Thank you for meeting me at your property on June 27, 2103. The purpose of my
visit was to ascertain whether the landscaping to screen the tennis court meet the
intent of the Resolution of approval and whether the planning department
conditions have been adequately met to final the project. I found that although
currently the newly planted landscaping to screen the tennis court is scarce, you
assured me that in two years it would grow significantly.
Additionally, in accordance with Resolution No. 2011-07, the monetary security
deposit you posted with the City for $2,968 will be retained with the City for not
less than two years after landscape installation. The retained deposit will be
released by the City after the City Manager/Planning Director determines that
the landscaping was installed pursuant to the intent of the conditions of approval
and landscaping plan as approved, that such landscaping is properly established
and in good condition and screens the tennis court. Please keep accurate records
of when planting was installed.
Should it be determined after two years after planting that the tennis court is not
adequately screened and/or the landscaping for screening or of graded areas is
inadequate or not properly established, it will be required that you supplement
the planting and the security deposit will be kept for another two years.
Depending on the state of the landscaping at that time, it may be required that
you also supplement the amount of the security deposit.
Given the above, this project may now be finaled from the Planning conditions
perspective. However, any outstanding issues by other agencies, such as the LA
County Building and Safety must be taken care of prior to finaling the project.

RESIDENCE IN ZONING CASE NO. 801, AT 16 PINE TREE LANE (LOT 81-1-

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES

Section 1. An application was duly filed by Dr. and Mrs. Juma Bharadia
with respect to real property located at 16 Pine Tree Lane (Lot 81-1-RH), Rolling
Hills, CA requesting a Site Plan Review and Conditional Use Permit for grading and
construction of a 6,502 square foot sports court and Variances for exceeding the
maximum permitted quantities of grading and the surface area of grading for sports
courts. The applicants also propose a 762 square foot addition to their residence, a
portion of which, (145 square feet), would encroach 8 feet into the required side yard
setback, which requires a variance. Portion of the existing residence encroaches into
the side setback. A 975 square foot basement is also proposed.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the application on March 15, April 21, May 17 and at a field trip
on April 21, 2011. The applicants were notified of the public hearings in writing by
first class mail. Evidence was heard and presented from all persons interested in
affecting said proposal and from members of the City staff and the Planning
Commission having reviewed, analyzed and studied said proposal. The applicants'
representative was in attendance at the hearings. An inquiry and a letter were
received from adjacent property owners, who were also present at the field trip.
Section 3. The Planning Commission finds that the project qualifies as a
Class 3 Exemption (The State of CA Guidelines, Section 15303) and is therefore
categorically exempt from environmental review under the California
Environmental Quality Act.
Section 4. Section 17.46.030 requires a development plan to be submitted
for Site Plan Review and approval before any grading requiring a grading permit or

On May 17, 2011, the Planning Commission adopted a resolution, with conditions, granting
your request for a CUP and Variance Zoning Case No. 801. That action, accompanied by the

I am requesting that the project site at #16 be fenced and that parking be
provided by the owner.
We are all familiar with the fire code as it relates to the cul de sac.lt is a non
parking area. My private properties are adjacent to the construction area
and I would like the Planning Commission to consider my private property
rights and to direct the owner to provide parking for his project. all cars,
trucks, grader et all off my properties.
I am concerned about the excess grading and the use of set backs for his
project. The house is in the set back and at that time an exception was
made. With the set back uses that are being proposed this property
established a precedent for all the future development in our city and
especially on Pine Tree Lane.
In addition I am concerned about the drainage culvert that is constructed on
this property. It runs hard scape waters off the property and across the
property line to the neighboring #18. There is no design on this culvert for
dispersing the run off, the water shoots directly off the culvert and will cause
further erosion. This is not an Association issue as they have said so. It is
the city and or Fish and Game. Although the process is used to drain the
parking lot located at #16 the water is carried on to #18 and dumped quickly
following the canyon north.
I would like to be kept up to date on the plan for the access for this tennis
construction. I have concerns about the natural growth
Within the easement and it appears the access is over the easement.

It has come to the City's attention that the addition to the residence approved a while
back has not commenced. As you know, since the time the project was approved by City
staff, the side setback on your property has changed due to the acceptance by the
RHCA of the roadway easement. A portion of the proposed addition would now be
located in the setback, which requires permission from the Planning Commission and
the City Council via a Variance process. This can be processed concurrently with your
tennis court application and there is no additional fee from the City.
Please stake the addition to the residence for the April 21 st field trip, so that the
Planning Commission may consider the request.

• Stake the addition and limits of encroachment
• Erect the silhouette showing the roof ridge
• Show the eave overhang

SILHOUETTE CONSTRUCTION GUIDELINES

A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

ZONING CASE NO. 801 Request for a SPR, CUP and a VR for tennis court
Dear Dr. and Mrs. Bharadia:
Pursuant to state law the City's staff has completed a preliminary review of the
application noted above and finds that the information submitted is:
X Sufficiently complete as of the date indicated above to allow the application to be
processed.
However, a landscaping plan showing type of plants that would screen the court on all
four sides, as required by the Zoning Code, must be submitted prior to the Planning
Commission field visit to the property. It is anticipated that the field visit will take place in
mid -April.
Please note that the City may require further information in order to clarify, amplify,
correct, or otherwise supplement the application. If the City requires such additional
information, it is strongly suggested that you supply that information promptly to avoid
any delay in the processing of the application. Additionally, should conditions during the
field visit reveal conditions that are not on the plan submitted by your agent, the plans
will have to be revised.
Your application for Zoning Case No. 801 has been set for public hearing consideration
before the Planning Commission at their meeting on Tuesday. March 15. 2011.
The meeting will begin at 6:30 PM in the Council Chambers, Rolling Hills City Hall
Administration Building, 2 Portuguese Bend Road, Rolling Hills. You or your designated
representative must attend to present your project and to answer questions.
The staff report for this project will be available at the City Hall after 3:00 PM on Friday,
March 11. We will forward the report to you and your representative.
