FINDINGS AND REPORT
The application of Mr. Bruce Kittrell, Lot 9-CF, Chesterfield
Tract, for a Conditional Use Permit under Section 3.01 (D); Paragraph 3
of Ordinance No. 170 came on for hearing on the 18th day of December,
1979, in the Council Chambers of the Administration Building, 2 Portu-
guese Bend Road, Rolling Hills, California, and the applicant, having
submitted evidence in support of the application, the Planning Commis-
sion, being advised, now makes its Findings and Report as required by
the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Bruce Kittrell,
is the owner of that certain real property described as Lot 9-CF,
Chesterfield Tract, located at 7 Chesterfield Road in the City of
Rolling Hills, and that notice of the public hearing in connection
with said application was given as required by Sections 8.06 and 8.07
of Ordinance No. 33 of the City of Rolling Hills, California. The
Commission finds that no comment, written or verbal, was received in
favor of or in opposition to the request.
II.
The Commission finds that it is the applicant's intention
to complete development of his property by building a guest house
adjacent to a tennis court which has been approved for construction on
a pre -graded pad below the residence and swimming pool, and above a
proposed stable and corral planned for a lower pre -graded pad. The
Commission finds that the property, consisting of 8+ acres, is not
suitable for subdivision, and that a Conditional Use Permit should be
granted in order to preserve substantial property rights in the same
vicinity and zone, and that the granting of such Conditional Use Permit
would not be materially detrimental to the public welfare, nor injurious
to property in the same vicinity and zone.
III.
From the foregoing it is concluded that a Conditional Use
Permit should be granted to Mr. Bruce Kittrell, Lot 9-CF, 7 Chester-
field Road, for construction of a guest house, subject to the follow-
ing conditions:
That no cooking facilities are permitted;
That occupancy of the proposed secondary living quarters
be limited to persons employed by the owner of the premises
or by temporary guests of the occupants of the main residence;
That no vehicular access or paved parking area be developed
within fifty feet of the proposed secondary living quarters;
That the Conditional Use Permit shall not be effective for
any prupose until the owner or his representative has filed
with the Rolling Hills City Clerk an affidavit stating that
he is aware of and accepts all conditions of approval of
the plan marked "Exhibit A";
and it is, therefore, so ordered. This approval shall expire one year
from the date of grant, if not acted on.
