Dear Mr. and Mrs. Tsai:
City Manager Craig Nealis and I appreciate Mrs. Tsai meeting with us on Thursday, April 13, 2000,
to discuss the landscaping of the outer side of the retaining wall along the west side of your
property where the growth of the oleander bushes may obstruct the existing Caballeros riding trail
in the future.
We have spoken with the City's Landscape Consultant Julie Heinsheimer and learned that Ficus
repens (Creeping fig) can be planted in 2 feet of soil along that outer portion of the retaining wall
and that these plants will thrive once established. This should allow the plant material to be planted
immediately adjacent to the outer wall above the wall footings.
We would appreciate hearing from you within the next two weeks (by May 2, 2000) about these
plants and your ability to plant them within the next few weeks. In addition, it would be most
helpful if you would remove the oleander bushes and fill in the holes once the vines are
established.

Thank you for your letter dated November 1, 1999. We appreciate your responding to our concerns in
writing.
Your correspondence was in response to our request for information as to when you plan to plant the
landscaping to obscure the subject retaining wall from the views of adjacent properties. That landscaping
was to be planted within one (1) month of the completion of the retaining wall approved by the Planning
Commission in Zoning Case No. 549 on February 11, 1997 by Resolution No. 97-6. On June 4, 1997, you
posted a landscape bond in the amount of $690.00 for the landscaping. The retaining wall was completed
and finaled on February 1. 1999 and landscape plantings to obscure the retaining wall from adjacent
properties along with the removal of stockpiled soil and debris has not been undertaken.
In your correspondence, you request that we extend your request until April, 2000 before planting the
landscaping.
We will honor our original extension of the requirement to plant the landscaping until February 1. 2000.

Albert E. Tsai Debra Y. Tsai and we received the letter date October 19,1999.
Since we received the letter, Albert spoken with Mr. Craig NealIs and Ms. Lola M
Ungar over the phone. We understand that we need to finish the landscaping
along the retaining wall. Mainly because the economic crises and lately the
earthquake make our business become more stressful for us. Albert has stay
there for longer period of time. From our past experience, in order to get thing
done right it must take a lot of personal attention from us during the construction.
We would like to prepare the soil and install sprinkler or dripping system before
we can plant any thing. We plan to have this done by the end of April 2000
because the beginning of the year Albert can spend more time here.
For the swale between our property with Mr. Torres's property, I already has an
engineering firm gave us an initial consultation. The topology survey along the
property line just finishes not long ago. I will give the survey to a structure
engineer to work on. In the meantime I already have worker clean the stockpile
of soil. I discussed with Mr. Torres in case a rain will coming I will have the
worker put the plastic cover to cover the slope for now.

On October 12, 1999, I talked with Mrs. Tsai about the lack of landscaping to obscure the retaining wall from
the views of adjacent properties. That landscaping was to be planted within one (1) month of the completion
of the retaining wall approved by the Planning Commission in Zoning Case No. 549 on February 11, 1997
by Resolution No. 97-6. On June 4, 1997, you posted a landscape bond in the amount of $690.00 for the
landscaping. The retaining wall was finaled on February 1, 1999 and you still have not removed the
stockpiled soil and debris or planted the landscaping to obscure the retaining wall from adjacent properties.
Since that time, we have spoken with you on numerous occasions about the lack of landscaping, the
stockpiling of soil and debris on your property, and the necessity of a swale or drainage system between
your property and Mr. and Mrs. Rafael Torres' property at 10 Bowie Road. We spoke with Mr. or Mrs. Tsai on
May 26, 1999, June 4, 1999, June 8, 1999, June 10, 1999, June 21, 1999, June 22, 1999, August 9,
1999, and August 19, 1999 besides our recent discussion with Mrs. Tsai on October 12, 1999.
Please contact this office in writing within the next two weeks (bv November 3. 1999) to inform us of any
planned action. We would like to avoid consideration of more drastic action to gain compliance with required
conditions.

RESOLUTION NO. 97-6
Dear Mr. and Mrs. Tsai:
This letter shall serve to notify you that the Planning Commission adopted a
resolution on February 11, 1997 to approve your request for a Variance to encroach
into the front yard setback to construct a retaining wall and a request for a Variance
to encroach into the side yard setback to construct the same retaining wall at a single
family residence in Zoning Case No. 549. That action, accompanied by the record of
the proceedings before the Commission, was placed as a report item on the City
Council's agenda at the Council's regular meeting on Monday, February 24, 1997. At
the meeting, the Council received and filed these documents.
The Planning Commission's decision in this matter shall become effective thirty
days after the adoption of the resolution by the Commission, unless an appeal has
been filed or the City Council takes jurisdiction of the case within that thirty (30) day
appeal period (bv March 13, 1997). (Section 17.54.010(B) of the Rolling Hills
Municipal Code). Should there be an appeal, the Commission's decision will be
stayed until the Council completes its proceedings in accordance with the provisions
of the Municipal Code.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and
you will be required to cause to be recorded an Affidavit of Acceptance Form
together with the subject resolution in the Office of the County Recorder before the
Commission's action takes effect.
We have enclosed a copy of RESOLUTION NO. 97-6, specifying the conditions of
approval set forth by the Planning Commission and the approved Exhibit A
Development Plan to keep for your files. Once you have reviewed the Resolution,
please complete the enclosed AFFIDAVIT OF ACCEPTANCE FORM, have the
signature(s) notarized, and forward the completed form and a copy of the
Resolution to:

We have arranged for the Planning Commission to conduct a field inspection of
your property to view a staking of the proposed project on Saturday. February 8,
1997.
The Planning Commission's timetable is to meet at 7:30 AM at your property at 8
Bowie Road.
The site must be prepared according to the following requirements:
• Stake the property lines, the easements, and the front (50 foot) and side (35 foot)
setback lines in relation to the proposed retaining wall. Use small pieces of cloth
or flags attached to wire or twine to aid in the visualization of the proposed
construction.
The owner and/or representative should be present at the field trip to answer any
questions regarding the proposal.
