Originally, as a condition of approval of the development, this tree and another Pine tree located further down the driveway were to be removed. With your and Mr. Inman's (11 Caballeros) permission staff is able to approve Mr. Karpf's request to keep the top tree. In your letter you request that the City assure you that this tree or any other new or existing trees and vegetation located on 8 Maverick Lane not be allowed to grow into your view, and that this condition apply to any new property owners of this lot. As a condition of approval of the 8 Maverick Lane project, the Planning Commission placed a condition on the property that the new trees to be planted in conjunction with this development, at maturity, shall not exceed the height of the roofline of the residence and shall be maintained at that height at all times. This condition runs with the land and therefore any future owners will be required to adhere to it. The City has no authority to place a condition on existing trees, and therefore, such condition was not placed on Mr. Karpf's development. However, should the Pine tree that is subject to this approval, grow into your view, Mr. Karpf or any subsequent property owner will be required to trim it or remove the tree, as it was originally required. I would suggest that you take a picture from your property of the tree for future reference. The City has a process, through its View Preservation Ordinance, by which a property owner could apply to have his/her view restored. In that letter, Mr. Karpf stated his reasons for wanting to save the one tree and that he believed the one remaining tree was not in our view. We would like to make it clear that both trees are, in fact, in our view —especially in our view of Mt. Baldy. However, we want to be good neighbors and have agreed to let Mr. Karpf keep the one tree he has chosen at the top of his driveway. Mr. Karpf has also removed the eucalyptus trees and stumps that were re -growing into our view and we appreciate that. We request that any trees or vegetation now on his property, or any planted in the future, not be allowed to grow into our view as the pine tree has done, and that any future owner of the property would do the same. When we bought our property in 1971, we had an unobstructed view of all of the Los Angeles Basin from inside King Harbor to Long Beach and Orange County, including all of the mountain ranges from west to south, and we prized that very much. There are now eight Catalina Cherries planted in the area circled in red on the enclosed plan — all planted with my permission by Mr. Lay a couple of years ago. Please confirm for me that this is sufficient to meet the requirements of the approved plan by the City Council and if so, please amend our proposed Landscape Plan to indicate that these will be Catalina Cherries rather than Ficus Benjaminas. Following a visit to the property today and further review, City staff has determined that the side setback along the westside of your property shall be considered as one continuous setback. Thus, the proposed parking area in the side setback will not exceed 10% of the total side setback. For formal approval of the new location for the parking area, please provide the City with an updated site plan including calculations for revised hardscape, quantities of any anticipated grading, and information/details with regard to any additional walls to be constructed. Per Resolutions 2008-18 and 2010-23 for the project (conditions AD and L, respectively), if there is to be additional grading or structural development, it may be necessary for the Planning Commission to review the proposed modification. Additionally, Fire Department approval will be necessary. I believe the intent of the 10% limit for a parking area within a side or front setback is to retain open, unobstructed space (e.g., landscaping) between properties. Consistent with the General Plan, this is to maintain privacy and distance between homes and related uses and to not have a large parking area along the perimeter of a property. This particular provision in the zoning code was adopted September 1981 and is referenced in the Environmental Information Form submitted with development applications (section 17g and 17h). In our conversation, you suggested that a number of properties in the City appeared to have driveways exceeding 10% of the side setback and inferred that City staff has not been consistent in the application of the zoning. As stated in the enclosed portion of the Municipal Code, the zoning code allows 20% of a setback to be used for a driveway. With the distinction between driveways and parking areas in mind, we have reviewed each property you cited and determined each property, where records exist, is consistent with the zoning code. • 18 Crest Road East: This property has four side yards due to its shape; of which three are on the westside and one is on the eastside. 50% of the parking area is in one of the side setbacks (the portion closest to the garage on the westside) however; it constitutes just 6.5% of the total of that particular side setback. According to our records, no driveway reconstruction has been made since 1975. • 29 Crest Road East: The City has no records readily accessible on this property. • 35 Crest Road East: The City has no records readily accessible on this property • 18 Portuguese Bend Road: The parking area is not in any setback. Furthermore, by way of example, the property at 3 Meadowlark, recently approved for development, required a variance to have over 10% of its motor court area within the setback and, the recent approval for 12 Ringbit East was conditioned with a requirement that the parking area and the driveway not be enlarged. In conclusion, City staff strives for consistency with the General Plan through its approvals and in its application of the zoning code. Decisions relative to the zoning code are made with the best interest of the City in mind with no prejudice to the individual(s) submitting an application or seeking the approval. Staff is also able to reconsider its decisions when presented with information and reasoning to justify a change in course. Being mindful of the intent of the General Plan, the zoning code as well as your request, we have determined your proposed motor court is allowable within the existing setback. We would request/suggest, however, that you consider softening the look of the parking area by utilizing a pervious surface, such as grass- crete, on at least a portion of the parking pad. Please submit the earlier referenced site plan information for review of the proposed motor court for approval. Your input was appreciated, as were the insights that you provided concerning the project. I understand that your Department initially determined that because of insufficient water flow at the hydrant closest to my home, that there would be a requirement that we upgrade this hydrant to 6". However, the main that runs to this hydrant is only 4" and so it would have to be replaced. However, to replace this main line will be prohibitively expensive. I have attached a letter from Henry Wind, District Manager of the California Water Services Company, to Marion Jaikowski of the County Fire Department. In it Mr. Wind estimates the cost of upgrading this 4" hydrant and replacing 700' of water main at $210,000 (two -hundred and ten thousand dollars). Such a sum is quite cost prohibitive, so much so that it might make it impossible for me to go forward with our project because of this unexpected added expense. It seems to me that to require an individual property owner to bear such an enormous expense in conjunction with a remodel and addition places an undo burden on him. Fortunately, in speaking with you it appears that there is an altemative that would satisfy the Fire Department's requirements for sufficient water flow but would be significantly less expense. This would be for us to upgrade the hydrant that is at the corner of Caballeros and Maverick with a 6" hydrant. As this hydrant is currently served by a 6" main there would be no need to upgrade it and the combined flows from the two hydrants would be sufficient to meet the Department's requirements. I understand that in order to provide additional safety we would be required to install sprinklers in our project. This is something that we are willing to agree to so that we are able to move forward with this project. Thank you for joining me at our new home site to conduct your Site Plan Review in conjunction with approval of our remodeling / reconstruction request. It is our hope that as a result of this Site Plan Review the Commissioners will have a first hand opportunity to observe several important aspects of the property and our plans (as delineated by the silhouette and lot line, easement and set back stakes.) The aspects that I hope will be observes are as follows: 1. How truly little, if any, change there is to the feeling of openness as a result of our changes to the structure. While the 1600 sq. feet of addition seems like a lot because of the way in which it is being added it does not appear or feel like a lot. This is not a case where we are asking for a 1600 sq. foot addition to be added to an existing structure. Rather it is a project where we will be replacing the older part of the home with a structure which is only somewhat larger in each of its boundary dimensions (i.e. pushing out the walls in each direction.) 2. Because of the large size of the property (net sq. ft. of 110,320) and the fact that the proposed reconstruction sits very comfortably on the existing pad without any overcrowding whatsoever, the requirements of the General Plan and the intent of the pad coverage guidelines with respect to preserving a feeling of openness and lack of overcrowding is more than met. • • 3. Distances from all improvements as proposed to the top and toe of slopes and from building setbacks far exceed standard expectations for similar homes in the community. This is true with respect to Rolling Hills in general but is particularly true for homes on Maverick and the adjacent Caballeros Road. This feeling of openness and the distances of setbacks and distances from adjacent homes for this property as proposed is much in excess that for other homes on these two streets where lots tend to be smaller and homes closer together. A quick drive up and down Caballeros and Maverick will verify this. 4. The entire home, including the proposed expansions, are on an area of the pad that cannot generally be seen by neighbors or the community at large due to the existing topography and landscaping. It is significant that there are only six or seven homes that even have a view of this property and of those, only three can see the area of proposed improvements. All of the owners of these properties have received notices from the City and all of them have been written to personally by the applicants. Of these six or seven that can see the home at all, four have expressed their support for this project and the others have remained silent. Of the three that can see the area of proposed improvements two owners have expressed their support and one has remained silent. Of those who have remained silent, although they can see the area of proposed improvements, it is unlikely that they would be able to tell that there had been a change. 5. There are two areas of the building pad (in the front where the front yard meets the retaining wall that runs at the base of the driveway and at the rear slope) where additional building pad square footage could be obtained with retaining walls which conform to zoning code requirements. We (the architect and applicants) estimate that an additional building pad square footage of between 1500 —1800 square feet could be obtained in this manner. During the site plan review the applicant will point out the areas where this can be accomplished. While the applicant may elect to add some of these retaining walls for esthetic reasons, to add them all would create unnecessary expense and disruption of the neighborhood during construction. We would like to avoid both. However, it, along with regrading of the pad itself, remains an option to obtain a larger building pad. 6. Landscaping. This overall project includes extensive landscaping of the property. This landscaping will greatly soften the neighbor's view of those portions of the home that will not be re -built as part of this project. During the site plan review the applicant will point out the landscaping that is to be done in conjunction with this project. It was mentioned above that there was one neighbor who had remained silent on this application but who would be able to see (but likely not be able to see the difference) the portions of the residence to be modified. As a result of the landscaping that is to be done, it is unlikely that � 4y • this neighbor will even be able to see the portions of the residence which have been modified. All other neighbors who will be able to see ANY portion of the residence will benefit from the landscaping that is being done in conjunction with this project. The entire neighborhood will benefit from the project. 7. ALL of the neighbors who are in closest proximity to this property and who have had an opportunity to review the plans for this project have indicated their support of the project (two of them in person at the last hearing). This project is supported because it will be good for the neighborhood. The applicant will point out the location of these neighbor's homes during the site plan. Nonetheless, we feel the proposed additions are consistent with both the general plan and the intent of the guidelines for the following reasons: 1) The large size of the property of 110,320 net sq. ft. easily supports the size of the home and other improvements as demonstrated by the structural lot coverage figure of 10.96% with total coverag including hardscape of 24.03%. 2) The existing pad could be increased in size to support the guideline of 30% with additional grading. This is undesirable in that: a) The environmental disruption to the neighborhood while re -grading the lot is needless. b) The costs incurred by the property owner would be a hardship. 3) The proposed additions fit comfortably on the existing pad without overcrowding. 4) Distances from the proposed additions, as well as from the existing improvements, to top and toe of slopes, and from building setbacks, far exceed standard expectations for similar homes in the community. 5) The proposed additions are on an area of the pad that cannot be seen by neighbors or the community at large due to the existing topography and landscaping. 6) The entire property is below street level with the improvements accessed via a long, down slope driveway. As I mentioned, our intention is to do some extensive remodeling which will involve rebuilding the older wing of the home and which will also involve obtaining Planning Commission, City Council and RHCA approval. My sense is that what we are proposing to do will not have any effect on the esthetics or views of your home as we will be retaining pretty much the same footprint for the house as we currently have although we will be enlarging it somewhat (hence the need for city approval). We are also proposing building a garden room / building down the slope below the house (where the driveway now ends) but I don't think that you will be able to see that, though 1 cannot say that with certainty (you would probably be able to see it from some points on your property though not from your home and patio.) In general I think our plan is very sensitive to preserving the neighbors views and esthetics and in the case of many of the neighbors I think the esthetics of their properties will be increased by the landscaping we will be doing. Regardless of the lack of impact on your property, I would still like to meet with you and have the opportunity to show you what we are planning. Provide plan showing "as graded" areas and provide accurate calculations for disturbed area. The plans from 1999-2000 approval show disturbed area at 38.6% of the net lot area. However during the construction process, there were some revisions in the grading areas and in grading quantities, calculations for which are not reflected on any of the old plans. If the amended grading areas resulted in greater than 40% disturbance, a Variance should have been applied for at that time. State somewhere on the plan whether the utility lines to the residence and guest house were placed underground. 4, Delineate on the plan the 5,261 sq.ft. stable pad. 5. Show all existing and proposed retaining walls, show the height (is there a retaining wall along the driveway?) 6. If known, show the location of the septic tank. 7. Refer to the Site Plan submittal checklist instructions to assure that all information is included on the plans and the application, and submit 15 sets of completed plans by July 7, 2008, _(except for item #1) Please note that the City may require further information in order to clarify, amplify, correct, or otherwise supplement the application.
