179, Install an inground pool, Resolutions & Approval Conditions4 BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Janusz Brzezinski Lot 36-GF ZONING CASE NO. 179 FINDINGS AND REPORT The application of Mr. Janusz Brzezinski, Lot 36-GF, Georgeff Tract, for a conditional use permit under ARTICLE III, Section-3.07, Side Yard Requirements, Ordinance No. 33 and Section 3.01, Paragraph 3 (c) of Ordinance No. 112 for construction of a swimming pool in the side yard came on for hearing on the 15th day of February, 1977. in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having sub- mitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Janusz Brzezinski, is the owner of that certain real property described as Lot 36-GF, located at 3 Buckboard Lane in the City of Rolling Hills, and%.that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds, further, that no communication, written or verbal, was received in favor of or in opposition to the request. II. The Commission finds that the applicant requests the con- ditional use permit for construction of a swimming pool as shown on original plans for the residence. In order to locate a pool on the property it would be necessary to project into the side yard, but not into the easement. Plans submitted indicate that the parcel consists of 1.169 acres in the RAS-1 zone; construction would cover 10% of the property, and total development would result in 17% lot coverage. The Commission finds that a conditional use. permit should be granted in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such conditional use permit would not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. III. From the foregoing it is concluded that a conditional use permit should be granted to Mr. Janusz Brzezinski for a swimming pool which woulf project into the side yard of Lot 36-GF, subject to the conditions that the Landscape Committee of the Rolling Hills Community Association be requested to make a field trip to the pro- perty to establish requirements for screening the pool from the road and trail as necessary, that pool equipment be screened, and that no pool -related accessory structure exceed 42" above grade, and it is, therefore, so ordered. cretary, Planning ommission /s/ Forrest Riegel Chairman, Planning Commission
