THE CONDITION OF THIS OBLIGATION IS SUCH THAT, the
-Principal, along with his or its heirs, executors,
administrators, successors or assigns, shall abide by and well
and truly keep and perform all of the obligations of the
Landscaping Condition along with any alterations thereto, made as
therein provided, all within the time specified therein and in
all respects according to their true intent and meaning. Until
satisfaction of the Landscaping Condition as specified therein,
this bond shall remain in full force and effect. Upon
satisfaction of the landscaping condition as specified therein,
the obligations of this bond shall become null and void.
FURTHER, the Surety, for value received, hereby stipulates
and agrees that no change, extension of time, alteration or
modification of the Landscaping Condition, or of the work to be
performed thereunder, shall in any way affect the obligation_of
this bond, and the Surety does hereby waive notice of any such
change, extension of time, alteration or modification of the
Landscaping Condition or of the work to be performed thereunder.
FURTHER, the Surety, for value received, hereby stipulates
and agrees that the City of Rolling Hills, California may, in the
event of a breach of the Landscaping Condition, may proceed
against the Surety prior to proceeding against the Principal
without exonerating the Surety. The Surety therefore agrees to
waive the provisions of California Civil Code Section 2845.
FURTHER, the Surety expressly agrees as follows:
(a) If the Principal fails to complete any work
required by the Landscape Condition within the time specified
therein, that the City may, upon written notice to the Principal,
determine that said work or any part thereof is uncompleted, and
may cause to be forfeited to the City such portion of this
obligation as may be necessary to complete such work.
(b) If the Principal shall fail to complete one or more
of the requirements of the Landscaping Condition within the
specified time, the City shall not -be required to declare a
forfeiture of this obligation or to prosecute an action under
this bond as to all actions under this bond or as to any one or
more of the remaining uncompleted requirements, even though the
City knows or has reason to know, at the time of the initial
forfeiture and prosecution for actions, that other requirements
had not been completed within the time specified for completion.
FURTHER, As part of the obligation secured hereby and in
addition to the face amount specified therefore, the Surety shall
pay all reasonable costs, expenses and fees, including
reasonable attorney's fees, incurred by City in successfully
enforcing this obligation, in an amount to be fixed by the court.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A VARIANCE TO DEVELOP A DRIVEWAY
IN THE SIDE YARD SETBACK EXCEEDING THE 20% YARD COVERAGE
REQUIREMENT, GRANTING A VARIANCE TO ENCROACH INTO THE
FRONT YARD SETBACK TO CONSTRUCT A RETAINING WALL, AND
GRANTING A VARIANCE TO ENCROACH WITHIN THE SIDE YARD
SETBACK TO CONSTRUCT A RETAINING WALL IN ZONING CASE NO. 434.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. John Rich
with respect to real property located at 20 Outrider Road, Rolling
Hills (Lots 78-EF and 95-B-EF) requesting: (1) a Variance to
develop a driveway in the side yard setback exceeding the 20% yard
coverage requirement by 56.7%, totalling 76.7% to construct a 6,480
square foot roadway to allow ingress and egress to an adjacent
property at 24 Outrider Road (Lot 96-SK); (2) a Variance to
encroach into the front yard setback to construct a retaining wall;
and (3) a Variance to encroach within the side yard setback to
construct a retaining wall. The driveway was cut prior to the
application. Proper grading permits were approved on December 14,
1990.
Section 2. The Planning Commission conducted a duly noticed
public hearing to consider the application on June 19, 1990. The
applicant thereafter submitted an expanded request which the
Planning Commission considered at a duly noticed public hearing
held on July 17, 1990, August 21, 1990, September 18, 1990, October
16, 1990, November 20, 1990, December 18, 1990, January 15, 1991,
February 19, 1991 and March 19, 1991 and at a field trip visit on
August 4., 1990.
Section 3. Sections 17.32.010 through 17.32.030 permit
approval of a Variance from the standards and requirements of the
Zoning Ordinance when exceptional or extraordinary circumstances
applicable to the property and not applicable to other similar
properties in the same zone prevent the owner from making use of a
parcel of property to the same extent enjoyed by similar
properties. Section 17.28.022 paragraph (2) allows driveways
leading to a garage or other parking area to be permitted in a
required yard provided the driveway and parking area do not exceed
twenty percent (20%) of the area of the yard in which they are
located. With regard to this request, the Planning Commission
makes the following findings:
A. There are exceptional or extraordinary circumstances and
conditions applicable to the property and the intended use that do
not apply generally to the other property in the same vicinity and
zone. The Variance is necessary because access to the property at

24 Outrider Road can only occur across the property at 20 Outrider
Road. In order to minimize the impact on 20 Outrider Road, a
driveway has been placed in the side yard setback.
B. The Variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied the
property in question. The Variance is necessary because of the
inability of practical methods of accessing the lot at 24 Outrider
Road from Eastfield Drive.
C. The granting of the Variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity and zone in which the property is
located. The Variance will have no impact on surrounding
properties due to distances between the driveway and residences.
Section 4. Based upon the foregoing findings, the Planning
Commission hereby approves the Variance to exceed the 20% yard
coverage requirements for the construction of a driveway leading to
24 Outrider Road as indicated on the Development Plan attached
hereto as Exhibit A, subject to the conditions specified in Section
9 below.
Section 5. Section 17.28.022 requires that yards be
maintained unoccupied from the ground up of any structures. The
applicant is requesting a Variance for encroachment into the 50
foot front yard setback to construct a retaining wall in connection
with a proposed driveway leading to 24 Outrider Road. The Planning
Commission finds as follows:
A. There are exceptional or extraordinary circumstances and
conditions applicable to the property and the intended use that do
not apply generally to the other property in the same vicinity and
zone. The Variance is necessary because access to the property at
24 Outrider Road can only occur across the property at 20 Outrider
Road. In order to minimize the impact on 20 Outrider Road, a
driveway has been placed in the side yard setback.
B. The Variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied the
property in question. The Variance is necessary because of the
inability of practical methods of accessing the lot at 24 Outrider
Road from Eastfield Drive.
C. The granting of the Variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity and zone in which the property is

Section 7. The applicant is also requesting a Variance for
encroachment into the 20 foot side yard setback to construct a
retaining wall in connection with the proposed driveway leading to
24 Outrider Road. The Planning Commission finds as follows:
A. There are exceptional or extraordinary circumstances and
conditions applicable to the property and the intended use that do
not apply generally to the other property in the same vicinity and
zone. The Variance is necessary because access to the property at
24 Outrider Road can only occur across the property at 20 Outrider
Road. In order to minimize the impact on 20 Outrider Road, a
driveway has been placed in the side yard setback.
B. The Variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied the
property in question. The Variance is necessary because of the
inability of practical methods of accessing the lot at 24 Outrider
Road from Eastfield Drive.
C. The granting of the Variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity and zone in which the property is
located. The Variance will have no impact on surrounding

Section 8. Based upon the foregoing findings, the Planning
Commission hereby approves the Variance to encroach into the side
yard setback to construct a retaining wall 20 feet into the side
yard setback not to exceed 5 feet in height at any one point as
indicated on the Development Plan attached hereto as Exhibit A,
subject to the conditions specified in Section 9.
Section 9. The approvals specified in Sections 4, 6, and 8
are based upon the following conditions:
A. The Variance shall expire unless used within one year
.from the effective date of approval as defined in Section 17.32.110
of the Municipal Code.

B. It is declared and made a condition of the Variance
approvals that if any conditions are violated, the
Permit shall be suspended and the privileges granted thereunder
shall lapse, provided that the applicant has been given written
notice to cease such violation and has failed to do so for a period
of thirty (30) days.
C. All requirements of the Zoning Ordinance and of the zone
in which the subject property is located must be complied with
unless otherwise set forth in the Permit or shown otherwise on an
approved plan.
D. The retaining wall incorporated into the front and side
yard setbacks shall not be greater than five (5) feet in height at
any point along the driveway.
E. The driveway and retaining walls shall be screened and
and shielded from view with native vegetation to minimize the view
from the residence at 20 Outrider.
F. No scraping of terrain shall be permitted.
G. All slopes that are disturbed by the grading of the
driveway shall be planted with native drought -resistant vegetation.
H. The project must be reviewed and approved by the Rolling
Hills Community Association Architectural Review Committee prior to
the issuance of any building or grading permit.
I. The applicant shall execute an Affidavit of Acceptance
of all conditions of this Variance, pursuant to Section 17.32.087,
or the.approval shall not be effective.
J. All conditions of this Variance approval must be
complied with prior to the issuance of a building or grading permit
from the County of Los Angeles.

months of that time period were taken up in obtaining the required

Dear Mr. Wallace:
This addendum is submitted in response to questions raised by
the County of Los Angeles in a Geotechnical Engineering Review
Sheet dated September 13, 1989. A copy of the Review Sheet is
included herein.
Our soil engineering investigation has been conducted as a joint
project with a geologic investigation by Keith W. Ehlert, whose
report dated May 2, 1990 (Project No. 2260-89) should be
reviewed in conjunction with this addendum.
Private Sewacre Disposal
The location of the proposed private sewage disposal system,
which will probably include seepage pits, is not known. The
seepage pits should be capped such that the effluent would not
be. discharged near the slope surface nor into the proposed
fill. We recommend that the location of the proposed private
sewage disposal system be reviewed by the engineering geologist.

Since there is no near -surface ground water and the effluent
will not "daylight" on the slope below the subject area, the
effluent should have no adverse effects on the stability of the
subject site and surrounding areas.
Grading Plan
At the time of this addendum, the grading plan has not been
completed. The grading plan, when available, shall be reviewed
by us to verify that our recommendations have been incorporated
in the plan.
Proposed Grading
It should be noted that we have recommended the following:
"All existing fill soils, soil and colluvium, as well as
disturbed bedrock, exposed at the proposed grade within areas of
slabs, or within areas to receive fill, shall be removed and
wasted off -site or replaced as compacted fill."
"If the proposed house is to be supported in compacted fill, a
compacted fill blanket of no less than 6 feet thick shall be
provided in the area of the proposed house. The compacted fill
blanket shall extend a minimum of 5 feet beyond the area of the
proposed house."
"The excavated soils may be reused in the compacted fill,
provided they are cleaned of vegetation and debris. Fill
placement shall be in accordance with specifications given in
Appendix III of the referenced report."

This is to advise that the RHCA has approved a residence footprint
and driveway access to Lot 96, Eastfield Tract for Mr. & Mrs. Howard
Wallace. The access to the new home is located on an Association
easement beginning at the Outrider cul-de-sac to the Wallace lot.
To clarify, one of the many designated uses of Association easements
as defined in the Deed Restrictions, "easements are reserved for the
use and purpose of erecting, constructing, operating and maintaining
thereon: roads, streets, or bridle trails, parkways and park areas."
To expand upon the use of easements for access, Association
Regulations and Restrictions require that proper drainage and erosion
controls also be designed when road grading access is proposed.
These walls and drains are considered appurtenant to the access
usage. The "rolling hills" topography dictates, in most cases, a
necessity for retaining walls and drainage when new roads are built.
Careful aesthetic control is employed by the Architectural Committee
to provide aesthetic wall treatments that will be an asset to the
Community.
An example of the Association's involvement in exercising control of
the easements is the new driveway to the Pak residence located in the
Crest Road West easement. Although initially the property owner was
uncooperative in providing an aesthetic wall design and was
insensitive to the overall height, after much dialogue, the wall was
redesigned in a more pleasing manner.

materials will be carefully reviewed by the committee to make certain
that the design is an attractive solution and is harmonious with
neighborhood aesthetics.

This letter will serve to advise you that I represent residents of Rolling Hills, California, whose
property is adjacent to that certain property identified us 2.669 acres gross, Lot 96-SK; 24 Outrider
Road, Rolling Hills, California.
As I'm sure you're aware, a hearing is scheduled liar Tuesday, June 19,1990, at 7:30 p.m. to consider
the request for variance to exceed grading and Site Plan Review, Zoning Case Number 434, in
connection with the applicant, Mr. Howard Wallace. 'The notice indicates that he is requesting a
variance to exceed grading standards for maximum cut/fill slopes and a Site Plan Review for a
proposed new residence.
My Clients are quite concerned in that it is our understanding that the city of Rolling Hills has not
approved such an extensive grading with the requirements for import and export equal to the request
of Mr. Wallace before. It is our understanding that the city of Rolling Hills has not granted
anywhere near the variance in regard to grading standards since the Portuguese Bend landslides.
This letter shall constitute a formal request and demand on the part of the City to provide in a
simplified fashion an explanation of the specific items and work to be performed should the City
grant the variance requested by Mr. Wallace.
Further, I am informed that there has been extensive, non -permitted excavation and grading which
has already occurred on the site in violation of the approved plans of Municipal Code.
Demand is further made upon you to provide me immediately with the geological reports by the
expert whom I'm sure you've retained to make certain that the requested grading will not remove the
toe of the slope sufficient to produce any land movement or subsidence; should the variance be
granted.
Further, this correspondence shall constitute notice to you that in the event said variance is granted
and subsidence or landslide activity occurs, the adjoining property owners will look to and hold the
city of Rolling Hills responsible for any and all damages they might incur.
Please understand that it is not our intent to interfere with any vested rights maintained by Mr.
Wallace. It is rather our concern that the conduct on the property match.that or the Municipal Code

adjoining properties as a result of any activities on the subject property.

purpose of providing geologic information pertaining to the proposed
construction of a single-family dwelling on Lot 96, in the City of Rolling Hills.
Information obtained during this investigation indicates that provided the

SUBJECT: UNAUTHORIZED GRADING WORK PERFORMED AT 24 OUTRIDER ROAD, LOT
96-EF
Dear Mr. Wallace:
City and County Staff have inspected the area of construction work
undergoing at the terminus of Outrider Road. Our observations indicate
that grading work has been undertaken at the above -stated lot. Our
records indicate no such grading permit issued for said property.
Correspondingly, this letter shall serve as notification that unauthorized
grading work must cease and corrective measures must be undertaken to
resolve the violation occurred. Please contact the undersigned by
February 23, 1990 to discuss a resolution of this matter. I can be

SUBJECT: GRADING WORK PERFORMED AT 20/22 OUTRIDER ROAD
Dear Mr. Rich:
City and County Staff have inspected the property located at the
above -stated address to evaluate the grading work performed for the
project approved under Zoning Case No. 382. Staff observed that the
northwesterly easement area and extending to an abutting property, that
being 24 Outrider Road (Property owner: Wallace), has been graded
apparently to create a roadway access. This grading work was not
indicated on the grading plan submitted to the Planning Commission, and
thereby not authorized by City and County Staff. Further, any additional
structures, including walls, that may be erected to necessitate the
stabilization of earth within the required setback area would need a
variance to the Municipal Code.
Correspondingly, this letter shall serve as notification that deviation
from the approved grading plan requires corrective measures be undertaken.
Cease all further grading not indicated on the approved plans and contact
the undersigned by February 12, 1990 to discuss a resolution of this
