the decision of the Planning Commission on April 20, 1976
to deny your application for a conditional use permit for.
construction of a tennis court in the front yard of Lot
14EF, 79 Eastfiold Drive:

Members of the Council:
In attempting to develop a plan for construction of a
home at 79 Eastfield Dr. we obtained a Geological Study,
a Topographical Rendering and employed the services of an
Architect. The results of the studies Show the property is
unique in that the water runoff from streets and homes over
a large area converges on the front of the property near the
center of the lot. This runoff has deposited a deep layer
of Topsoil which is unsuitable for a foundation to a depth
of 15 or more feet. Construction of the house on this
portion of the property would necessitate redirecting the
Runoff underground besides the difficulty of engineering the
foundation.
It was also revealed that an unusually stable building
site exists toward the rear of the property. It is based on
rock which inclines back into the hillside and can provide
a sound base without the deep foundation or extensive
compaction which would be necessary on the front portion of
the property.
Placing the house on this Hillside location would leave
more than an acre of land between the house and the street.
dge applied for a variance in order to utilize a portion of
that area for construction of a Tennis Court. The Court
would be quite distant from the street and heavily screened
by already mature trees and vegetation. Letters from the

neighbors indicate they have no objections to a Tennis Court
in that location, and after a Field Trip to view the staked
area indicating the location of the Tennis Court, the R.H.C.A.
Board approved the granting of the Variance with proper
additional planting by unanimous vote. The Architectural
Commitee also gave their approval.
Aside from the extreme difficulty in building the house
at thefront of the lot, we feel the best interest of the
Community would be served by building the home, rather than
court, toward the rear where it would be clearly visible
from Crest Road. We believe most Rolling Hills residents
would prefer to see a home in that more visible location.
We feel that the reasons given for requesting a Variance
did indeed show practical difficulties and unnecessary
hardship as defined in Art. V1 Sec. 6.03 of the'City 0rdinanee.
We therefore respectfully request that the decision to deny
the Variance be reviewed by the City Council.

Gentlemen:
I am aware of the request for a building permit
from Dr. Whitmore for a tennis court at 79 Eastfield
Drive, Rolling Hills, Calif., 90274. I own the Northerly
adjacent property at 77 Eastfield Drive.
I have no objections to a tennis court on the front
of Dr. Whitmore's property as long as no trees protecting
my property from his are disturbed.
