FINDINGS AND REPORT
The application of Mr. Paul Steffan, Lot 35-GF, Georgeff Tract,
for a conditional use permit under Article III, Section 3.06, Front
Yard Requirements, and Section 3.07, Side Yard Requirements, Ordinance
No. 33, for construction of a residence with less than the required
front yard set -back, swimming pool in the front yard, and retaining wall
in the side yard came on for hearing on the 18th day of May, 1976 in the
Council Chambers of the Administration Building, 2 Portuguese Bend Road,
Rolling Hills, California, and the applicant, having submitted evidence
in support of the application, the Planning Commission, being advised
now makes its Findings and Report as required by the Ordinances of the
City of .Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Paul Steffan, has
entered into an agreement with Mr. B. R. Snyder, owner, for purchase
of that certain real property described as Lot 35-GF, Georgeff Tract,
located in the City of Rolling Hills, California, and that Mr. Snyder,
in a letter to the City of Rolling Hills dated May 4, 1975, approved
application for the conditional use permit. Notice of the public
hearing in connection with said application was given as required by
Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills,
California.

The Commission finds, further, that no person appeared at
said public hearing in opposition to the application, and that Mr.
Donald Barclay, owner of Lot 34A-GF, an adjacent parcel, had viewed
the plan submitted by Mr. Steffan, and had made no comment in favor of
or opposition to the request.
III.
The Commission further finds that the front of the lot is that
portion of the parcel bound by Buckboard Trail, a private driveway giving
access to parcels 34-B and 34-C, which are adjacent to the property.
Said access is a continuation of an easement from Buckboard Lane. Access
to Lot 35-GF is provided by a cul de sac at the end of Buckboard Lane.
The applicant requests the conditional use permit for construction of a
residence with less than the required set -back, because of a limited build-
ing site available on the lot, which consists of 1.882 acres in the RAS-1
Zone, but which cannot be fully developed because of lot design and topo-
graphy. Further, the Commission finds that the applicant requests per-
mission to construct a swimming pool in the front yard as part of the
residence.design, and further requests a conditional use permit for con-
struction of a retaining wall in the side yard to permit development of
a driveway from the cul de sac to the residence. The applicant advised
the Planning Commission that in addition to the limited area available
for construction of a residence, design is further limited by his desire
to retain a 180° view from the proposed residence.
After considerable discussion of the matter, the Commission
finds that a request for three separate conditional use permits indicate
that the residence being planned is not appropriate for the lot, and
that a residence which might be developed for the property in the required
set -back would be small in size and of a design inadequate for the community,
different in concept from the rest of the city, and materially detrimental
to property in the same vicinity and zone.
IV.
From the foregoing it is concluded that conditional use permits
should not be granted under Article III, Section. 3.06, Front Yard Re-
quirements and Section 3.07, Side Yard Requirements of Ordinance No. 33
to Mr. Paul Steffen in order to preserve substantial property rights
possessed by other property in the same vicinity and zone and that the
granting of such conditional use permits would be materially detrimental
to the public welfare and injurious to property in the same vicinity and
zone, and it is, therefore, so ordered.
