FINDINGS AND REPORT
The application of Dr. Martin Goldberg for a Variance of
Front Yard Set Back Requirements under Section 3.06, Ordinance No. 169
came on for hearing on the 26th day of August 1980 in the Council
Chambers of the Administration Building, 2 Portuguese Bend Road,
Rolling Hills, California, and the applicant having submitted evidence
in support of the application, the Planning Commission, being advised,
now makes its Findings and Report as required by the Ordinances of the
City of Rolling Hills, California.
I.
The Commission finds that the applicant, Dr. Martin Goldberg,
is the owner of that certain real property described as Lot 92-2-RH,
located on Pine Tree Lane in the City of Rolling Hills, and that notice
of the public hearing in connection with said application was given as
required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of
Rolling Hills, California.
II.
The Commission finds that the applicant has requested a
variance of front yard requirements in order to construct a residence
on the lot, which was created by subdivision of property in 1970 under
ordinances which required a front yard setback of 30 feet from the
road easement line. The Commission finds that no comment, written or
verbal, was received in favor of or in opposition to the request for a
variance from front setback requirements. The Commission finds that
Dr. Braden Stauts, 2 Pine Tree Lane, advised the Commission that he
likes the concept of the low profile of the proposed residence, and
would be opposed to any improvement of Pine Tree Lane which would
result in widening the road. The Commission finds that the proposed
residence has been designed with a 30 foot setback as required when
the lot was created by subdivision in 1970, since a 12,000 square
foot pad cannot be developed under current requirements of a 50 foot
setback. The Commission finds that the proposed house would be 60 feet
from the paved portion of Pine Tree Lane at its closest point, the
floor line at that point is 25 vertical feet below Pine Tree Lane and
the roof ridge at the highest::point would be 8 feet below the road.
The Commission further finds that future widening of Pine Tree Lane is
not anticipated because of the steep topography on both sides of the
road, low traffic volume, and existing large pine trees along the
edge of the road adjacent to the subject property. •
III.
The Commission finds that further discussion should be
deferred for a field trip to the site on September 30, 1980, and
that further considerations should again be delayed until October 21,
for review of a revised plan.
IV.
The Commission finds that revised plan "B", submitted on
October 21, 1980 should be approved because of hardship caused by
topography and lot design; that the requirement for a 50 foot front
setback is not critical in this case, since the elevation of the
house, which will be located below road level, provides sufficient
setback, that a Variance of Front Yard Requirements should be granted
in order to preserve substantial property rights in the same vicinity
and zone, and that the granting of such a variance would not be
materially detrimental to the public welfare, nor injurious to property
in the same vicinity and zone.
V.
From the foregoing it is concluded that a Variance of Front
Setback REquirements should be granted to Dr. Martin Goldberg, Lot
92-2-RH, Pine Tree Lane, and it is, therefore, so ordered.
VI.
The applicant is advised that this approval shall expire
one year from the date of grant, if not acted on. The applicant is
further advised that the time within which to seek judicial review of
this action is governed by Section 1094.6 of the Code of Civil
Procedure of the State of California.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ROLLING HILLS AMENDING ORDINANCE NO. 33 ENTITLED
"AN ORDINANCE OF THE CITY OF ROLLING HILLS,
CALIFORNIA PROVIDING FOR ZONING IN SAID CITY"
The City Council of the City of Rolling Hills, California
does ordain as follows:
Section 1. Ordinance No. 33, ARTICLE III, Section 3.06,
Front Yard is amended to read:
"Section 3.06. Each lot or parcel of land shall

have a front yard of not less than 50 feet,
measured horizontally from the front easement line."
