FINDINGS AND DECISION
The application of ROBERT Y. IRWIN AND FLORENCE IRWIN
came on for hearing on the 14th day of August, 1961 at the hour
of 7:15 o'clock p.m., at the City Hall of the City of Rolling
Hills, California, on Resolution No. 6 of the Planning Commission
of the City of Rolling Hills recommending the amendment of
Ordinance No. 33 of the City of Rolling Hills to change the zone
of Lot 1 of Chesterfield Ranchos -A from Zone RAS-2 to Zone RAS-1,
and the applicants having submitted evidence in support of their
application, and the City Council having heard evidence in
opposition to said application, and being advised, now makes its
Findings and formal decision as required by Ordinance No. 33 of
the City of Rolling Hills, California.
I.
The City Council finds that true and legal notice of
the date, time and place of the hearing on said Resolution was
given as required by the Government Code of the State of California,
and Ordinance No. 33 of the City of Rolling Hills. That Robert Y.
Irwin and Florence Irwin are the owners of that certain real
property described as Lot 1, Chesterfield Ranchos -A located in the
City of Rolling Hills, California,

2 That said Lot 1 is located to the south of and adjacent

to the boundary dividing RAS-1 and RAS-2 in said City, and that

said lot contains approximately 3.148 acres, That access to said
Lot 1 is through an area now zoned RAS-one acre that is by the
7 way of Eastfield Drive, Chuckwagon Road and Bowie Roads.

9: That Mr. Paul Wallace, owner of Lot 4, Mr, C. W. Richards,

owner of Lot 2, and Mr. Arthur Pinner, owner of Lot 12, Chesterfielc
Ranchos -A, own property in close proximityto said Lot 1, were
opposed to the change of zone of said lot for the reason that said
13
14 change would deprive each of them of substantial property rights
15 they now enjoy in the ownership of their respective properties.

17 That William E. Greer, owner of Lot 5, Chesterfield
18 Ranchos -A, and one of the original developers of the said Chester-
19
field Ranchos area, is opposed to the rezoning of Lot 1 for the
20
reason that the same would deprive him of a valuable property
21
22 right for the reason that said Lot 5 was not capable of being
23 divided into two building sites that would, after the proposed
24 change of zone of Lot 1, still remain in Zone RAS-2. Said Lot 5

is adjoining to and lies directly to the west of said Lot 1 owned
by the applicants.

That the said Lot 1 should not be changed from Zone

30 RAS-2 to Zone RAS-1 only because the topographical profile of
31 said lot admits two possible building sites.

Theodore Robinson, owner of Lot 6, Chesterfield

Ranchos -A, was the land planner and designer of all of the lots
3
4 in the Chesterfield Ranchos -A area. That he was familiar with
6 the topographical and geographical features of the said Lot 1,
6 and that in his opinion said Lot J. should have located thereon
7 only one building site, and that said lot was designed by him to
8
accommodate only one building site.

That the rezoning of said Lot 1 from RAS-2 to RAS-1

12 would detract from the property values of all other properties
13 I in the area.
DECISION

From the foregoing Findings it is decided that the
15
16 granting of a change of zone of Lot 1, Chesterfield Ranchos -A
17 from RAS-2 to RAS-1 is not necessary for the preservation and
18 enjoyment of a substantial property right possessed by other
19 property in the same vicinity and zone, but which is denied to
20
Lot 1 and the applicants herein. The granting of said change of
21
zone for said Lot l will be materially detrimental to the public
22
23 welfare and injurious to the property or improvements in such
24 vicinity and zone in which the said Lot 1 is located.
25 Resolution No. 6 of the Planning Commission recotuiiending
26 the change of zone for Lot 1, Chesterfield Ranchos -A, is disapproved
27 and the applicants' request for a change of zone of Lot 1, Chester-
26 field Ranchos -A from RAS-2 to RAS-1 is denied.
