appropriate procedure. A. Essentially, the patio was built with the existing structure, has in place concrete for a floor and walls and a trellis roof, It is separated from the living area by a sliding glass door. The pro- posed project will put a roof in place with skylights, walls with windows, bring the floor to match the house, and remove the sliding glass door and other window between the kitchen and the patio. This patio will then become an enclosed sunny nook which will provide us with an opportunity to use it year round rather than only in the summertime. The plot plan will show the portion of this existing patio projecting into the equestrian and building setback imposed by the city. Therefore, the variance is requested. b. We feel that the setback imposed creates an extraordinary and unusual circumstance. It was never the intent of the constructors of the house to violate the setbacks for sideyards at all. How- ever, the increased setback brought. in a position of not being able to thoroughly enjoy our lot as constructed without requesting a variance. This creates an unusual circumstance. Further, based on the minimum sizes for useful rooms in the configuration of our building, it would be impossible for us to construct a nook of reasonable size in close proximity to the kitchen without vio- lating the setback - again, an extraordinary circumstance. We feel that failure to approve this particular variance would deny us a substantial property right enjoyed by others in similar vicinity and zone. We have an inordinate amount of setback in relation to the total amount of our lot, and our existing building was structured very close to the setback initially. Therefore, we feel that denial of the variance denies us of a substantial property right enjoyed by others. C. We do not feel that the construction of the nook will be detrimental to the general public welfare. Indeed, it represents an improvement to our property and, therefore, should enhance the neighborhood and its values. Further, the design of the nook surfaces will be in conformance with the building and in a very short time it will look like it was an integral part of the building since its original construction. The particular improvement in question will undoubtedly enhance the value for the property, provide more livability within the house, and generally improve the property value and the area concerned. The variance requested does not represent a change in use and, therefore, has no effect on the general plan for that area. We trust that you will be sympathetic to our views, grant us this variance to enhance our property, and provide us with extended livability in this fine city. Thanks very much.
