RE: Drainage Report --7 Caballeros Road —The Kwon Family Residence
Dear Ms. Swartz,
This report is prepared in response to condition F, of the City's
requirements for this site, which calls for the, preparation of a drainage plan
for the north side of the subject property. This condition F was in response
to the City's concerns regarding potential on -site and off -site drainage
issues.
Existing Conditions:
The subject property is located, on the east side of Caballeros Road with
approximately 140' of frontage. The side lot lines diverge and the lot width
expands slightly as one moves easterly. The lot depth is approximately
580' in the east -west direction. The lot gently slopes away from Caballeros
Road for the first 200'. This area provides the pad for the existing single
family home located on this lot. The lot then descends at a steep slope to
another pad area with a small barn. Two additional slopes and pads occur
until the rear property line is reached. At the rear property line is a
drainage course which collects runoff from all of the area Tots that backup
to it and directs the water to the north. This drainage course is
approximately 120' lower than Caballeros Road which provides sufficient
slope to encourage the surface drainage on this lot to move from west to
east down to the drainage course.
The neighboring lots on the north and south are similarly sized and have
similar on -site drainage patterns. There are very small areas along the
north and south property lines of the subject lot which are subject to minor

cross lot drainage. This is caused by existing, localized landscape features
and surface anomalies and is common in Tots such as these that were
subdivided and developed in the 1950's.
The Concentrated Surface Drainage Sources of Potential Concern:
The following sources of drainage were observed and investigated:
1. The location and direction of relevant flows from the existing
roof and existing rear yard deck drains.
2. The location and direction of the over flow discharge drainage
from in the recently relocated koi pond.
3. The discharge flow from the koi pond filters when backwashing
occurs.
4. The direction and volume of flows from the existing landscape
sprinklers.
Roof and Deck Drains
Most of the rain fall on the front 200' of this lot is intercepted by the roof or
rear yard deck areas. The large rear yard deck has about a dozen properly
installed deck drains interspersed within the pool, spa and koi pond deck
areas and the some landscaped areas. These deck drains are connected
to an underground pipe system. The roof of this large (4,400 sf) single
story home drains to rain gutters and a downspout system which is
connected to the same underground pipe system as the deck drains. This
existing underground system was observed to discharge to a 4"outlet pipe
which located approximately in the middle of the lot. This outlet had an
elevation at least 30' lower than the rear deck area. An earthen trench led
away from this outlet and carried the water to, the east. None of this water
could be considered as cross lot drainage. If this underground pipe system
were to be blocked or otherwise fail, it is estimated that 99% of the runoff
would wind up in the same drainage course at the rear of the property,
based on the contours observed.

Pond Overflow
The recently reconstructed koi pond has its own overflow drain located
within the pond and is about 4" below the edge of the koi pond deck. The 3"
overflow drain within the pond is connected to the same underground pipe
system as the deck drains described above. This drain is about 40'
southerly of the northerly sideyard property line. A small portion of this
pond was inadvertently originally built within the required 6' wide northerly
setback area. As required, the encroaching portions of the koi pond were
removed from said setback area, thereby restoring the topography to its
original condition which existed prior to the pond's construction.
If this overflow drain were to fail and the koi pond overflowed it is estimated
that 80% of the water would spill onto the deck and enter the deck drains.
Perhaps 20% would spill into the northerly sideyard setback area and head
easterly, though a very small amount may cross the northerly property line
as it has done for the last 60 years from the original topographic condition.
The fences on the side property lines are decorative rail fences with no
footings and are not designed to prevent cross lot water movement. The
land under these fences is relatively flat in the north -south direction making
the north -south movement of water unpredictable (as it always has been) in
this approximately 100 linear foot area near the pond.
Pond Filter Backwashinq,
Back washing of the koi pond dual filter system is entirely enclosed and the
discharge is directed into an underground 3" pvc pipe which is directed
down the hill to, the middle of the this lot where it flows downhill easterly
within the subject property.
Sprinkler Systems
All sprinkler systems were operated and observed. None of the stations
created any cross lot drainage. Over flows from sprinklers that may
operate too long will drain to the east within the property lines of the subject
property. There were broken irrigation pipes and sprinkler heads observed
in the northerly sideyard setback area near the koi pond, but these appear
to be owned by the neighbor to the north and were therefore encroaching
onto the subject property. They have been cutoff and abandoned and will
be removed in the future.

Conclusion and Recommendation
The four sources of runoff described above cover all possible sources. A
field survey and topography map would reveal nothing more than these
same field observations that have been made by an experienced engineer.
If a requirement is imposed to eliminate any possibility of cross lot drainage
between this subject lot and its neighbors it is recommended that a stone
footing curbline be built along the north side property line. The stones
should be approximately 12" by 12" by 6" (half buried for stability), laid in
contact with one another forming a barrier to water movement. The soil on
the south side of this footing should be raked with a hand rake to form a
shallow channel whose centerline is running parallel to and 3' away from
this footing. Raking the soil up against the stone to create the channel
would leave about'/4 of the stone visible. A maximum of 100 linear feet
should handle all of the questionable areas. An alternate to this buried
stone would be a buried 8"x 8" reinforced concrete footing covered in
decorative stone veneer.

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mrs. Hanna Kwon with respect
to real property located at 7 Caballeros Road requesting an 18-months time extension
to comply with the requirements of Resolution No. 2010-25 to relocate "as built"
improvements.
Section 2. The Commission considered this item at a meeting on September
18, 2012 at which time information was presented indicating that additional time is
needed to process and implement the application.
Section 3. Based upon information and evidence submitted, the Planning
Commission granted a three month time extension and does hereby amend Paragraph
A, Section 12 of Resolution No. 2010-25, dated October 19, 2010 to read as follows:
A. The Variance approval shall expire within two years and three months
from the effective date of approval as defined in Sections 17.38.070(A).
Section 4. Except as herein amended, the provisions and conditions of

This letter shall serve to notify you that the Planning Commission adopted a resolution on
October 19, 2010 granting your request for a Variance in Zoning Case No. 780, with

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A VARIANCE TO RETAIN AN "AS BUILT"
WATERFALL, KOI POND AND TRELLIS IN THE SIDE YARD SETBACK,
AT AN EXISTING SINGLE FAMILY RESIDENCE IN ZONING CASE NO.
780, AT 7 CABALLEROS ROAD, (LOT 33-SK), (KWON). THE PROJECT
HAS BEEN DETERMINED TO BE EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mrs. Hanna Kwon with respect to
real property located at 7 Caballeros, Rolling Hills (Lot 33-SK) requesting to retain an
"as built" 409 square foot waterfall with koi pond and 1,076 square foot trellis in the
side yard setback at an existing single family residence.
Section 2. In April 2008 it came to the attention of staff from the adjacent
property owner, that the applicant was renovating a koi pond and adjoining water
cascade, both of which were located within the north side yard. The City inspected the
property and initially determined that the nature of the work was the replacement of
existing structures and therefore could remain in place and be renovated. This
determination was made based on a site visit and phone conversations with the previous
property owner, who stated that the koi pond and the cascade were on the property
since before she moved into the house in the early 1980's.
Section 3. The City of Rolling Hills Zoning Code regarding encroachment into
setbacks was contradictory in the 1970's and 1980's. The definition on setbacks called for
the setbacks to be free of structures, whereas under a separate section on accessory
structures it stated, "minor structures could be located in setbacks". "Minor structures"
were not defined. According to the previous RHCA Manager, ponds, fountains, outdoor
kitchens and similar "minor" structures were regularly approved in setbacks. However,
such structures would have required a building permit. There are no building permits
on record for the koi pond or the cascading feature, although there are permits on record
for the swimming pool and the spa. According to the building official, the koi pond and
the water feature could have been a part of the approval for the pool, but not specifically
called out on the permit.
Section 4. In September 2008, staff was informed that the applicant began
construction on a detached open -roofed trellis that covered and extended somewhat
beyond the koi pond and that the water feature was larger than the one previously
located in the area. Staff investigated further and determined that the trellis, pond and
cascade exceeded the scope, in both size and location, of the pre-existing structures.
Staff informed the owner of this determination and that their options were to either
remove the trellis, pond and water features from the setback or apply for a Variance to
retain them in the side setback.

This letter shall serve to notify you that the Planning Commission voted at their regular meeting
on September 21, 2010 to direct staff to prepare a resolution to approve a modified request in
Zoning Case No. 780. The Planning Commission will review and consider the draft resolution,
together with conditions of approval, at an upcoming meeting on October 19, 2010 and make its
final decision on your application at that meeting.
The Planning Commission placed the following conditions:
At the sole expense of the applicant, the City is to hire an independent surveyor to survey the
property line in the vicinity of the water cascade/koi pond
The property line to be permanently staked
Approve the as built water feature, but move it 6-feet from the property line
Approve the as built trellis, but move it 6-feet from the property line
Prepare a drainage plan for the entire side yard area where the water cascade/koi pond are
located
Obtain plumbing permits from the County of LA for the plumbing fixtures and building permit for
the trellis.
The findings and conditions of approval of the draft resolution will be forwarded to you before the
Planning Commission meeting for your review. When you receive the report, please read the
resolution and especially the conditions, as you will be required to sign, notarize and record an
affidavit that you accept all of the conditions, unless you appeal the decision to the City Council.
The decision of the Commission will become effective thirty days after the adoption of the
Planning Commission's resolution unless an appeal is filed or unless the City Council takes
jurisdiction of the case within that thirty (301 day appeal period.
As stated above, the Planning Commission's meeting to consider the resolution of approval is
scheduled for Tuesday. October 19. 2010 at 6:30 P.M. After the Planning Commission adopts the
resolution, that action, accompanied by the record of the proceedings will be forwarded to the City
Council as a report. Your case is tentatively scheduled to be placed as a report item on the City
Council's agenda at their regular meeting on Monday. November 8. 2010.

Pursuant to State Law, the Planning Commission must act on a development case within certain
period of time or the case is automatically approved. They may continue the case for additional

side yard setback.
Dear Mr. and Mrs. Kwon:
Pursuant to state law the City's staff has completed a preliminary review of the application
noted above and finds that additional information is required to complete our review, as
follows:
1. The net lot area (nla) calculation submitted (90,091 square feet) is incorrect. As shown in
the attached handout, the net lot area excludes not only the roadway easement area but also a
strip 10 feet wide along the entire perimeter of the lot, measured from the boundary of the
roadway easement. Please re -calculate and submit corrected data. Please also adjust other
data that was based on the incorrect nla, including:
"structural coverage": nla covered by structures= max. 20% - see below for exclusions.
"total lot coverage": nla covered by structures and impervious surfaces = max. 35%.
2. Please review and adjust as necessary the square footage of detached small structures
that may be excluded from the structural coverage calculation. Please note that all attached
and detached structures, including trellises, porches, breezeways and entryways are to be
counted towards structural coverage. However, up to five detached structures comprising 800
square feet total may be excluded if they each do not exceed 12 feet in height and a maximum
of 120 square feet. The types of excluded structures include: storage sheds (maximum of 2 can
be excluded), trellises and covered patios (may exceed 120 sq. ft), outdoor bars, kitchens,
fireplaces, gazebos, roofed play forts (maximum 15 ft in height), and fountains, ponds and
similar structures.
3. Please note the square footage separately for each structure on the data sheet including
pool, spa (list sq. ft of spa as a separate item from pool), service yard (utility area where trash
cans are stored), detached or attached trellis, attached covered porch, pond, raised deck.
Please locate and label these items as applicable on the site plan.

4. Please correct the front setback dimension (50 feet)which is measured from the
roadway easement boundary, not property line as shown on the site plan.
5. Trellis documentation: please provide any evidence that the subject trellis was pre-
existing. The prior owner (Cho) may provide a written statement.
6. You may make the requested changes by hand on the already submitted plans.
A copy of the original calculations and handout are attached. Please make/submit all
