RESOLUTION NO. 18
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS CONDITIONALLY APPROVING ZONING CASE NO. 271
SIDE YARD VARIANCE
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS HEREBY
RESOLVES AND ORDERS. AS FOLLOWS:
SECTION 1: A public hearing to consider the proposed request
for driveway relocation and Variance of Side Yard Requirements with re-
spect to real property described in Exhibit "A" of Zoning Case No. 271
attached hereto was duly held on February 16, 1982 at 7:30 P.M. in the
Council Chambers of the City Hall, 2 Portuguese Bend Road, Rolling Hills,
California. Notice of the time, date, place and purpose of the aforesaid
hearing was duly given.
SECTION 2: Evidence, both,written and oral, was duly presented
to and considered by the Planning Commission at the aforesaid public hear-
ing. The applicants in Zoning Case No. 261, Mr. and Mrs. Monty Ormsby,.
were present at the hearing.
SECTION 3: The Planning Commission finds that the applicant
proposes to construct.a masonry wall along the southerly property line
within the required front yardsetback area, pursuant to Section
17.16.070 of the Rolling Hills Municipal Code. The applicant further
proposes to relocate two (2) ofthe three (3) existing driveway entrances
to the subject property. The Commission visited the subject property on
March 2, 1982 and approved the request, but only so far as to permit:
1. Relocation of the easterly driveway to a point immediately in
front of the garage entrance.
2. Construction of a retaining wall at the property line to a maximum
of three (3) feet above the existing grade level, adjacent to the south.
This retaining wall may extend between the westerly driveway entrance
and the relocated easterly driveway entrance. Permission is granted to
backfill to that three foot wall to the extent title limitations will
allow.,
3. The applicant may relocate the existing westerly driveway to a
point not closer than 25 feet from the roadway easement for Portuguese
Bend Road.
4. It is recommended that this grant not include any additional'
access drives to Portuguese Bend Road.
The staff further recommends that the approval be subject to such
additional conditions as the Planning Commission feels are appropriate.
The following list of conditions is provided for your reference:
1. This approval 'shall not be effective for any purpose until the
owner of the property involved, or his duoy authorized representative,
has filed with the City Clerk of the City of Rolling Hills an affidavit
stating that he is aware of and agrees to comply with all the conditions
of the approval.
2. It is declared to be the intent of the Planning Commission that if
any provision of the approval is held or declared to be invalid, the
approval shall be void and the privileges granted thereunder shall lapse.
3. It is declared and made a condition of the approval that if any
conditions thereof are violated, or if any law, statute or ordinance is
violated, the approval shall be suspended and the privileges granted
thereunder shall lapse; provided that the applicant has been given
written notice to cease such violation and has failed to do so for a
period of thirty (30) days.

4. All requirements of the Zoning Ordinance and of the zone in which
the subject property is located must be complied with unless otherwise
set forth in the approval, or shown otherwise on an approved plan.
5. The property shall be developed and maintained in substantial con=
formance with the site plan on file marked Exhibit "A" except as other-
wise provided herein.
6. Submit a revised Exhibit "A" to the satisfaction of the City staff..
7. Prior to issuance of building permits a grading plan satisfactory
to•the City Engineer shall be submitted.
SECTION 4: Based on the foregoing findings the•Commission
hereby approves a Variance of Side Yard Setbacks pursuant to Section
17.16.070 of the Municipal Code and re -design of the driveway access,
subject to conditions stated in SECTION 3 to Mr. and Mrs. Monty Ormsby,
Lot 51-RH, located at 2 Eucalyptus Lane.•
SECTION 5: The secretary shall certify to the adoption of
this resolution and shall transmit copies of the same to the permit
holder and to the City Clerk.
SECTION 6: This action shall become final and effective
twenty (20) days after the adoption of this resolution unless within
such time an appeal is filed with the City Clerk in accordance with
the provisions of the Rolling Hills Municipal Code. This Variance
shall expire unless used within one year from the date of grant.
