100, Construct a Barn., Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) of ) ZONING CASE NO. 100 Dro Leonard Swanson Lot 14-CF FINDINGS AND REPORT The application of Dr. Leonard Swanson, Lot 14-CF, Chesterfie,d Tract for a variance under Article III, Section 3.01C of Ordinance No. 33, uses Permitted came on for hearing on the 18th day of May, 1971 in the Council Chambers of the Administration Building, 2 Portu- guese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Com- mission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Dr. Leonard Swanson, is the owner of that certain real property described as Lot 14-CF, Chester- field Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. IIo The Commission further finds that no person appeared at said pub- lic hearing in opposition to the application for a variance, and that no evidence was received by the Commission inopposition thereto. The Commission further finds that the applicant wishes to construct a stable approximately 10 feet from the easterly property line, and 10 feet from the westerly property line, instead of 25 feet from the exter- ior boundaries as required by the ordinance. Further, the Commission finds that because of the topography of the property, the stable would be 125 feet from the Swanson residence, 66 feet from the residence on the east, and 250 feet from the residence on the west. The Commission finds, therefore, that a variance of 15 feet of side yard requirements to allow for construction of a stable should be granted to the appli- cant in order to preserve •substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare or injurious to property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance under Article III, Section 3.01C of Ordinance No. 33, Uses Permitted, should be granted by the Planning Commission of the City of Rolling Hills to Dr. Leonard Swanson, Lot 14-CP, Chesterfield Tract, in accordance with the plot plan marked Exhibit I on file, in these proceedings, and it is, therefore, so ordered. /s/ Godfrey Pernell Chairman, Planning Commission Q ecretary, Planning C mission
