431, Grade slope for access road to, Staff Reports•**** STAFF REPORT DATE: JULY 9-, 1990 TO: PLANNING COMMISSION FROM: STAFF SUBJECT: ZONING CASE NO. 431; Request for Variance to encroach into the side yard setback to construct a retaining wall, and Site Plan Review for a proposed stable and deck; 28 Caballeros Road, Lot 12-SK; Owner: Rodriguez DISCUSSION The Planning Commission, at their regular meeting of June 19, 1990, continued the request to an adjourned meeting to conduct a field inspection of the subject site and surrounding properties. At the field inspection, the proposed site modifications to include stable access requiring a retaining wall encroaching 17 feet into the required 20 foot setback, a 1,152 square foot stable and a 1,120 square foot raised deck structure were evaluated. Issues addressed from the previous meetings are as follows: 1. Access to the stable requiring a variance to construct a retaining wall within the side yard setback and perimeter easement. It was noted that the Association has previously approved the stable footprint and access road as submitted. 2. Potential grading impacts to the natural terrain, natural vegetation and drainage of the site. 3. Adequacy of the stable design for the functional purpose. RECOMMENDATION The Commission must closely examine the proposed project and potential impacts inaccordance with zoning requirements addressing yard standards and development compatibility. Rodriguez Doug McHattie, South Bay Engineering June 9, 1990 1.383 acres gross; Irregular shape Single family residence, swimming pool A Variance to encroach into the side yard setback to construct a retaining wall, and Site Plan Review for a proposed stable and deck REVIEW AND EVALUATION OF ISSUES In reviewing the applicant's request under Title 17 (Zoning), staff would identify the following issues for evaluation: 1. The applicant desires a variance to construct a retaining wall within the side yard setback in order to develop vehicular access to a proposed stable; and Site Plan Review to construct a 1,152 squarefoot stable and 1,120 square foot deck. 2. The project calls for 350 cubic yards of cut/fill earth movement to develop the pads for the stable, deck and access path. The Commission must address those impacts as they pertain to modifications of the natural terrain and alterations of on -site and perimeter drainage courses. Cross -sections have been provided to show the proposed development and recontouring of the property. 3. Landscaping requirements should be addressed regarding retention and/or replacement of vegetation. 4. Lot coverage totals are not to exceed code limits (12.2% structure, 20.1% total). 5. The proposed access path and stable footprint has been previously approved by the Community Association Architectural Committee. RECOMMENDATION Staff recommends that the Planning Commission closely examine the proposed project and potential impacts in accordance with the zoning requirements addressing yard standards and development compatibility. In order before a variance may be granted, the Commission must determine that there are special circumstances applicable to the property, special privileges are not granted, and it would not be detrimental to the public welfare or injurious to other property. The Commission must also determine that the findings required for site plan review approval as set forth by the ordinance are satisfied. The Commission should receive public testimony and continue the matter to an adjourned meeting so as to inspect the site and surrounding properties. zc431rh
