91, Addition to family room to exc, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) of Mr, William N. Hahn Lot 16EF ZONING CASE NO. 91 FINDING AND FORMAL REPORT The application of Mr. William N. Hahn, Lot 16EF, Eastfield Tract, for a variance of side yard requirements under Article III, Section 3.07 of Ordinance No. 33 came on for hearing on the 19th day of August, 1969 at the hour of 8:00 P.M. at the Administration Build- ing of the City of Rolling Hills, California, and the applicant, having submitted evidence in support of his application, the Planning Com- mission, being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. Is The Commission finds that the applicant, Mr. William N. Hahn, is the owner of that certain real property described as Lot 16EF, East - field Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No, 33 of the City of Rolling Hills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in opposition thereto. III. The Commission further finds that in order to enclose and enlarge an existing breezeway to be used as the family room it will be necessary to extend '._the. construction 18" into the side yard; otherwise, an exten- sive roof modification would be necessary, and interior changes would then be necessary. The owner stated that this would present sufficient hardship to discourage the entire remodelling project, and stated, fur- ther, that the addition cannot be seen from the road and the nearest part of any residence is the garage on the adjacent property. The Commission finds, therefore, that the variance of side yard require- ments to allow the family room to project 18" into the side yard should be granted to the applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance of side yard requirements should be granted by the Planning Commission of the City of Rolling Hills to Mr. William No Hahn, Lot 16EF, Eastfield Tract, in accordance with the plot plan marked Exhibit 1 on file in these proceedings, and it is, therefore, so ordered.
