225, Construct a new pool in the fr, Resolutions & Approval Conditionss• BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) ) of ) ) ZONING CASE NO. 225 Dr. Larry Kelly ) ) Lot 35-FT ) FINDINGS AND REPORT The application of Dr. Larry Kelly, Lot 35-FT, Flying Triangle Tract, for a variance of front yard requirements under ARTICLE III, Section 3.06, Ordinance No. 33 came on for hearing on the 17th day of April, 1979 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as re- quired by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Dr. Larry Kelly, is the owner of that certain real property described as Lot 35-FT, located at 2 Pinto Road in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds that no comment, written or verbal, was received in opposition to the request, and that Mrs. Catherine Partridge, 69 Portuguese Bend Road, telephoned to say that she and Mr. Partridge have no objection to the request. II. The Commission finds that the applicant has requested a variance of front yard requirements for construction of a swimming pool, and has stated that because of the orientation of the residence on the property, all improvements have been located in the front yard, and the only other location which could accommodate s swimming pool would be over the septic tank, and would eliminate the children's play area. The Commission finds that a conditional use permit should be granted in order to preserve substantial property rights in the same vicinity and zone, and that the granting of such variance would not be materially detrimental to the public welfare, nor injurious • • to property in the same vicinity and zone. III. From the foregoing it is concluded that a variance of front yard requirements should be granted to Dr. Larry Kelly, Lot 35-FT, 2 Pinto Road, under Article III, Section 3.06, Ordinance No. 33, for construction of a swimming pool in the front yard, subject to the requiremetns that no structures more than 42" high be permitted; that the pool area be landscaped; and that the raw earth be replanted within 60 days after construction of the pool, and it is, therefore, so ordered.
