RESOLUTION NO. 90-26 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS APPROVING AN EXTENSION OF APPROVAL FOR SITE PLAN REVIEW IN ZONING CASE NO. 402 THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Mr. Dana MacKay with respect to real property located at 4 Buggy Whip Drive, Rolling Hills (Lot 244-MS) requesting an extension on site plan review approval for a proposed residential reconstruction on the site, and which had a date of expiration for the approval on September 19, 1990. Section 2. The Planning Commission conducted a duly noticed public hearing to consider the application on August 21, 1990. Section 3. Section 17.34.080 (B) provides for an extension for up to one year on a Site Plan Review approval upon application by the property owner, and that a public hearing is to be held and an approval granted in the same manner and based upon the same criteria as for the issuance of a new permit. Section 4. Pursuant to the foregoing Section, the Planning Commission makes the finding that previous findings determined with the approved Resolution No. 89-24, dated September 19, 1989, can be restated. Section 5. Based upon the foregoing Section, the Planning Commission hereby approves the extension of approval for Zoning Case No. 402 to permit a one year extension of the Site Plan Review approval to September 19, 1991. An application was duly field by Mr. Dana McKay with respect to real property located at 4 buggy Whip Drive, Rolling Hills (Lot 244-MS) requesting site plan review approval for a proposed residential redevelopment on the site. Section 2. The Planning Commission conducted a duly noticed public hearing to consider the application on June 20, 1989, July 18, 1989, and conducted a field site review on July 8, 1989. Section 3. Section 17.34.010 requires a development plan to be submitted for site plan review and approval before any building or structure may be constructed or any expansion, addition, alteration or repair to existing buildings may be made which involve changes to grading or an increase to the size of the building or structure by more than twenty-five (25%) percent in any thirty-six (36) month period. Section q. The Commission makes the following findings of fact: A. The proposed structure complies with the General Plan requirement of low profile, low density residential development with sufficient open apace between surrounding structures. The project con• forms to the Zoning Code setback and lot coverage requirements. The lot has a net square foot area of 133,163 square feet. The proposed residential structure and garage will have 9,650 square feet which constitutes approximately 7% of the lot, which is within the maximum 20% lot coverage requirement. The total lot coverage including paved areas, driveway, pool and gazebo, will be 27,050 square feet which equals 20.3% of the lot, which is within the 35% maximum structural lot coverage requirement. The proposed project is similar and compatible with neighboring development patterns. B. The proposed development preserves and integrates into the site design, to the maximum extent feasible, the natural topographic features of the lot by being constructed on the former building pad for the previously existing house. C. The grading for the project follows the natural contours of the site described in paragraph.B, above. All drainage flow from the north portion of the site will be channeled into existing drainage courses. Drainage flow from the south portion of the lot will be channeled toward the street. D. To the maximum extent possible, native vegetation will be preserved along with a substantial number of existing avocado trees on the north portion of the site. E. The project substantially preserves the natural and undeveloped state of the lot in that the reconstruction will occur primarily within the existing building pad area. F. Although the Development Plan specifies a relatively large residential structure, the project is harmonious in scale and mass for the site and in relation to neighboring residential structures. The proposed structure will be 100 feet from the nearest residence on the west side. G. The project is sensitive and not detrimental to the convenience and safety of circulation for pedestrians and vehicles in that the driveway entrance remains in its existing location. H. The project conforms to the requirements of the California Environmental Quality Act and is categorically exempt from environmental review. Section a. Based on the foregoing findings, the Commission hereby approves the site plan review application for a proposed residential project to the property located at 4 Buggy Whip Drive subject to following conditions: A. Any modifications to the project which would constitute a modification to the Development Plan as approved by the Planning Commission, shall require the filing of an application for modification of the Development Plan pursuant to Section 17.34.070 of the Rolling Hills Municipal Code. B. A landscaping plan must be submitted to the City of Rolling Hills Planning Department -staff for -2- 890911 M+ 1680035 (1) approval. The plan submitted must comply with the purpose and intent of the Site Plan Review Ordinance. The landscaping plan shall incorporate existing mature trees and native vegetation. A bond in the amount of the cost estimate for the landscaping plus 15% shall be posted and retained with the City for not less than two years after landscape installation. The retained bond will be released by the City after the City Manager deter- mines that the landscaping was installed pursuant to the landscaping plan as approved, and that such landscaping is properly established and in good condition. C. Prior to the submittal of a final grading plan to the County of Los Angeles for plan check, a detailed grading plan with related geology, soils and hydrology reports that conform to the Development Plan as approved by the Planning Commission must be submitted to the Rolling Hills Planning Department staff for their review. D. The proposed building plan must be approved by the Rolling Hills Community Association Architectural Review Committee before any grading permit is issued. E. The working drawing submitted to the County Department of Building and Safety for plan check review must conform to the Development Plan approved with the site plan review. PASSED,. B'-15 -99 This is a request for a Site Plan Review to determine the compatibility of the proposed single-family residence with the site at 4 Buggy Whip Drive, Lot 244-MS. The City Manager reported that, per the suggestions of the Planning Commission at their last meeting and during the field trip, the applicant has scaled down the size of the proposed residence. Thus, the Commission has before them, for their consideration, a revised plan. The original proposal showed a residence of approximately 10,200 square feet, which has been reduced to 6,450 square feet. The original proposed garage was approximately 2,200 square feet, and has been reduced to 1,200 square feet. Finally, the originally proposed 4,000 square foot basement has been reduced to 3,000 square feet. In essence, the applicant has reduced the exterior mass of the structures by approximately twenty-five percent, resulting in a total of approximately 9,650 square feet. Also, a previous concern of the Commission was the proximity of the proposed rear garage to the residence across the canyon (on Johns Canyon Road). The garage has been moved back ten feet such that there is now a sixty foot setback rather than a fifty foot setback. Thus, there is a separation distance of approximately one hundred feet from the rear garage to the residence on the abutting parcel. In addition,. the proposed stable has been relocated out of the side yard setback. Chairman Roberts opened the public hearing. Mr. Russ Barto, architect on the project, addressed the Commission and confirmed that the structural square footage has been reduced, such that the coverage of the building pad will be approximately forty-two percent (42%). There being no further comments, Chairman Roberts closed the public hearing. Commissioner Hankins moved approval of Zoning Case No. 402, a request for a Site Plan Review to determine the compatibility of the proposed new single-family residence with the site, based on the fact that the proposed plan, as revised, is compatible with the neighboring development patterns, and based on the standard findings and conditions for site plan approval. The motion was seconded by Commissioner. Lay. Commissioner Lay expressed his appreciation for the cooperation and effort on the part of the applicant in favorably responding to the Commission's recommendations, and attempting to develop the site in such a way that it is compatible with the General Plan and character of the community. Commissioner Hankins agreed with Commissioner Lay, and indicated that the applicant should be commended. There being no further comments, Chairman Roberts called for a vote on the motion on the floor, which carried by the following roll call vote: AYES: Commissioner Hankins, Commissioner Lay, Commissioner Raine, Chairman Roberts NOES: None ABSTAIN: Commissioner Frost Commissioner Frost indicated that he abstained since he had not participated in the field trip and had not viewed the site.
