237, Construct a Tennis Court & Poo, Resolutions & Approval Conditions• • BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) ) of ) ) ZONING CASE NO. 237 Mr. Bruce Kittrell ) ) Lot 9-CF ) FINDINGS AND REPORT The application of Mr. Bruce Kittrell, Lot 9-CF, Chesterfield Tract, for a Conditional Use Permit under Section 3.01 (D), Paragraph 3 of Ordinance No. 170 came on for hearing on the 18th day of December, 1979, in the Council Chambers of the Administration Building, 2 Portu- guese Bend Road, Rolling Hilis, California, and the applicant, having submitted evidence in support of the application, the Planning Commis- sion, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hilis, California. I. The Commission finds that the applicant, Mr. Bruce Kittrell, is the owner of that certain real property described as Lot 9-CF, Chesterfield Tract, located at 7 Chesterfield Road in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds that no comment, written or verbal, was received in favor of or opposition to the request. II. The Commission finds that it is the applicant's intention to complete development of the 8+ acre property by adding to the existing residence and swimming pool a tennis court to be located on a pre -graded pad below the residence, and above a proposed stable and corral planned for the lower pre -graded pad. The Commission finds that drainage from the proposed tennis court would be handled by a drain installed under the court which would carry water to a catch basin, and that natural growth will hide the drain installation. The Commis- sion finds that a Conditional Use Permit should be granted in order to preserve substantial property rights in the same vicinity and zone, and that the granting of such Conditional Use Permit would not be material- ly detrimental to the public welfare, nor injurious to property in the i same vicinity and zone. III From the foregoing it is concluded that a Conditional Use Permit should be granted to Mr. Bruce Kittrell, Lot 9-CF, 7 Chester- field Road, for construction of a tennis court, subject to the follow- ing conditions: That the owner sign an affidavit accepting the conditions of approval imposed by the Planning Commission; That the fence height be limited to eight (8) feet; That the landscaping of the tennis court be approved, and to the satisfaction of the Planning Commission; That a plan showing screen planting be approved by the Landscape Committee; That the walls be a uniform earthen color; That bonds for irrigation and landscaping be required to the satisfaction of the Manager to guarantee installation of the irrigation system and satisfactory growth of planting. That construction of the tennis court be started within one year from the date of approval, and completed not more than eighteen months after construction is started, and that irrigation and landscaping be done concurrently with con- struction and completed prior to use of the court; That the property be developed and maintained in conformance with the plan in the file marked "Exhibit A"; That if the intent of the permit is violated, the permit shall be void and the Conditional Use Permit shall lapse; That the fence be an appropriate color to reduce visibility from other properties; and it is, therefore, so ordered.
