9 FINDINGS AND FORMAL REPORT
10 The application of Fred Sauer, Lot 14, Sunny Knolls,
11 for a side yard'variance, came on for hearing on the
12 22nd day of January, 1963, at the hour of 8:00 P.M. at
13
the City Hall of the City of Rolling Hills, California, and
14
15 the applicants having submitted evidence in support of their
16 application, and the Planning Commission being advised, now
17 makes its Findings and Formal Report as required by the
18 Ordinances of .the City of Rolling Hills,, California.

The Commission finds that the applicant Fred Sauer,
21
is. the owner of that certain real property described as Lot
22
23 14, Sunny. Knolls, located in the City of Rolling Hills,
24 California, and that notice of the public hearing in connection
25 with said application was given as required by Sections 8.06
26 and 8.07 of Ordinance No. 33 of the City of Rolling Hills,
27 California

.That no person appeared at said public hearing in

31 opposition to the application for "a variance and that no
32 evidence was received by the Commission in opposition thereto.

1 III.
In accordance with the plot plan filed herein the
Commission finds that the proposed residence addition of
4
applicant is to be located sixteen (16) feet from the side line
5
of said Lot instead of twenty (20) feet as required by said
6
7 Zoning Ordinance. The Commission further finds that by reason
8 of the terraine of said Lot 14, the variance should be granted
9 to applicant in order to preserve substantial property rights
10 possessed by other property in the same vicinity and zone, and
11
that the granting of such variance will not be materially de-
12
trimental to the public welfare or injurious to property or
13
14 improvements in such vicinity and zone in which applicant's
15 property is located, and that there are exceptional and
16 extraordinary circumstances and conditions by reason of physical
17 location and terraine of said Lot 14, which do not apply
18 generally to other property in the same vicinity and zone,
19
and that s6id proposed building to be located on Lot 14 will
20
be located thirteen (13) feet below the grade of the nearest
21
22 adjoining residence.
23 IV.
24 From the foregoing it is concluded that a variance should
25 be granted by the Planning Commission of the City of Rolling
26 Hills to Fred Sauer on Lot 14, Sunny Knolls in accordance with
27
the Plot Plan marked Exhibit 1 on file in these proceedings,
28
and it is, therefore, so ordered.
