It has come to the attention of the Planning Department that the
required screening for the tennis court approved by the Planning
Commission on November 20, 1973 (attached) is not in compliance.
When the Planning Commission approved the Conditional Use Permit
for a tennis court. screening of the court with mature landscaping
was required. And, as you know, the Conditional Use Permit goes
with the land.
Section 17.16.012.E of the Rolling Hills Municipal Code allows a
Conditional Use Permit to be granted under certain conditions.
And, Section 17.32.120 of the Code states that after a public
hearing, the Planning Commission may revoke or modify any Variance
or Permit issued on any one of the following grounds:
"A.
That the approval was obtained by fraud;
"B. That the permit or variance granted is being or recently
has been exercised contrary to the terms or conditions of such
approval or in violation of any statute, ordinance, law or
regulation;
"C. That the use for which the approval was granted is so
exercised as to be detrimental to the public health or safety, or
so as to constitute a nuisance. Ord. 188 (part), 1981:
Ord.33,SS6.12, 1960."
You are formally requested to provide 2 sets of landscaping plans,
a cost estimate and a bond that complies with the Resolution at
once and to contact this office within the next twenty days.
If we do not receive a response from you within that period, we
have no alternative but to arrange a public hearing before the
Planning Commission to revoke or modify your Conditional Use
Permit.

FINDINGS AND REPORT
The application of Dr. Michael Barnett, Lot 50-EF, Eastfield
Tract, for a conditional use permit under Section 3.06, Front Yard
Requirements and Section 3.07, Side Yard Requirements, Article III,
Ordinance No. 33 for construction of a tennis court came on for
hearing on the 20th day of November, 1973 in the Council Chambers
of the Administration Building, 2 Portuguese Bend Road, Rolling
Hills, California, and the applicant, having submitted evidence in
support of the application, the Planning Commission, being advised,
now makes its Findings and Report as required by the Ordinances of
the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Dr. Michael Barnett,
is the owner of that certain real property described as Lot 50-EF,
Eastfield Tract, located in the City of Rolling Hills, .alifornia,
and that notice of the public hearing in connection with said
application was given as required by Sections 8.06 and 8.07 of
Ordinance No. 33 of the City of Rolling Hills, California.
II.
The Commission finds, further, that no communication, written
or oral, had been received in opposition to the request, and that a
civil engineer employed by Dr. Barnett stated that the proposed
location is the only logical site for the tennis court to preserve
an existing three rail fence and to eliminate the necessity of
cutting into the house pad.
III.
The Commission further finds that because of the wedge shape
of the property there is no hidden back or side, and Eastfield Drive
borders two sides of the property. The applicant has advised the
Commission that a horse corral is presently located in the area where
he wishes to build a tennis court, there will be no lights, and the
area is fairly well screened from Eastfield Drive, and a landscape
plan is being prepared for the property. The Commission finds, further,
that there are other tennis courts in the area; at least one required
similar conditional use permits, and conditional use permits for
construction in the side and front yards should be granted in order
to preserve substantial property rights possessed by other property
in the same vicinity and zone.
IV.
From the foregoing it is concluded that a variance of Side Yard
Requirements under Article III, Sections 3.06 and 3.07 of Ordinance
No. 33 should be granted by the Planning Commission of the City of
Rolling Hills to Dr. Michael Barnett, Lot 50-EF, Eastfield Tract,
in accordance with the plot plan marked Exhibit I on file in these
proceedings, and it is, therefore, so ordered.

CONDITIONS OF APPROVAL - TENNIS COURTS
•
While a complete list of conditions cannot be recommended until a
public hearing has been held and all testimony taken, the following
list of conditions pertaining to tennis courts is provided:
1. This Conditional Use Permit shall not be effective for any
purpose until the owner of the property involved, or his duly
authorized representative, has filed with the City Clerk of the
City of Rolling Hills an affidavit stating that he is aware of
and agrees to comply with all the conditions of the Permit.
2. It is declared to be the intent of the Planning Commission that
if any provision of the Permit is held or declared to be invalid,
the permit shall be void and the privileges granted thereunder
shall lapse.
3. It is declared and made a condition of the Permit that if any
conditions thereof are violated, or if any law, statute or
ordinance is violated, the Permit shall be suspended and the
privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation
and has failed to do so for a period of thirty (30) days.
4. All requirements of the Zoning Ordinance and of the sone in
which the subject property is located must be complied with un-
less otherwise set forth in the Permit, or shown otherwise on
an approved plan.
The property shall be developed and maintained in substantial
conformance with the site plan on file marked Exhibit "A"
except as otherwise provided herein.
6. Tennis court fences shall be a maximum of eight(8) feet in
height above the surface level of the court.
All new slopes shall be landscaped with ground cover and trees
to screen
A landscape plan and irrigation system shall be submitted to
the Planning Commission for review and approval.
9. All proposed walls shall be a uniform earthen color. The color
and material shall be approved by the Planning Commission.
10. A bond shall be deposited with the City, to be held until
eighteen months after completion, to guarantee the satisfactory
growth .nd maintenance of the required landscaping.
11. All landscaping shall be planted and the irrigation system shall
be installed concurrent with completion of the tennis court.
12. Tennis court fence shall be black or dark green vinyl coated
chain link.

13. Additional offstreet parking may required.
14. Prior to issuance of building permits a grading plan satisfactory
to the City Engineer shall be submitted.
This Conditional Use Permit shall expire unless used within one year
from the date of grant.
15. The Planning Commission may, at its discretion, attach such
other conditions as it deems appropriate to the property.

This is to inform you that the City Council, at their meeting on
February 12, 1990, voted to ratify the Planning Commission's approval
of the above referenced planning/zoning case application.
Pursuant to Section 17.32.087, Ordinance No. 207, an Affidavit of
Acceptance form must be executed before the above approval becomes
effective. A copy of the Resolution of Approval, specifying
conditions of approval set forth by the Planning Commission, is
enclosed for your information. Once you have reviewed the Resolution
of Approval, please complete the enclosed Affidavit of Acceptance
form, have the signature(s) notarized, and forward the Affidavit to
the Office of the County Recorder, Room 15, 227 North Broadway, Los
Angeles, CA 90012, with a check in the amount of $7.00. When the
Affidavit of Acceptance has been returned to the City, duly executed
and recorded, the Los Angeles County Department of Building and Safety
will be notified that a permit can be issued.

Dear Mr. Roberts and members of the Planning Commission,
We are presently seeking approval of
the Planning Commission for changes in the barn at our
new home at 19 Eastfield Drive. Such changes will allow
us to use an area, currently set up as a workshop, for a
study.
It is our understanding that while viewing the site of
our proposed work, the Planning Commission expressed concern
regarding the visibility of the tennis court from the road.
This concern dates at ]east from the time the previous owner
cleared the landscaping from the court snveral years ago. We
share your desire that the court bo as unobtrusive as
possible. To that end, we are willing to allow existing
plants to continue to grow in order to screen thecourt.
Because the court is so close to Eastfield Drive, we are
concerned that lowering the fence below the regulation 12
fect, will ^l}n* halls to excape, creating a hazard to
traffic on that busy road.
It is our desire to accomplish our project in the barn
as expeditiously as possible, It is also our desire to work
with you to have our tennis court shielded from view on East -
field Drive without altering the existing fencing. We very
much appreciate your cooperation in this matter and look
forward to working with you.
