Criteria to be satisfied for grant of Variances: Items of interest: Los Angeles County Fire Prevention has determined this property to be un-improvable as it is currently developed. The existing driveway, given its length of over 300 feet, is steeper than allowed, and at 11 to 14 feet wide, does not meet the minimum 20 ft. width requirement. Also, the required turnaround area for fire trucks at the pad cannot be met (hammerhead turnaround). The existing usable pad has 7,945 sq. ft. of area in the rear yard setback (area that is not counted in the area calculation sheets, but is used in the current development of the property). The existing home and garage encroach into the rear yard setback by as much as 28 feet, for a total area of 1,110 sq. ft. Discussion: The only solution to meet Fire Prevention driveway and turnaround requirement is to re-route the driveway across the northern slope of the property. In doing so, the length of the driveway is increased to such a degree that the fire code is met for pitch and width. A large motor court at the pad is included in the design to allow for the turnaround requirements. This is a hardship for the property. It affects the ability to site the home outside of the rear yard setback. Also, at 10,820 sq. ft. it forces the total developmental coverage to 39.5%, exceeding the maximum allowed of 35%. In an attempt to work with the existing pad and rear yard setbacks conditions, the proposed home only encroaches 21 feet into the 50 feet setback (in comparison to the existing 28 feet encroachment) and the area of the home encroaching has been reduced to 648 sq. ft. (in comparison to the existing 1,110 sq. ft.) a reduction of 462 sq. ft.) Such change will not be materially detrimental to the public welfare nor injurious to the property of improvements in such vicinity and zone where the property is located because: The existing total coverage of 38.8% is not noticeable given the topography of the property, in relationship to Bowie Road. The proposed design with a coverage of 39.5% is not materially different from the existing. Also, the rear yard setback has been increase, and the area of structure within the setback have been reduced. This all reduces the impact of the proposed project.
