C. Miller ) ) Lot 13-CRA ) FINDINGS AND REPORT The application of Mr. A. C. Miller, Lot 13-CRA, Chesterfield Ranchos, for a conditional use permit for construction of a paddle tennis court under Section 3.01, Paragraph 3 (c) of Ordinance No. 150, came on for hearing on the 17th day of October, 1978 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, in the City of Rolling Hills, California, and the applicant, having sub- mitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. A. C. Miller, is the owner of that certain real property described as Lot 13-CRA, located at 11 Bowie Road in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds that no comments, written or verbal, were received in opposition to the request, and that Mr. George Moll, 9 Bowie Road, and Mr. Anthony Vinter, 9 Reata Lane, looked at the map and said they had no objection to the court. II. The Commission finds that the original submittal, marked Exhibit "A" required two retaining walls and a fence ten feet high. At the request of the Commission a plan marked Exhibit "B" was entered into the file, showing the paddle tennis court sunken to a depth of five feet and surrounded by a berm five feet high which would have a three foot high chain link fence on top. The Commission finds that an effort should be made to retain the rural atmosphere and pastoral views, and that a conditional use permit should be granted in order to preserve substantial property rights possessed by other properties • • in the same vicinity and zone, and that the granting of such permit would not be materially detrimental to the public welfare nor injur- ious to property in the same vicinity and zone. III. From the foregoing it is concluded that a conditional use permit for construction of a paddle tennis court should be granted to Mr. Miller as shown on Exhibit "B" in the file, which amends Exhibit "A" by showing a sunken paddle tennis court with a three foot high chain link fence on top of a five foot berm, with the condition that landscaping be done to make the wall less visible, such landscaping to be approved by the Landscape Committee and re- ferred to the Planning Commission for review and approval, and that the retaining walls remain natural and not be painted white, and it is, therefore, so ordered.
