A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROLLING HILLS APPROVING A CONDITIONAL
USE PERMIT FOR A CONVERSION OF A PORTION OF A
STABLE INTO A RECREATION ROOM IN ZONING CASE NO. 413
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Dr. David
Cannom with respect to real property located at 19 Eastfield Drive,
Rolling Hills (Lot 50-EH) requesting a conditional use permit for
conversion and addition of a portion of an existing stable into a
recreation room on said property.
Section 2. The Planning Commission conducted a duly
noticed, public hearing to consider the application on December 12,
1989 and January 16, 1990 and conducted field site review on January
6, 1990.
Section 3. Section 17.16.012(F) of the Municipal Code
requires a conditional use permit to permit a detached recreation
room on the same lot as a primary residence provided that no kitchen
or cooking facilities are included.
Section 4. The Planning Commission makes the following
findings:
A. The proposed recreation room complies with
the requirements of the Zoning Ordinance because the proposed
recreation room will be a part of an existing structure that requires
no further grading and complies with setback requirements. A
58-square foot addition to the 250-square foot area of the stable to
be converted to the recreation room will be permitted since the
additional square footage will be displaced by, the removal of gazebo
structure so as not to increase the existing lot coverage total.
B. The proposed recreation room is compatible
with the site and with the surrounding uses because the proposed
recreation room is incorporated within an existing structure that
complies with the required setbacks and, will not cause the total lot
coverage of all structures on the site to exceed that which currently
exists.
C. The proposed project is not detrimental to
the public health, safety and welfare because the project requires no
grading.
D. The development plan for the project
indicates the ability to provide horse keeping capability on the site
by adherence to certain conditions attached hereto.
Section 5. Based on the foregoing findings, the Planning
Commission hereby approves the conditional use permit in Case No. 413
to allow for the conversion of a portion of an existing stable into a
recreation room and the addition of 58-square feet to such recreation
room and subject to the following conditions:
A. This Conditional Use Permit shall expire
unless used within one year from the date of the Permit is granted.
B. If any provision of this Conditional Use
Permit is held or declared to be invalid, the permit shall be void
and the privileges granted thereunder shall lapse.
C. It is declared and made a condition of the
Permit that if any conditions thereof are violated, or in any law,
statute or ordinance is violated, the permit shall be suspended and
the privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation and
has failed to do so for a period of thirty (30) days.
D. All requirements of the Zoning Ordinance and
of the zone in which the subject property is located must be complied
with unless otherwise set forth in the Permit, or shown otherwise on
the approved development plan.
E. The Lot shall be maintained in substantial
conformance with the site plan on file marked Exhibit A except as
otherwise provided in these conditions.
F. Occupancy of the recreation room, stable and
groom's quarters are prohibited. The groom's quarters shall be used
for clean-up purposes in conjunction with the stable. Sleeping
quarters are not permitted in the recreation room, stable and groom's
quarters.
G. Renting, leasing or any commercial use of the
recreation room, stable, and groom's quarters is prohibited.
H. The recreation room, stable and groom's
quarters shall not have a kitchen or any cooking facilities. There
shall be no access between the recreation room and groom's
quarters/stable.
I. A vehicular access to the stable must be
clearly delineated on the Development Plan attached hereto as Exhibit
A.
J. The removal of a 64-square foot gazebo and
138-square feet of paved area shall be completed as part of this
approval and prior to the issuance of a building permit for the
project.
K. The applicant shall submit a plan to include
additional landscaping to screen the existing tennis court.
L. The project must be reviewed and approved by
the Rolling Hills Community Association Architectural
Review Committee prior to the issuance of any building permit for the
proposed recreation room.
M. Applicant shall execute an affidavit of
acceptance of all conditions pursuant to Section 17.32.087 or this
Permit shall not be effective.
