A RESOLUTION OF THE PLANNING 'COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING APPROVAL FOR A VARIANCE TO
CONSTRUCT AN OUTDOOR KITCHEN, BARBEQUE, WALL,
UNCOVERED PATIO AND POOL EQUIPMENT AREA WHICH
WOULD ENCROACH INTO THE SIDE AND FRONT SETBACKS AND
TO EXCEED THE MAXIMUM PERMITTED DISTURBANCE OF THE
LOT, ON A PROPERTY DEVELOPED WITH A SINGLE FAMILY
RESIDENCE AND ACCESSORY STRUCTURES IN ZONING CASE NO.
809, AT 11 OUTRIDER ROAD, (LOT 93-A-EF), (MOUSSALLI). THE
PROJECT HAS BEEN DETERMINED TO BE EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. and Mrs. George Moussalli with
respect to real property located at 11 Outrider Road, Rolling Hills (Lot 93-A-EF)
requesting a Variance to construct a 190 square foot outdoor kitchen including a pizza
oven and fire place, 5' high wall behind the kitchen, encroach 10 feet with a patio into
the side yard setback and construct an 80 square foot pool equipment area in the side
and front yard setbacks and a Variance to exceed the currently disturbed lot area by
0.1%.
Section 2. Records show that the residence was constructed in 1957 and the
swimming pool in 1958. In 1998 a 981 square foot addition to the house was
constructed. The swimming pool and spa were constructed, with building permits, in
the front yard area of the lot, partially in the side setback, and are legal non -conforming.
A pool equipment area is currently located close to the residence, in the side yard
setback. The proposal calls for relocating the pool equipment towards the front of the
pool, in the front yard area of the lot. The pool equipment will be tucked into the slope.
An over-the-counter approval was granted to reconstruct the pool and spa, within the
existing footprint and configuration, to resurface the driveway, to continue a maximum
3' high wall along the driveway, to construct a fire pit and to enlarge the side patio.
Pursuant to Section 17.24.020 of the Zoning Ordinance legally constructed non-
conforming structures may be maintained and repaired. In addition, pursuant to
Section 17.16.140, an uncovered patio may project into the side yard setback up to 6 feet.
Such patio shall not extend above the floor level of the building or the surface of the
ground. Not to exceed 3' walls are allowed along a driveway.
Section 3. The Planning Commission conducted duly noticed public hearings
to consider the application at a field trip visit and at their regular meeting on November

SUBJECT: ZONING CASE NO. 809, Request for a Variance.
Dear Mr. and Mrs. Moussalli:
This letter shall serve to notify you that the Planning Commission at their
meeting on November 15, 2011, directed staff to prepare a Resolution, with
conditions, to approve your request in Zoning Case No. 809. The Commission
will review, deliberate and vote on this resolution at their December 20, 2011
meeting. The meeting starts at 6:30 PM.
The Planning Commission requested that the pool equipment area be buried in
the slope and not exposed, that it be insulated and heavily landscaped. They
requested that you provide an accurate and current site plan depicting all of the
proposed improvements, including those previously approved over-the-counter,
and showing the proposed areas of landscaping and the fountain at the driveway
turn around. In addition, please reconfigure and include on the plan a minimum
1,000 square foot area for the future stable and corral. The County Health Code
requires that any stable and corral area be located no less than 35 feet to a
residential use. The current plan does not meet this requirement. Also provide
information on how you plan to insulate the pool equipment area.
Please submit 7 sets of revised plans by December 13, so that they may be
included in the Commissioners' information packet for the December 20 meeting.
The, resolution with findings and conditions of approval will be forwarded to
you and your representative on Friday, December 16, 2011. Please review the
conditions of approval, as they will be eventually recorded on your property.
The Planning Commission decision shall become effective thirty days after the
adoption of the resolution unless an appeal has been filed by you, any interested
party or the City Council takes jurisdiction of the case within that thirty (30) day
appeal period. (Section 17.54.010 of the Rolling Hills Municipal Code). Should
there be an appeal, the Commission's decision will be stayed until the Council
completes its proceedings in accordance with the provisions of the Municipal
Code.

Justification for Variance
Dear Ms. Schwartz,
My Clients, Mr. & Mrs. Moussalli (owners of the above mentioned property), are
requesting a variance to construct a 50 s.f. pool equipment enclosure.
The Owners meet all requirements of the City of Rolling Hills planning department with
the exception of a pre-existing legal non -conforming Total Disturbed Lot Area 21,550 s.f.
or 54% of the net lot area (39,920 s.f.).
The Owners are requesting a variance to add 50 s.f. of disturbed area for a proposed Total
Disturbed Area of 21,600 s.f. or 54.1 % of the net lot area. This addition will result in an
increase of Disturbed Area approximately 0.1 percent. The total earthwork involved is
approximately 2.5 cubic yards.
Justification for the variance is the increase in total Disturbed Area is negligible (50 s.f.)
and will not be significantly noticeable to neighboring property owners.
Also, please note that an area reserved for a future corral and stable are currently within
our existing calculated disturbed (graded) area and is not expected to increase it
substantially should new Owner decide to build a corral and stable. The current Owners
will not be constructing a corral or stable now or in the future.

SILHOLTETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week °receding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes shouldbe constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/z - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
