FINDINGS AND FORMAL REPORT
The application of Jimmy A. Garcia, Lot 11,
Chesterfield, for a side yard variance came on for hearing
on the seventeenth day of December, 1963, at the hour of
8:00 P.M., at the City Hall of the City of Rolling Hills,
California, and the applicant having submitted evidence in
support of his application, and the Planning Commission being
advised, now makes its Findings and Formal Report as required
by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Jimmy A.
Garcia, is the owner of that certain real property described as
Lot 11 of Chesterfield Tract, located in the City of Rolling
Hills, California, and that notice of the public hearing in
connection with said application was given as required by
8.07
Sections 8.06 ancj/,of Ordinance No. 33 of the City of Rolling
Hills, California.
II.
That no person appeared at said public hearing in
opposition to the application for a variance and that no
evidence was received by the Commission in opposition thereto.

The Commission further finds that the proposed

2 residence of applicant is to be located eleven (11) feet from
3 the side line of said Lot and thirteen (13) feet from the side
4 line of said Lot instead of twenty (20) feet as required by
5 said Zoning Ordinance, and further finds that by reason of the
6 terrain of said Lot 11, the variance should be granted bo
7 applicant in order to preserve substantial property rights
8
possessed by other property in the same vicinity and zone, and
9
10 that the granting of such variance will not be materially detri-
11 mental to the public welfare or injurious to property or improv-
12 ments in such vicinity and zone in which applicant's property is
13 located, and that there are exceptional and extraordinary
14 circumstances and conditions by reason of physical. location
15
and terrain of said Lot 11, which do not apply generally to
16
other property in the same vicinity and zone.

19 From the foregoing it is concluded that a variance
20 should be granted by the Planning Commission of the City of
21 Rolling Hills to ITatnmytA'w Garcia of Lot 11 of Chesterfield Tract
22 in accordance with the Plot Plan marked Exhibit 1 on file in
23
these proceedings, and it is, therdfore, so ordered.
