FINDINGS AND REPORT
The application of Mr. Harvard Jee, Lot 11-CF, Chesterfield
Tract, for a Conditional Use Permit under Section 3.01, Paragraph 3 (a)
of Ordinance No. 170 came on for hearing on the 15th day of July, 1980
in the Council Chambers of the Administration Building, 2 Portuguese
Bend Road, Rolling Hills, California, and the applicant, having
submitted evidence in support of the application, the Planning
Commission, being advised, now makes its Findings and Report as
required by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Harvard Jee,
is the owner of that certain real property described as Lot 11-CF,
located at 8 Chesterfield Road in the City of Rolling Hills, and
that notice of the public hearing in connection with said application
was given as required by Sections 8.06 and 8.07 of Ordinance No. 33
of the City of Rolling Hills, California. The Commission finds,
further, that no comment, written or verbal, was received in favor of
or in opposition to the request.
II.
The. Commission finds that the applicant has requested a
Conditional Use Permit for construction of a structure to serve as
a guest house and servants' quarters. The Commission finds further
that the plan submitted shows
a future stable, and that the stable
will be built in a location recommended by the Planning Commission,
and a fence
will be constructed between the access road and the
guest house/servants' quarters. Further, the applicant has agreed
to have the paving on the existing access road removed and replaced
with a gravel surface to accommodate horses. The Commission finds
that a Conditional Use Permit should be granted in order to preserve
substantial property rights in the same vicinity and zone, and that

the granting of such Conditional Use Permit would not be materially
detrimental to the public welfare, nor injurious to property in the
same vicinity and zone.
From the foregoing it is concluded that a Conditional Use
Permit should be granted toMr. Harvard Jee, Lot 11--CF, 8 Chesterfield
Road, for construction of, a guest house/servants' quarters, subject
to Conditions 1 through 11 of the Conditions of Approval. for Guest
Houses/Servants Quarters, adopted by the Planning Commission on
March 18, 1980 (attached), and that bonding to the satisfaction of
the staff be required for landscaping and an irrigation system, and,
that the approved landscape plan be reviewed by the Planning Commission
after approval by the Landscape Committee, and it is, therefore, so
ordered. This approval shall expire one year from the date of grant,
if not acted on.
You are further advised that the time within which
judicial review of the action of the Planning Commission is•governed
by Section 1094.6 of the Code of Civil Proceedings of the State of
California.

to Conditions 1 through 11 of the Conditions of Approval. for Guest

March 18, 1980 (attached), and that bonding to the satisfaction of

that the approved landscape plan be reviewed by the Planning Commission
after approval by the Landscape Committee, and it is, therefore, so

CONDITIONS OF APPROVAL
GUEST HOUSES/SERVANTS' QUARTERS
While a complete list of conditions cannot be recommended until a
public hearing has been held and all testimony taken, the following
list of conditions pertaining. to guest houses/servants' quarters is
provided:
1. This Conditional Use Permitshall not be effective for any
purpose until the owner of the property involved, or his duly
authorized representative, has filed with the City Clerk of
the City of Rolling Hills an affidavit stating that he is
aware of and agrees to comply with all the conditions of the
Permit.
2. It is declared to be the intent of the Planning Commission that
if any provision of the Permit is held or declared to be invalid,
the permit shall be void and the privileges 'granted thereunder
shall lapse.
3. It is declared and made a condition of the Permit that if any
conditions thereof are violated, or if any law, statute or
ordinance is violated, the Permit shall be suspended and the
privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation
and has failed to do so for a period of thirty (30) days.
4. All requirements of the Zoning Ordinance and of the zone in
which the subject property is located must be complied with
unless otherwise set forth in the Permit, or shown otherwise
on an approved plan.
5. The property shall be developed and maintained in substantial
conformance with the site plan on file marked Exhibit "A".
except as otherwise provided in these conditions.
6. No vehicular access or paved parking area be developed within
fifty (50) feet of the proposed guesthouse or servants' quarters.
7. Occupancy of the proposed guest house or servants' quarters be
limited to persons employed wholly on the premises and their
immediate families, or by the temporary guests of the occupants
of the main residence.. No guest may remain in continuing.
occupancy for more than thirty days in any six month period.
8. Landscaping, irrigation plans and bonding may be required of the
applicant where applicable, to the satisfaction of the Planning
Commission.
9. Prior to issuance of building permits a grading plan, if necessary,
satisfactory to the City Engineer shall be submitted.
10. Renting of guest houses or servants' quarters is prohibited.
11. No sleeping quarters are permitted in cabanas or recreation rooms.
This Conditional Use Permit shall expire unless used within one year
from the date of grant.
