All actions of the Planning Commission authorized by this Title may be appealed to the City Council. All appeals shall be filed in writing with the City Clerk. B. All appeals must be filed on or before the 30th calendar day after adoption of the Planning Commission's resolution on the project or application. Application fees shall be paid as required by Section 1730.030 of this Title. C. Within 30 days after the Planning Commission adopts a resolution which approves or denies a development application, the City Clerk shall place the resolution as a report item on the City Council's agenda. The City Council may, by an affirmative vote of three members, take jurisdiction over the application. In the event the City Council takes jurisdiction over the application, the Planning Commission's decision will be stayed until the City Council completes its proceedings in accordance with the provisions of this Chapter. 17.54.020 Persons Authorized to File an Appeal Any person, including the City Manager, may appeal a decision of the Planning Commission to the City Council, in accordance with the terms of this Chapter. 17.54.030 Form, Content, and Deficiencies in an Appeal Application A. All appeals shall be filed in writing with the City Clerk on a form or forms provided by the City Clerk. No appeal shall be considered filed until the required appeal fee has been received by the City Clerk. B. The appeal application shall state, at a minimum, the name and address of the appellant, the project and action being appealed, and the reasons why the appellant believes that the Planning Commission erred or abused its discretion, or why the Planning Commission's decision is not support by evidence in the record. 76 ROLLING HILLS ZONING MAY 24, 1993 • 1754.030 C. If the appeal application is found to be deficient, the City Clerk shall deliver or mail (by certified mail), to the appellant a notice specifying the reasons why the appeal is deficient. The appellant shall correct the deficiency with an amendment to the appeal form within seven calendar days of receiving the deficiency notice. Otherwise, the appeal application will be deemed withdrawn, and the appeal fee will be returned to the applicant. 17.54.040 Request for Information Upon receipt of a written and complete appeal application and fee, the City Clerk shall direct the Planning Commission Secretary to transmit to the City Council the complete record of the entire proceeding before the Planning Commission. 17.54.050 Scheduling of Appeal Hearing Upon receiving an appeal, the City Clerk shall set the appeal for a hearing before the City Council to occur within 20 days of the filing of the appeal. In the event that more than one appeal is filed for the same project, the Clerk shall schedule all appeals to be heard at the same time. 17.54.060 Proceedings A. Noticing The hearing shall be noticed as required by Section 17.30.030 of this Title. In addition, the following parties shall be noticed: 1. The applicant of the proposal being appealed; 2. The appellant; and 3. Any person who provided oral testimony or written comments to the Planning Commission during or as part of the public hearing on the project. B. Hearing The City Council shall conduct a public hearing pursuant to the provisions of Chapter 17.34 of this Title. The Council shall consider all information in the record, as well as additional information presented at the appeal hearing, before taking action on the appeal. 77 ROLLING HILLS ZONING MAY 24, 1993 • • 1754.060 C. Action The Council may act to uphold, overturn, or otherwise modify the Planning Commission's original action on the proposal, or the Council may remand the application back to the Planning Commission for further review and direction. The Council shall make findings to support its decision. D. Finality of Decision The action of the City Council to approve, conditionally approve, or deny an application shall be final and conclusive. E. Record of Proceedings The decision of the City Council shall be set forth in full in a resolution or ordinance. November 17. 2003, at 4:30 PM. The site must be prepared according to the enclosed Silhouette Construction Guidelines and the following requirements: • A full-size silhouette in conformance with the attached guidelines must be prepared for the STRUCTURE of the project showing the footprints and roof ridges; • Stake (delineate) the area of the proposed future stable and corral; • Delineate/stake the location of the required front yard setback; setbacks; The silhouette shall remain on the property during the entire review process of this case, including City Council's review. Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable. Bracing should be provided where possible. Wire, twine or other suitable material should be used to delineate roof ridges and eaves. Small pieces of cloth or flags should be attached to the wire or twine to aid in the visualization of the proposed construction. The application may be delayed if inaccurate or incomplete silhouettes are constructed. The plan, as submitted, is not sufficiently accurate or complete to consider for placement before the Planning Commission. The following corrections must be made: 1. It appears that the net lot area is incorrectly calculated. I checked the Assessor's map, (lot 7567-13-11), which shows the lot at 89,908 square feet, excluding the roadway easements. The City maps show Pinto Road as having a 50-foot wide right of way and Portuguese Bend Road as having a 60-foot wide right of way. The City's requirement for calculating the net lot area is as follows: exclude the roadway easements from the gross lot area, (25 feet along Pinto Road and 30 feet along Portuguese Bend Road) and exclude additional ten feet around all nronertv lines. (See enclosed example). Assuming that the Assessor's maps are correct, the 136,353 (2.44 acres) shown by you as the net lot area seems incorrect. 2. The City's setback requirements are as follows: Front yard - 50 feet from the roadway easement (not from the property line, which in most instances in the City is in the middle of the road); Side yard — 35 feet from the property line Side yard on a lot where the side abuts a street - 25 feet from the roadway easement 3. .The residential building pad is measured from the setback lines, and does not include the areas within the setbacks, even though the areas within the setback could be flat (10% or less). Therefore, in this case, the building pad is much less than 33,513 square feet. 4. To calculate the building pad coverage, you must add the square feet of all of the structures on the lot, which in this case includes the shed, house, sports court, swimming @Printed or; F_t.yclyd • pool, the existing garage, the proposed garage and a minimum of 96 square foot area for keeping the trash, (if an area for trash already exists, show it on the plan and include in the structural coverage, as it is required to be enclosed). Whatever that total number is, it is to be divided by the residential building pad (#3 above). 5. The structural lot coverage and the total lot coverage, which included all impervious surfaces (flatwork) and structures get to be calculated against the net lot area (#1 above). For the calculation of the total structural and flatwork coverage you would need to include the concrete pad from the burnt -out stable. 6. You need to show the size and percentage of the disturbed area of the net lot. In general, the disturbed area is that area of the lot that at some point in the past was graded in order to construct the structures. So in this case the disturbed area would be the area of the building pad plus those areas outside the building pad where any impervious surfaces and structures exist (impervious surfaces and structures or parts thereof, which are located in the setback). For the disturbed area do not include the roadway easements, but include the setback areas, if they were graded or constructed upon. 7. On the sheet called "CALCULATIONS OF LOT COVERAGE" please calculate the existing and proposed development. Please revise the site plan and calculations and submit for my review, prior to formally applying. I remember providing you with all of our requirements. However, I am enclosing them with this letter together with the submittal fees and schedule. As you know, we will require the following applications and fees: a Site Plan Review for the new structure, ($1500); a Conditional Use Permit for a detached garage (structure), .($1500); Variance to locate the structure in the front yard setback ($1250); and environmental review fee — $200. A list and address labels for all property owners within 1000-foot radius is also required. Please do not hesitate to call me, should you have any questions.
