This letter shall serve to reconfirm your verbal comments on Thursday, October 3,
1996, to withdraw the Variance for consideration of exportation of more than 500
cubic yards of soil from your project construction site at 1 Buggy Whip Drive.
Based upon your word, we had advertised for this public hearing to commence on
Saturday, October 12, 1996. Since this has been advertised in the local newspaper,
this title will appear on the Planning Commission Agenda, but the field trip public
hearing cannot be conducted for the reasons cited below.
The submitted vicinity map and address list required for the City to notify area
property owners of the public hearing pursuant to Section 17.34.030, Paragraph A,
(2), of the Rolling Hills Municipal Code was incomplete in that it did not contain all
properties within 1,000 ft. of the exterior boundaries of all of the affected properties.
In this Variance request, your property is affected because it is exporting in excess of
500 cubic yards of soil. The properties that are receiving the soil are affected, and
become part of the project, because they are receiving in excess of 500 cubic yards as
well.
The Municipal Code requires that these notices be sent to area property owners no
later than 10 days prior to the public hearing. This time frame was not able to be
met given the contents of the list provided to the City on October 2, 1996. This is
required to provide interested parties the opportunity to review the project and
express any concerns. We have enclosed these Sections of the Municipal Code for
your review.
Further, and more importantly, the project is now described as involving a portion
of an approximate 63 acre parcel of land that was not included in the advertisement
for this Variance, and possibly not involving at least one of the properties that was
included in the advertisement for this public hearing. Theentire public hearing
notice and property address list needs to be clarified in this regard.

Finally, the application was submitted without the appropriate filing fees of
$1,450.00. Your representative suggested that we bill you. You have expressed that
someone else should pay. This matter needs to be clarified and addressed if you
desire to apply for this Variance.
We will maintain on file the documents that have been submitted to date on this
matter so your representatives will not have to resubmit the necessary paperwork.
Further, we will share our existing property lists from projects in close proximity
which will greatly assist your representatives in providing an updated list of
properties within 1,000 ft. of all affected properties.
We have attempted to do everything in our power to accelerate your request.
Enclosed please find the project filing deadline dates that are applied to land use
applications requiring Planning Commission review. If you review that material, I
think you will find this to be true. However, since you have withdrawn this
application, this point is somewhat mute.
Should you wish to reapply for this Variance or modify any of the conditions of
your project, we encourage you to contact us at your earliest date so we do not
encounter any unanticipated delays.

NOTICE IS HEREBY GIVEN, that the Planning Commission of the City of Rolling
Hills will hold a Public Hearing at 7:30 AM on Saturday, October 12, 1996 at 1 Buggy
Whip Drive, Rolling Hills, CA for the purpose of receiving public input regarding
the following:
ZONING CASE NO. 547, a request for a Variance to permit more than 500 cubic
yards of soil to be exported from a construction site in the City where a single family
residence, garages, pool, tennis court, and stable have been approved for
construction for property at 1 Buggy Whip Drive, Rolling Hills (Lot 176-A-MS and a
portion of Lot 176-MS) to repair Rolling Hills Community Association maintained
trails in the vicinity of 10 Buggy Whip Drive (Lot 1-BW), 12 Buggy Whip Drive (Lot
2-BW), 14 Buggy Whip Drive .(Lot 3-BW). 16 Buggy Whip Drive (Lot 4-BW), 18
Buggy Whip Drive (Lot 5-BW), and 20 Buggy Whip Drive (Lot 247-6-MS), .
APPLICATIONS REQUIRED BY MUNICIPAL CODE: Variances - Chapter 17.38 and
Section 17.16.230 - Balanced grading required.
On November 22, 1994, the Planning Commission found that the project will not
have a significant effect on the environment and adopted a mitigated Negative
Declaration in accordance with the California Environmental Quality Act. The
proposed modification is consistent with the project reviewed in the previously
adopted mitigated Negative Declaration.
Any person is welcome to review the subject application and plans prior to the
public hearing at the City Hall Administration Building located at 2 Portuguese
Bend Road, Rolling Hills, CA.
If you challenge the approval or denial of this permit application in court, you may
be limited to raising only those issues you or someone else raised at the public
hearing described in this notice, or in written correspondence delivered to the
Planning Commission at, or prior to, the public hearing.

17.34.030
17.34.030 Noticing requirements. The following no-
ticing requirements shall apply to all applications requir-
ing public notice.
A. Form of Notice for All Applications Except Revoca-
tion of Variances and Nonconforming Uses. Notice of the
time and place of public hearing shall be made as follows,
where not contrary to the provisions of Chapters 3 and 4,
Title 7 of the California Government Code, -and -where no - -
other provision is made in this title for notice:
1. Such notice shall be published in at least one
newspaper of general circulation in the City, or if there
are none, in a newspaper of general circulation in Los An-
geles County. The notice shall appear in the newspaper not
less than ten calendar days prior to the date of the public
hearing. However, if a Negative Declaration is to be
adopted pursuant to Section 21080(c) of the State of
California Public Resources Code, then notice of the hear-
ing shall appear not less than twenty-one days prior to the
hearing date, or as otherwise provided for in the Public
Resources Code.
2. A written notice of the hearing shall be mailed
to the owner of the affected property and also to the own-
ers of property located within one thousand feet of the
exterior boundaries of the affected property not less than
ten calendar days prior to the hearing date. The latest
available assessment roll of the Assessor of Los Angeles
County, or other list approved by the legislative body,
shall be used in determining the names and addresses of the
property owners.
B. Form of Notice for Revocation of Variances or
Nonconforming Uses. Notice of the time and place of public
hearing shall be made as follows, where not contrary to the
provisions of Chapters 3 and 4, Title 7 of the California
Government Code, and where no other provision is made in
this title for notice:
1. A written notice shall be mailed via first-
class mail to the owner or owners and to the occupant or
occupants of the property involved. The notice shall set
forth the grounds for the proposed revocation.
2. The notice shall be mailed not less than ten
calendar days prior to the hearing.
3. In addition, the Planning Commission may order
notice of such hearing to be given to other interested
persons as the Commission deems necessary and proper in its
discretion. (Ord. 239 §11(part), 1993).
C. Required Wording on Notices.
1. Public notices of hearings on zone changes,
amendments, variances, conditional use permits or revoca-
tions shall contain the words •notice of proposed change of
zone,• "notice of proposed zoning ordinance amendment,"
•notice of proposed variance,• "notice of proposed condi-
tional use permit' or 'notice of proposed revocation,' as

is the applicable case. The notice shall describe the
property under consideration, the nature of the proposed
application, the time and place of the public hearing or
hearings on the application, and any other information the
legislative body deems appropriate.
2. All such notices shall also contain language in
substantially the following form: "Subsequent to final -
City action on this item, should you challenge the City's
action in court, you may be limited to raising only those
issues you or someone else raised at the public hearing, or
to issues addressed in written correspondence delivered to
the City either at or prior to the public hearing described
in this notice.'
D. Evidence of Notice. Evidence of all notice asso-
ciated with an application shall be maintained in the file
of the affected application or with the City Clerk. (Ord.
239 §11(part), 1993).
17.34.040 Hearings--Schedulina, A. For applications
or proposals requiring public hearing before the,Planning
Commission, the Secretary of the Planning Commission shall
set the date and time of the hearing. For applications or
proposals requiring public hearing before the City Council,
the Clerk of the City Council shall set the date and time
of the hearing.
B. The date of the hearing shall occur not less than
twenty-one calendar days nor more than sixty calendar days
from the date an application is deemed complete, or from
the date a resolution or motion is adopted requiring such
hearing. (Ord. 239 §11(part), 1993).
17.34.050 Hearinas--Rules of conduct. The Planning
Commission may establish rules governing the conduct of
public hearings conducted by that body. (Ord. 239
§11(part), 1993).
17.34.060 Hearings--Investicration. The Planning
Commission shall be responsible for investigating, or di-
recting the investigation, of the facts bearing upon an
application or similar matter set for hearing. The inves-
tigation shall also include an analysis of precedent cases
and other relevant information necessary to assure that
action on each case is consistent with the purpose of this
title and with previous decisions. (Ord. 239 §11(part),
1993) .
17.34.070 Hearinas--Number required. A. Zone Chang-
es and Amendments. Zone changes and amendments require at
least one hearing before the Planning Commission and one
hearing before the City Council.

SILHOUETTE CONSTRUCTION GUIDELINES
1. When required by the Planning Commission or City Council, a
silhouette of proposed construction should be erected for the
week preceding the designated Planning Commission or City
Council meeting. The Silhouette shall not remain erected for
a period longer than one week unless directed by the Planning
Commission or City Council.
2. Silhouettes should be constructed with 2" x 4" lumber.
Printed boards are not acceptable.
3. Bracing should be provided where possible.
4. Wire, twine or other suitable material should be used to
delineate roof ridges and eaves.
5. Small pieces of cloth or flags should be attached to the wire
or twine to aid in the visualization of the proposed
construction.
6. The application may be delayed if inaccurate
silhouettes are constructed.

SUBJECT: ZONING CASE NO. 539, Request for a Conditional Use Permit to permit the
construction of a guest house and request for Site Plan Review to permit the construction
of a new structure (the same guest house) on a site where a single family residence,
garages, pool, tennis court, and stable have been approved for construction for property
at 1 Buggy Whip Drive, Rolling Hills (Lot 176-A-MS and a portion of Lot 176-MS).

above and finds that the information submitted is:

Commission at their meeting on Tuesday. March 19,1996,
The meeting will begin at 7:30 PM in the Council Chambers, Rolling Hills City Hall Administration
Building, 2 Portuguese Bend Road, Rolling Hills. You or your designated representative must attend to
present your project and to answer questions.
The staff report for this project will be available at the City Hall after 3:00 PM on Friday, March 15,
1996. Please arrange to pick up the staff report to preview it prior to the hearing.
