SUBJECT: Zoning Case No. 324, Request for Variance
The following conditions are recommended, should the
Planning Commission approve a request by Mr. John Lyons for a
Variance of Front Setback Requirements for conversion of an
existing patio:. to a breakfast nook on his home on Lot 49-EF,
located at 21 Eastfield Drive:
1. This Variance shall not be effective for any purpose until
the owner of the property or his duly authorized represent-
ative has filed with the City Clerk of the City of Rolling
Hills an affidavit stating that he is aware of and agrees
to comply with all conditions of the approval.
2. It is declared to be the intent of the Planning Commission
that if any provision of the approval is held Or declared
to be invalid, the Variance shall be void and the privileges
granted thereunder shall lapse.
It is declared and made a condition of the approval that if
any conditions thereof are violated, or if any law, statute
or ordinance is violated, the Variance shall be suspended
and the privileges granted thereunder shall lapse; provided
that the applicant has been given written notice to cease
such violation and has failed to do so for a period of (30)
thirty days.
All construction shall be completed prior to February 1, 1988.
5. An elevation of the proposed addition shall be submitted for
review by the City Manager.
6. The Planning Commission may, at its discretion, attach such
other conditions as it deems appropriate to the property.
