255, Cut and fill slopes as reccomm, Resolutions & Approval ConditionsBEFORE THE. PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) ) of . ) ) ZONING CASE NO. 255 Dr. Martin Goldberg ) ) Lot 92-2-RH ) FINDINGS AND REPORT The application of Dr. Martin Goldberg for a Variance of Grading Requirements under Section 1 (a), Maximum Slope, and Section 3 (c), Fill Slope, of Ordinance No. 153, came on for hearing on the 26th day of August 1980 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Di. Martin Goldberg., is the owner of that certain real property described as Lot 92-2-RH, located on Pine Tree Lane in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds that the applicant has requested a variance of grading requirements in circler to construct a residence on the lot, which was created by subdivision of property in 1970, under ordinances which permitted 12:1 cut and fill slopes. The Commission finds that Dr. Charles Turner, 4 Pine Tree Lane, attended meeting and advised that severe erosion resulted fron recent rains, and he is concerned about drainage resulting from development of the land. Dr. Braden Stauts, 2 Pine Tree Lane, appeared before the Commission and stated that he likes the concept of +'e low of the proposed residence, but would be opposed to any improvement of Pine Tree Lane which would result in widening the road. The Commis- sion finds that no other comment, written or verbal, was received in favor of or in oppositicnl to the request. The Commission finds that discussion of the matter was deferred for a field trip to the site and was discu sed at a meeting on September 30, after which it was deferred to October 21, 1980, for consideration of a revised plan. The Commission finds that the plan, as revised, incorporates recommendations of the Planning Commission at previous meetings and the field trip, and resulted in change.of location of the proposed swimming pool, an increase in the usable area around the house, and addition of retaining walls. III. The Commission finds that a hardship exists because of the topography and lot design, and that a Variance of. Grading Regulations should be granted in order to preserve substantial property rights in the same vicinity of zone, and that the granting of such a variance would not be materially detrimental to the public welfare, nor injurious _to property in the same vicinity and zone. IV. From the foregoing it is concluded that a Variance of Grading Requirements should be granted to Dr. Martin Goldberg, Lot 92-2-RH, Pine Tree Lane, and it is, therefore, so ordered. V. The applicant is advised that this approval shall expire one year from the date of grant, if not acted on. The applicant is further advised that the • time within which to seek judicial review of this action is governed by Section 1094.6 of the Code of Civil Procedure of the State of California. C j irman, Plannin'Commission. ..o a retary, Planning Coission • ORDINANCE NO. 153 AN ORDINANCE OF THE CITY OF ROLLING HILLS AMENDING ORDINANCE NO, 133 "AN ORDINANCE OF THE CITY OF ROLLING HILLS ADOPTING BY REFERENCE THE LOS ANGELES COUNTY BUILDING CODE CONTAINED IN THE 1975 EDITION OF THE BUILDING LAWS PUBLISHED BY BUILDING NEWS, INC, FOR AND INSTEAD OF THE PRESENT BUILDING CODE, AND MAKING OTHER AMENDMENTS" The City Council of the 'City of Rolling Hills does ordain as follows: Section 1:. Section 7009, entitled "EXCAVATIONS" of the Los Angeles, County Building Code, which Building Code has been adopted by reference as the Building Code of the City of Rolling Hills, Para- graph (a) thereof, is amended to read: "(a) MAXIMUM SLOPE. Cuts shall not be steeper in slope than two horizontal to one vertical, or exceed a vertical height of thirty (30) feet unless the owner receives a variance for a steeper slope from the Planning Commission of the City of Rolling Hills, pursuant to the provisions of Ordinance No. 33 of said City. The building official may require the excavation to be made with a cut face flatter in slope than two horizontal to one vertical if he finds it necessary for stability and safety." Section 2: Section 7009 (b) is amended to read as follows: "(b) DRIVEWAYS. Driveways which provide access from any lot or parcel of land to any of the private roads in the City of Rolling Hills, which are maintained and constructed by the Rolling Hills Community Association, shall be so constructed that the first twenty feet of said driveway, treasuredfrom the edge of the paved portion of said private road, shall not be steeper in grade than seven (7%) percent." Section 3: Section 7010 (c) is amended to read: "(c) FILL SLOPE. No fill slope shall exceed a steepness of two hcrizontal to one vertical, nor exceed a vertical height of thirty (30) feet. The owner shall submit soil test data and engineering calculaticns to substantiate to the satisfaction of the Building Official the stability of the fill slope and slope surface under conditions of saturation."
