34, decrease the front yard setbac, Resolutions & Approval Conditions8 FINDINGS AND FORMAL REPORT 9 10 The application of Donald Barclay, Lot 34A, Georgeff 11 Ranchos Tract 19040, to establish a front yard setback in 12 accordance with Section 3.06 of Ordinance No. 33, came on 13 for hearing on the 28th day of May, 1963, at the hour of 14 8:00 P.M., at the City Hall of the City of Rolling Hills, 15 California, and the applicant having submitted evidence in 16 17 support of his application, and the Planning Commission being 18 advised, now makes its Findings and Formal Report as requited 19 by the Ordinances of the City of Rolling Hills, California. 20 I. 21 The Commission finds that the applicant, Donald 22 Barclay, is the owner of that certain real property described 31 32 BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS, 2 COUNTY OF LOS ANGELES, STATE OF CALIFORNIA 3 In the Matter of the Application ) 4 ) of ) 5 .) III. The Commission further finds that said proposed residence is to be located twenty (20) feet from the road instead of the thirty (30) foot front yard setback as required by the Zoning Ordinance, and further finds that by reason of the terrain of said Lot 34A, and the fact that a building pad had been previously graded thereon, the variance should be granted to applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare or injurious to property or improvements in such vicinity and zone in which applicant's property is located, and that there are exceptional and extraordinary circumstances and conditions by reason of physical location and terrain of said Lot 34A, which do not apply generally to other property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance should be granted by the Planning Commission of the City of Rolling Hills to Donald Barclay on Lot 34A, Georgeff Ranchos Tract 19040, in accordance with the Plot Plan marked Exhibit I on file in these proceedings and, it is therefore, so ordered.
