For the side yard :setback encroachment the existing residence encroaches 3.65' into the 20' setba .-';; the existing residence also encroaches a maximum of 21.8' into the rear yard setback at the southwesterly corner. The proposed western addition will have a corner which increases the encroachment by 2.75' resulting in an encroachment of 6.4' into the side yard setback, it will not increase the encroachment into the rear setback. As for the removal of the requirement of a future stable, there is no!place to locate a stable on the property without the requirement of a variance, and said stable would exceed the allowed structural coverage when also factoring in the new additions. -12- -. , • . Criteria to be satisfied for grant of Variance. Such change is based upon the following described exceptional or extraordinary circumstances or conditions that do not apply generally to other property in the same vicinity and zone. The exceptional condition which doesn't usually apply to other properties is that the property is non -conforming and has a portion of the existing residence located in the setback. In order to work with the existing residence floor plan the western addition needs to have a corner located beyond tieing the existing encroachment line. The site itself is quite small with a site area of approx. 0.75 acres. As for zoning requirements, the current net lot area of 21,323 S.F. does not meet the minimum of 43,000 S.F. set forth in 16.16.010. Being that the site has already been developed, placing a stable in a location which fits all of the requirements is quite difficult.
