FAMILY RESIDENCE AT 3 EUCALYPTUS LANE, IN ZONING
CASE NO. 743 (LOT 53-RH), (PIEPER).
REOUEST AND RECOMMENDATION
1. It is recommended that the City Council receive and file this report or provide
other direction to staff.
2. The applicants requested a Site Plan Review to construct two detached trellises
totaling 520 square feet on a property that requires Planning Commission review, due
to existing structural development restriction imposed during a Site Plan Review
application for a new residence, which was recently completed, at 3 Eucalyptus Lane.
BACKGROUND
3. The Planning Commission adopted the attached Resolution at their field trip
meeting on June 19, 2007. The vote was 4-0. There is one vacancy on the Planning
Commission.
4. In 2004 the Planning Commission approved a Site Plan Review to construct a
5,530 square foot residence, 973 square foot garage, 800 square foot swimming pool
with a spa and pool equipment, future stable, a service yard and a 2,640 square foot
basement.

5. The Planning Commission approved the project with a condition that any further
development on the property is subject to Planning Commission review and approval.
In approving the project, the Commission was concerned with the disturbed area of the
lot and the residential building pad coverage, which were close to the maximum
permitted by Code.
6. The property is zoned RAS-1 and is 2.06 acres (gross) in size and 72,744 square
feet (1.66 acres) net. The residential building pad coverage on the 26,580 square foot
residential building pad was approved at 29.5%, (max. guideline-30%), and the
disturbed area of the lot at 39.5%, (max. allowed-40.0%).
7. The applicant wishes. to construct two trellises totaling 520 square feet. Due to
the restriction onany further development on the property in the Resolution, the
applicant must seek Planning Commission approval.
MUNICIPAL CODE COMPLIANCE,
8. The structural coverage of the net lot would be 7,957 square feet (not including
the barbecue/ fire place and the trellises, but including the future stable) or 10.9%, (20%
permitted); and the total lot coverage proposed including the structures and paved
areas would be 13,637 square feet or 18.7%, (35% permitted). (Pursuant to Section
17.16.200Q) of the Zoning Ordinance, for calculation purposes, detached structures of
up to 800 square feet, not exceeding 12 feet in height and not more than 5 on the lot, are
not counted towards the structural and total lot coverage, disturbed area of the lot or
building pad coverage).
9. The trellises will be located on a previously disturbed area, which was approved
at 28,720, square feet or 39.5%, (40% permitted) of the net lot area, and therefore no
change in disturbance is proposed.
10. The residential building pad without the trellises and barbecue/fire place was
approved at 29.5% (guideline max. 30%). The barbecue/fire place and the trellises do
not count towards the building pad coverage, therefore, the coverage remains the same
at 29.5%.
ITEMS CONSIDERATION BY THE PLANNING COMMISSION
11. The previous Planning Commission approval of the residence required that
"any modification to the property, which would constitute additional structural
development shall require the filing of a new application for approval by the Planning
Commission". The proposed trellises do not count towards the structural and total lot..
coverage, disturbed area or the building pad coverage. However, pursuant to the
Zoning Ordinance, trellises are considered structures.
12. In reviewing this project the Commission determined that the project meets the
Site Plan Review criteria.

13. Although the trellises add to the mass of the development on the property they
are not counted towards the development standards, and therefore do not cause
exceedances of any of the city's Zoning requirements.
OTHER AGENCIES REVIEW
14. The Rolling Hills Community Association will review the proposed project at
a later date.
15. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA)
CONCLUSION
16. The Rolling Hills Zoning Code allows the Planning Commission to place future
development restrictions on properties in Site Plan Review and other discretionary
cases. In 2004, during a Site Plan Review process for a new residence the Commission
placed such a condition on the property. Therefore, when the applicant requested the
trellises, the project had to be brought before the Commission.
17. Although the trellises .add to the mass of the development on the property they
are not counted towards the development standards, and therefore do not cause
exceedances of any of the city's Zoning requirements or previously approved
structural, total and building pad coverages.
18. The trellises are proposed to be located on an already disturbed pad and will
not cause exceedance of the previously approved 39.5 % disturbance of the lot.

SITE PLAN REVIEW CRITERIA
17.46.010. Purpose.
The site plan review process is established to provide discretionary review of
certain development projects in the City for the purposes of ensuring that the proposed
project is consistent with the City's General Plan; incorporates environmentally and
aesthetically sensitive grading practices; preserves existing mature vegetation; is
compatible and consistent with the scale, massing and development pattern in the
immediate project vicinity; and otherwise preserves and protects the health, safety and
welfare of the citizens of Rolling Hills.
17.46.050 Required findings.
A. The Commission shall be required to make findings in acting to approve,
conditionally approve, or deny a site plan review application.
B. No project which requires site plan review approval shall be approved by
the Commission, or by the City Council on appeal, unless the following findings can be
made:
1. The project complies with and is consistent with the goals
and policies of the general plan and all requirements of the zoning ordinance;
2. The project substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage. Lot coverage
requirements are regarded as maximums, and the actual amount of lot coverage permitted
depends upon the existing buildable area of the lot;
3. The project is harmonious in scale and mass with the site,
the natural terrain and surrounding residences;
4. The project preserves and integrates into the site design, to
the greatest extent possible, existing topographic features of the site, including
surrounding native vegetation, mature trees, drainage courses and land forms (such as
hillsides and knolls);
5. Grading has been designed to follow natural contours of the
site and to minimize the amount of grading required to create the building area;
6. Grading will not modify existing drainage channels nor
redirect drainage flow, unless such flow is redirected into an existing drainage course;
7. The project preserves surrounding native vegetation and
mature trees and supplements these elements with drought -tolerant landscaping which is
compatible with and enhances the rural character of the community, and landscaping
provides a buffer or transition area between private and public areas;
8. The project is sensitive and not detrimental to the convenient and safe
movement of pedestrians and vehicles; and
9. The project conforms to the requirements of the California Environmental
Quality Act.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF

PLANNING COMMISSION REVIEW DUE TO EXISTING
STRUCTURAL DEVELOPMENT RESTRICTION AT A SINGLE
FAMILY RESIDENCE AT 3 EUCALYPTUS LANE, IN ZONING CASE
NO. 743 (LOT 53-RH), (PIEPER).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Jeffrey Pieper with
respect to real property located at 3 Eucalyptus Lane, (Lot 53-RH), Rolling Hills, CA
requesting a Site Plan Review to permit construction of two detached trellises, for a total
of 520 square feet. A Site Plan Review application approved. in 2004 for grading and
construction of a new 5,530 square foot single family residence, 973 square foot garage,
800 square foot swimming pool/spa, service yard, 450 square foot future stable, 2,640
square foot basement and a new driveway contains a condition that any further
development on subject property requires a site plan review by the Planning
Commission.
Section 2. The Planning Commission conducted duly noticed public hearings
to consider the application on May 15, 2007 and at a field trip visit on June 19, 2007. The
applicants were notified of the public hearings in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal and
from members of the City staff and the Planning Commission having reviewed,
analyzed and studied said proposal. The applicants were in attendance at the hearings.
Section 3. The property is zoned RAS-1 and is 2.06 acres (gross) in size and 1.7
acres net. A new residence, approved in 2004, is currently under construction.
Section 4. , The Planning Commission finds that the project qualifies as a Class
3 Exemption (The State of CA Guidelines, Section 15303) and is therefore categorically
exempt from environmental review under the California Environmental Quality Act.
Section 5. Section 17.46.040 allows the Planning Commission to condition any
approval to require a new Site Plan Review application for any further development on
the property, regardless of whether Site Plan Review would ordinarily be applicable to
such construction. Resolution 2004-14 for approval of a new residence contains such a
condition, and therefore the construction of the trellises is subject to a Site Plan Review
by the Planning Commission. With respect to the Site Plan Review application
requesting construction of the trellises, the Planning Commission makes the following
findings of fact:
A. The proposed development is compatible with the General Plan, the
Zoning Ordinance and surrounding uses because the proposed structures comply with

the General Plan requirement of low profile, low -density residential development with
sufficient open space between surrounding structures. The project conforms to Zoning
Code setbacks, lot disturbance and lot coverage requirements. Pursuant to Section
17.16.200J of the Zoning Ordinance, free standing structures, such as trellises,
barbeques, gazebos and similar structures are not counted towards structural, total and
disturbed area of the net lot, or building pad coverage, provided there is no more than 5
such structures on the lot or the combined size of such structures does not exceed 800
square feet. Therefore, the proposed structures are not counted against the maximum
permitted lot coverage or disturbance and will not exceed the previously approved
development standards. The structural coverage of the net lot was approved at 7,957
square feet (not including the barbecue/fire place and the trellises, but including the
future stable) or 10.9%, (20% permitted); and the total lot coverage proposed including
the structures and paved areas was approved at 13,637 square feet or 18.7%, (35%
permitted). The disturbed area of the lot was approved at 39.5%, which is within the
40% maximum permitted, and includes the stable. The proposed project is screened
from the road so as to reduce the visual impact of the development.
B. The development plan substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage because the new
structures will not cause the lot to look overdeveloped. Significant portions of the lot
will be left undeveloped so as to maintain open space on the property. The nature,
condition, and development of adjacent uses, buildings, and structures and the
topography of the lot have been considered, and the construction of the trellises will not
adversely affect or be materially detrimental to the adjacent uses, buildings, or
structures because the proposed structures will be constructed on a portion of the lot
which is the least intrusive to surrounding properties, will be screened and landscaped
with trees and shrubs, is a sufficient distance from nearby residences so that the
proposed structures will not impact the view or privacy of surrounding neighbors, and
will utilize the existing building pad for the new construction.
C. The proposed development, as conditioned, is harmonious in scale and
mass with the site, the natural terrain and surrounding residences. As indicated in
Paragraph A, the lot coverage maximum set forth in the Zoning Code will not be
exceeded and the proposed project is consistent with the scale of the neighborhood.
D. The development plan incorporates existing trees and native vegetation to
the maximum extent feasible. Specifically, the development plan preserves dense brush
and shrubs and supplements it with landscaping that is compatible with and enhances
the rural character of the community.
E. The development plan shows the trellises on an existing building pad and
there is no grading proposed.
F. The proposed development is sensitive and not detrimental to the
convenience and safety of circulation for pedestrians and vehicles because the trellises
will be accessed from the residence and no change to the circulation is proposed.
G. The project conforms to the requirements of the California Environmental
Quality Act and is exempt.

Section 6. Based upon the foregoing findings, the Planning Commission hereby
approves the Site Plan Review application for Zoning Case No. 743 for 520 square feet
trellises as shown on the Development Plan dated April 20, 2007 and marked Exhibit A,
subject to the following conditions:
A. The Site Plan Review approval shall expire within two years from the
effective date of approval if construction pursuant to this approval has not commenced
within that time period, as required by Section 17.46.080(A) of the Rolling Hills
Municipal Code, or the approval granted is otherwise extended pursuant to the
requirements of that section.
B. It is declared and made a condition of the Site Plan Review approval, that
if any conditions thereof are violated, this approval shall be suspended and the
privileges granted hereunder shall lapse; provided that the applicants have been given
written notice to cease such violation, the opportunity for a hearing has been provided,
and if requested, has been held, and thereafter the applicant fails to correct the violation
within a period of thirty (30) days from the date of the City's determination.
C. All requirements of the Building and Construction Ordinance, the Zoning
Ordinance, and of the zone in which the subject property is located must be complied
with unless otherwise set forth in the Permit, or shown otherwise on an approved plan.
D. The lot shall be developed and maintained in substantial conformance
with the site plan on file marked Exhibit A and dated April 20, 2007 except as otherwise
provided in these conditions.
E. The working drawings submitted to the County Department of Building
and Safety for plan check review must conform to the development plan approved with
this application.
F. There shall be no grading for this project.
G. Structural lot coverage shall not exceed 7,957 square feet or 10.9%.
H. Total lot coverage of structures and paved areas shall not exceed 13,637
square feet or 18.7% in conformance with lot coverage limitations.
I. The disturbed area of the lot shall not exceed 28,720 square feet or 39.5% of
the net lot area in conformance with lot disturbance limitations.
J. Residential building pad coverage on the 26,580 square foot residential
building pad shall not exceed 7,849 square feet or 29.5%.
K. During construction, the property owners shall be required to schedule
and regulate construction and related traffic noise throughout the day between the
hours of 7 AM and 6 PM, Monday through Saturday only, when construction and
mechanical equipment noise is permitted, so as not to interfere with the quiet
residential environment of the City of Rolling Hills.

L. Notwithstanding Sections 17.46.020 and 17.46.070 of the Rolling Hills
Municipal Code, any modifications to the property, which would constitute
additional structural development or grading, shall require the filing of a new
application for approval by the Planning Commission.
M. The project must be reviewed and approved by the Rolling Hills
Community Association Architectural Review Committee prior to the issuance of
grading or building permit.
N. Until the applicants execute an Affidavit of Acceptance of all conditions of
this Site Plan Review approval, as required by Section 17.46.065, the approval shall not
be effective.'
O. All conditions of the Site Plan approval, that apply, shall be complied with
prior to the issuance of a building permit from the County of Los Angeles.
P. All conditions of Resolution No: 2004-14 shall continue to be in full force
and effect.
Q. Any action challenging the final decision of the city made as a result of the
public hearing on this application must be filed within the time limits set forth in
Section 17.54.070 of the Rolling Hills Municipal Code and Code of Civil Procedure
Section 1094.6.

SITE PLAN REVIEW CRITERIA
17.46.010 Purpose.
The site plan review process is established to provide discretionary review of
certain development projects in the City for the purposes of ensuring that the proposed
project is consistent with the City's General Plan; incorporates environmentally and
aesthetically sensitive grading practices; preserves existing mature vegetation; is
compatible and consistent with the scale, massing and development pattern in the
immediate project vicinity; and otherwise preserves and protects the health, safety and
welfare of the citizens of Rolling Hills.
17.46.050 Reauired findings.
A. The Commission shall be required to make findings in acting to approve,
conditionally approve, or deny a site plan review application.
B. No project which requires site plan review approval shall be approved by
the Commission, or by the City Council on appeal, unless the following findings can be
made:
1. The project complies with and is consistent with the goals
and policies of the general plan and all requirements of the zoning ordinance;
2. The project substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage. Lot coverage
requirements are regarded as maximums, and the actual amount of lot coverage permitted
depends upon the existing buildable area of the lot;
3. The project is harmonious in scale and mass with the site,
the natural terrain and surrounding residences;
4. The project preserves and integrates into the site design, to
the greatest extent possible, existing topographic features of the site, including
surrounding native vegetation, mature trees, drainage courses and land forms (such as
hillsides and knolls);
5. Grading has been designed to follow natural contours of the
site and to minimize the amount of grading required to create the building area;
6. Grading will not modify existing drainage channels nor
redirect drainage flow, unless such flow is redirected into an existing drainage course;
7. The project preserves surrounding native vegetation and
mature trees and supplements these elements with drought -tolerant landscaping which is
compatible with and enhances the rural character of the community, and landscaping
provides a buffer or transition area between private and public areas;
8. The project is sensitive and not detrimental to the convenient and safe
movement of pedestrians and vehicles; and
9. The project conforms to the requirements of the California Environmental
Quality Act.

REOUEST AND RECOMMENDATION
1. Request for a Site Plan Review to construct two detached trellises totaling 520
square feet on a property that requires Planning Commission review, due to existing
structural development restriction imposed during a Site Plan Review application for a
new residence, currently under construction, at 3 Eucalyptus Lane.
2. It is recommended that the Planning Commission view the project, consider the
Site Plan Review criteria for approving Site Plan Review applications, open the
continued public hearing and if there are no objections to the project adopt Resolution
No. 2007-09 approving this request.
BACKGROUND
3. At the May 15, 2007 meeting, the Planning Commission scheduled a field trip to
subject property for tonight and directed staff to prepare a Resolution of approval to be
available for Commission's consideration at the field trip. Should the Commission find
reasons to approve the project, the enclosed Resolution of approval may me adopted at
the field trip.
4. In 2004 the Planning Commission approved a Site Plan Review to construct a
5,530 square foot residence, 973 square foot garage, 800 square foot swimming pool
with a spa and pool equipment, future stable, a service yard and a 2,640 square foot
basement. The project is currently under construction.

5. The Planning Commission approved the project with a condition that any further
development on the property is subject to Planning Commission review and approval.
In approving the project, the Commission was concerned with the disturbed area of the
lot and the residential building pad coverage, which were almost at the maximum
permitted.
6. The property is zoned RAS-1 and is 2.06 acres (gross) in size and 72,744 square
feet (1.66 acres) net. The residential building pad coverage on the 26,580 square foot
residential building pad was approved at 29.5%, (max. guideline-30%), and the
disturbed area of the lot at 39.5%, (max. allowed-40.0%).
7. The applicant wishes to construct two trellises totaling 520 square feet. Due to
the restriction on any further development on the property in the Resolution, the
applicant must seek Planning Commission approval.
MUNICIPAL CODE COMPLIANCE
8. The structural coverage of the net lot would be 7,957 square feet (not including
the barbecue/fire place and the trellises, but including the future stable) or.10.9%, (20%
permitted); and the total lot coverage proposed including the structures and paved
areas would be 13,637 square feet or 18.7%, (35% permitted). (Pursuant to Section
17.16.200(J) of the Zoning Ordinance, for calculation purposes, detached structures of
up to 800 square feet, not exceeding 12 feet in height and not more than 5 on the lot, are
not counted towards the structural and total lot coverage, disturbed area of the lot or
building pad coverage).
9. The trellises will be located on a previously disturbed area, which was approved
at 28,720, square feet or 39.5%, (40% permitted) of the net lot area, and therefore no
change in disturbance is proposed.
10. The residential building pad without the trellises and barbecue/fire place was
approved at 29.5% (guideline max. 30%). The barbecue/fire place and the trellises do
not count towards the building pad coverage, therefore, the coverage remains the same
at 29.5%.
ITEMS FOR PLANNING COMMISSION CONSIDERATION
11. The previous Planning Commission approval of the residence required that
"any modification to the property, which would constitute additional structural
development shall require the filing of a new application for approval by the Planning
Commission". The proposed trellises do not count towards the structural and total lot
coverage, disturbed area or the building pad coverage. However, pursuant to the
Zoning Ordinance, trellises are considered structures.
12. In reviewing this project the Commission must determine if the project meets
the Site Plan Review criteria, attached.

13. Although the trellises add to the mass of the development on the property they
are not counted towards the development standards, and therefore do not cause
exceedances of any of the city's Zoning requirements.
OTHER AGENCIES REVIEW,
14. The Rolling Hills Community Association will review the proposed project at a
later date.
15. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA).
CONCLUSION
16. The Rolling Hills Zoning Code allows the Planning Commission to place future
development restrictions on properties in Site Plan Review and other discretionary
cases. In. 2004, during a Site Plan Review process for a new residence the Commission
placed such a condition on the property. Therefore, when the applicant requested the
trellises, the project had to be brought before the Commission.
17. Although the trellises add to the mass of the development on the property they
are not counted towards the development standards, and therefore do not cause
exceedances of any of the city's Zoning requirements or previously approved
structural, total and building pad coverages.
18. The trellises are proposed to be located on an already disturbed pad and will
not cause exceedance of the previously approved 39.5 % disturbance of the lot.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING APPROVAL OF A SITE PLAN REVIEW
TO CONSTRUCT TRELLISES ON A PROPERTY THAT REQUIRES
PLANNING COMMISSION REVIEW DUE TO EXISTING
STRUCTURAL DEVELOPMENT RESTRICTION AT A SINGLE
FAMILY RESIDENCE AT 3 EUCALYPTUS LANE, IN ZONING CASE
NO. 743 (LOT 53-RH), (PIEPER).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Jeffrey Pieper with
respect to real property located at 3 Eucalyptus Lane, (Lot 53-RH), Rolling Hills, CA
requesting a Site Plan Review to permit construction of two detached trellises, for a total
of 520 square feet. A Site Plan Review application approved in 2004 for grading and
construction of a new 5,530 square foot single family residence, 973 square foot garage,
800 square foot swimming pool/spa, service yard, 450 square foot future stable, 2,640
square foot basement and a new driveway contains a condition that any further
development on subject property requires a site plan review by the Planning
Commission.
Section 2. The Planning Commission conducted duly noticed public hearings
to consider the application on May 15, 2007 and at a field trip visit on June 19, 2007. The
applicants were notified of the public hearings in writing by first class mail. Evidence
was heard and presented from all persons interested in affecting said proposal and
from members of the City staff and the Planning Commission having reviewed,
analyzed and studied said proposal. The applicants were in attendance at the hearings.
Section 3. The property is zoned RAS-1 and is 2.06 acres (gross) in size and 1.7
acres net. A new residence, approved in 2004, is currently under construction.
Section 4. The Planning Commission finds that the project qualifies as a Class
3 Exemption (The State of CA Guidelines, Section 15303) and is therefore categorically
exempt from environmental review under the California Environmental Quality Act.
Section 5. Section 17.46.040 allows the Planning Commission to condition any
approval to require a new Site Plan Review application for any further development on
the property, regardless of whether Site Plan Review would ordinarily be applicable to
such construction. Resolution 2004-14 for approval of a new residence contains such a
condition, and therefore the construction of the trellises is subject to a Site Plan Review
by the Planning Commission. With respect to the Site Plan Review application
requesting construction of the trellises, the Planning Commission makes the following
findings of fact:
A. The proposed development is compatible with the General Plan, the
Zoning Ordinance and surrounding uses because the proposed structures comply with

the General Plan requirement of low profile, low -density residential development with
sufficient open space between surrounding structures. The project conforms to Zoning
Code setbacks, lot disturbance and lot coverage requirements. Pursuant to Section
17.16.200J 'of the Zoning Ordinance, free standing structures, such as trellises,
barbeques, gazebos and similar structures are not counted towards structural, total and
disturbed area of the net lot, or building pad coverage, provided there is no more than 5
such structures on the lot or the combined size of such structures does not exceed 800
square feet. Therefore, the proposed structures are not counted against the maximum
permitted lot coverage or disturbance and will not exceed the previously approved
development standards. The structural coverage of the net lot was approved at 7,957
square feet (not including the barbecue/fire place and the trellises, but including the
future stable) or.-10.9%, (20% permitted); and the total lot coverage proposed including
the structures, and paved areas was approved at 13,637 square feet or 18.7%, (35%
permitted). The disturbed area of the lot was approved at 39.5%, which is within the
40% maximum permitted, and includes the stable. The proposed project is screened
from the road so as to reduce the visual impact of the development.
B. The development plan substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage because the new
structures will not cause the lot to look overdeveloped. Significant portions of the lot
will be left undeveloped so as to maintain open space on the property. The nature,
condition, and development of adjacent uses, buildings, and structures and the
topography of the lot have been considered, and the construction of the trellises will not
adversely affect or be materially detrimental to the adjacent uses, buildings, or
structures because the proposed structures will be constructed on a portion of the lot
which is the least intrusive to surrounding properties, will be screened and landscaped
with trees and shrubs, is a sufficient distance from nearby residences so that the
proposed structures will not impact the view or privacy of surrounding neighbors, and
will utilize the existing building pad for the new construction.
C. The proposed development, as conditioned, is harmonious in scale and
mass with the site, the natural terrain and surrounding residences. As indicated in
Paragraph A, the lot coverage maximum set forth in the Zoning Code will not be
exceeded and the proposed project is consistent with the scale of the neighborhood.
D. The development plan incorporates existing trees and native vegetation to
the maximum extent feasible. Specifically, the development plan preserves dense brush
and shrubs and supplements it with landscaping that is compatible with and enhances
the rural character of the community.
E. The development plan shows the trellises on an existing building pad and
there is no grading proposed.
F. The proposed development is sensitive and not detrimental to the
convenience and safety of circulation for pedestrians and vehicles because the trellises
will be accessed from the residence and no change to the circulation is proposed.
G. The project conforms to the requirements of the California Environmental
Quality Act and is exempt.

Section 6. Based upon the foregoing findings, the Planning Commission hereby
approves the Site Plan Review application for Zoning Case No. 743 for 520 square feet
trellises as shown on the Development Plan dated April 20, 2007 and marked Exhibit A,
subject to the following conditions:
A. The Site Plan Review approval shall expire within two years from the
effective date of approval if construction pursuant to this approval has not commenced
within that time period, as required by Section 17.46.080(A) of the Rolling Hills
Municipal Code, or the approval granted is otherwise extended pursuant to the
requirements of that section.
B. It is declared and made a condition of the Site Plan Review approval, that
if any conditions thereof are violated, this approval shall be suspended and the
privileges granted hereunder shall lapse; provided that the applicants have been given
written notice to cease such violation, the opportunity for a hearing has been provided,
and if requested, has been held, and thereafter the applicant fails to correct the violation
within a period of thirty (30) days from the date of the City's determination.
C. All requirements of the Building and Construction Ordinance, the Zoning
Ordinance, and of the zone in which the subject property is located must be complied
with unless otherwise set forth in the Permit, or shown otherwise on an approved plan.
D. The lot shall be developed and maintained in substantial conformance
with the site plan on file marked Exhibit A and dated April 20, 2007 except as otherwise
provided in these conditions.
E. The working drawings submitted to the County Department of Building
and Safety for plan check review must conform to the development plan approved with
this application.
F. There shall be no grading for this project.
G. Structural lot coverage shall not exceed 7,957 square feet or 10.9%.
H. Total lot coverage of structures and paved areas shall not exceed 13,637
square feet or 18.7% in conformance with lot coverage limitations.
I. The disturbed area of the lot shall not exceed 28,720 square feet or 39.5% of
the net lot area in conformance with lot disturbance limitations.
J. Residential building pad coverage on the 26,580 square foot residential
building pad shall not exceed 7,849 square feet or 29.5%.
K. During construction, the property owners shall be required to schedule
and regulate construction and related traffic noise throughout the day between the
hours of 7 AM and 6 PM, Monday through Saturday only, when construction and
mechanical equipment noise is permitted, so as not to interfere with the quiet
residential environment of the City of Rolling Hills.

L. Notwithstanding Sections 17.46.020 and 17.46.070 of the Rolling Hills
'Municipal Code, any modifications to the property, which would constitute
additional structural development or grading, shall require the filing of a new
application for approval by the Planning Commission.
M. The project must be reviewed, and approved by the Rolling Hills
Community Association Architectural Review Committee prior to the issuance of
grading or building permit.
N. Until the applicants execute an Affidavit of Acceptance of all conditions of
this Site Plan Review approval, as required by Section 17.46.065, the approval shall not
be effective.
O. All conditions of the Site Plan approval, that apply, shall be complied with
prior to the issuance of a building permit from the County of Los Angeles.
P. All conditions of Resolution No. 2004-14 shall continue to be in full force
and effect.
Q. Any action challenging the final decision of the city made as a result of the
public hearing on this application must be filed within the time limits set forth in
Section 17.54.070 of the Rolling Hills Municipal Code and Code of Civil Procedure
Section 1094.6.

REQUEST AND RECOMMENDATION
1. Request for a Site Plan Review to construct two detached trellises totaling 520
square feet on a property that requires Planning Commission review, due to existing
structural development restriction imposed during a Site Plan Review application for a
new residence, currently under construction, at 3 Eucalyptus Lane.
2. It is recommended that the Planning Commission review the staff report,
consider the Site Plan Review criteria for approving Site Plan Review applications,
which are attached, open the public hearing and take public testimony.
BACKGROUND
3. In 2004 the Planning Commission approved a Site Plan Review to construct a
5,530 square foot residence, 973 square foot garage, 800 square foot swimming pool
with a spa and pool equipment, future stable, a service yard and a 2,640 square foot
basement. The project is currently under construction.
4. The Planning Commission approved the project with a condition that any further
development on the property is subject to Planning Commission review and approval.
In approving the project, the Commission was concerned with the disturbed area of the
lot and the residential building pad coverage, which were almost at the maximum
permitted.
5: The property is zoned RAS-1 and is 2.06 acres (gross) in size and 72,744 square
feet (1.66 acres) net. The residential building pad coverage on the 26,580 square foot
residential building pad was approved at 29.5%, (max. guideline-30%), and the
disturbed area of the lot at 39.5%, (max. allowed-40.0%).

6. The applicant wishes to construct two trellises totaling 520 square feet. Due to
the restriction on any further development on the property in the Resolution, the
applicant must seek Planning Commission approval.
MUNICIPAL CODE COMPLIANCE
7. The structural coverage of the net lot would be 7,957 square feet (not including
the barbecue/fire place and the trellises, but including the future stable) or 10.9%, (20%
permitted); and the total lot coverage proposed including the structures and paved
areas would be 13,637 square feet or 18.7%, (35% permitted). (Pursuant to Section
17.16.200(J) of the Zoning Ordinance, for calculation -purposes, detached structures of
up to 800 square feet, not exceeding 12 feet in height and not more than 5 on the lot, are
not counted towards the structural and total lot coverage, disturbed area of the lot or
building pad coverage).
8. The trellises will be located on a previously disturbed area, which was approved
at 28,720, square feet or 39.5%, (40% permitted) of the net lot area, and therefore no
change in disturbance is proposed.
9. The residential building pad without the trellises and barbecue/fire place was
approved at 29.5% (guideline max. 30%). The barbecue/fire place and the trellises do
not count towards the building pad coverage, therefore, the coverage remains the same
at 29.5%.
ITEMS FOR PLANNING COMMISSION CONSIDERATION
10. The previous Planning Commission approval of the residence required that
"any modification to the property, which would constitute additional structural
development shall require the filing of a new application for approval by the Planning
Commission". The proposed trellises do not count towards the structural and total lot
coverage, disturbed area or the building pad coverage. However, pursuant to the
Zoning Ordinance, trellises are considered structures.
11. In reviewing this project the Commission must determine if the project meets
the Site Plan Review criteria, attached.
12. Although the trellises add to the mass of the development on the property they
are not counted towards the development standards, and therefore do not cause
exceedances of any of the city's Zoning requirements.
OTHER AGENCIES REVIEW
13. The Rolling Hills Community Association will review the proposed project at a
later date.
14. The project has been determined to be categorically exempt pursuant to the
California Environmental Quality Act (CEQA).

CONCLUSION
15. The Rolling Hills Zoning Code allows the Planning Commission to place
future development restrictions on properties in Site Plan Review and other
discretionary cases. In 2004, during a Site Plan Review process for a new
residence the Commission placed such a condition on the property. Therefore,
when the applicant requested the trellises, the project had to be brought before
the Commission.
16. Although the trellises add to the mass of the development on the property
they are not counted towards the development standards, and therefore do not
cause exceedances of any of the city's Zoning requirements .or previously
approved structural, total and building pad coverages.
17. The trellises are proposed to be located on an already disturbed pad and
will not cause exceedance of the previously approved 39.5 % disturbance of the
lot.

SITE PLAN REVIEW CRITERIA
17.46.010 Purpose.
The site plan review process is established to provide discretionary review of
certain development projects in the City for the purposes of ensuring that the proposed
project is consistent with the City's General Plan; incorporates environmentally and
aesthetically sensitive grading practices; preserves existing mature vegetation; is
compatible and consistent with the scale, massing and development pattern in the
immediate project vicinity; and otherwise preserves and protects the health, safety and
welfare of the citizens of Rolling Hills.
17.46.050 Required findings.
A. The Commission shall be required to make findings in acting to approve,
conditionally approve, or deny a site plan review application.
B. No project which requires site plan review approval shall be approved by
the Commission, or by the City Council on appeal, unless the following findings can be
made:
1. The project complies with and is consistent with the goals
and policies of the general plan and all requirements of the zoning ordinance;
2. The project substantially preserves the natural and
undeveloped state of the lot by minimizing building coverage. Lot coverage
requirements are regarded as maximums, and the actual amount of lot coverage permitted
depends upon the existing buildable area of the lot;
3. The project is harmonious in scale and mass with the site,
the natural terrain and surrounding residences;
4. The project preserves and integrates into the site design, to
the greatest extent possible, existing topographic features of the site, including
surrounding native vegetation, mature trees, drainage courses and land forms (such as
hillsides and knolls);
5. Grading has been designed to follow natural contours of the
site and to minimize the amount of grading required to create the building area;
6. Grading will not modify existing drainage channels nor
redirect drainage flow, unless such flow is redirected into an existing drainage course;
7. The project preserves surrounding native vegetation and
mature trees and supplements these elements with drought -tolerant landscaping which is
compatible with and enhances the rural character of the community, and landscaping
provides a buffer or transition area between private and public areas;
8. The project is sensitive and not detrimental to the convenient and safe
movement of pedestrians and vehicles; and
9. The project conforms to the requirements of the California Environmental
Quality Act.
